    Default Somebody reversed into my car

    Last night somebody reversed into my car. It's not too damaged, just mainly scratched however I don't know too much about car crashes so just want to ensure it will be classified as their fault not mine.

    So what happened was, they were driving straight down one side of the road (I was on the other side of the road - facing the other direction).
    I waited for them to drive past, then I did a u-turn so was behind them. They then stopped their car and began to reverse back to reverse parallel park but hit me (as I was stationary behind them and didn't have time to move back).

    When we got out of the car they first said "I don't know who's fault that was"
    I replied "It was yours because you reversed into me"
    They said "I didn't see you"
    I said something like "don't you look properly on both sides"
    To which they said sorry.

    Now I got my male friend to call them last night to sort it out and since then the lady has been speaking to her husband who is now saying it might not be her fault. Our insurance companies are going to need to sort it out but just want to know if anybody has any experience in this, am I in the right?
    Some mistakes are too much fun to only make once.

    Make sure they stick to their story that they were moving and you were stopped. Generally insurance companies look at damage to the front of one car and the rear of another, and say it was the fault of the one in the rear that hit the car in front of them. I would get them to make that statement to a credible witness, the police or your insurance company before they change their story. good luck. (I just noticed you are in Australia. My comments apply to US insurance companies. I have no idea about over there where you blokes drive on the wrong side of the road!) ;-)

    That's what I'm worried about - usually it's the person who is behind who is at fault..

    something similar to this happened to my mom. The other woman said they'd handle this by themselves cuz it was a minor accident but she went home, decided it would've raised her insurance too much and changed the story to make it look like it was my mom's fault. Moral of the story is next time this happens wait for cops to come so you can get the story straight to them at the scene of the incident and have the other person wait too. And try to get the number of a witness. If she changes the story perhaps you can take her to small claim claims court. My mom was able to get 700 dollars out of the grand she was owed for damages by doing this. The lady later told her that she lied because it would've raised the cost of her insurance too much. It's a sick, sad world.

    ^ Argh that scares me. I just hope she doesn't think about it and change her story because I'm sure she could quite easily lie and make it look like my fault. I guess I'll just keep my fingers crossed :-/
