    Default Liability, suing for deaths

    There was a horrific incident last year of a man and his wife in Long Island who were addicted to Hydrocodone, went in to a pharmacy to rob and killed a few people. They were convicted and sentenced. Man is to serve 5 life terms and wife 25 yrs. Here is the article on that...

    The daughter and family of this one victim is suing the following people and company, pharmacy owner, police dept and its former commissioner, even the manufacture of the drug. Here is my question, I know she can sue, anyone can sue for pretty much anything but do you believe she has a case? I do not believe she will be able to get anything, monetary, or even prove these people have fault in the outcome of this incident. Do you? Here is the article about the lawsuit.

    I think the only way she'd have a case (and even still it's a big maybe) is if her lawyer could show that the company did something illegal/negligent, such as being aware that the drug is addictive but not providing a warning on the label. The pharmacist could be liable for something if the man and his wife were on other prescription drugs that interact negatively with the hydrocodone, notified the pharmacist of their other prescriptions, and the pharmacist failed to recognize the harmful combination when giving them their new prescription. In general if every one did their job and didn't mess up, then I don't think there is anything you can fault the company/pharmacy/etc with. Even if they did mess up, hitting them with a wrongful death suit seems pretty flimsy still. You might get them on some lesser charge related directly to what they screwed up though.

    I suspect they are hoping to be offered a cash settlement to avoid the bad publicity.
