    Default Cell Phone Rules in clubs

    i can't seem to get a straight answer on this one. clubs i've worked at have been very lax about watching/acting on guys taking video/pix of the girls on stage. one club i worked at didn't want dancers grabbing phones out of the guys hands. we were suppose to have one of the lazy bouncers go through the guys phone. the bouncers would help if they felt like it, or lazily go through the phone.

    i know there is a law regarding personal property BUT when someone is emailing their friends pix and video of us nude, that crosses the line regarding a dancer's privacy. the guys are here to watch the girls not send videos to their friends. if they are doing that, they deserve their phone smashed or a drink poured on it.

    if i wanted to have video out there, i'd be a porn star or camming.

    seems as though there should be a labor law or SOMETHING that can be done about this.

    anyone know any lawyers??

    I'm not sure about legal rights for dancers on this one, but I definitely agree with you. My first club had bouncers just like you described, and it made me so mad. Luckily my club now is a bit better, but only if the dancer insists. I've had guys tape me before and the bouncers think it's enough to just suggest to the guy that he deletes it. Each time I would insist that they take the guys phone and wipe the memory card, and I wouldn't let it go, and they did it.

    It would definitely be good if there was some kind of privacy law out there that applied. I know my club now has a sign up (although I've never seen it enforced) saying that patrons must not use recording devices or they will be seized. Maybe dancers' whose clubs had similar signs could try to file a claim with the police if it happened to them, although they might be putting their job in jeopardy. Few club owners like having the police show up at the club.

    i'm really tired of the attitude w/staff, almost like, 'well, you're naked and choosing to do this job, too bad.' the way i feel, if there were no girls willing to get naked, YOU wouldn't have a job and this club wouldn't be here.

    i wonder how these guys would like to have naked video getting out for all their family, kids and coworkers to see?

    That is the only bright side of the horrendous clubs in Virginia; cellphones are forbidden at the floor.

    Believe it or not, by the letter of the law, the main club area and the club stage area are legally considered to be 'public' places. Thus by the same letter of the law, dancers have no right of privacy claim in regard to pics or videos shot in a club for 'personal use' ... because this is simply an extension of the customer's right to see you perform nude. Or put another way, whatever right to privacy that dancers surrendered when they agreed to perform nude for club customers 'live' also applies to pics and videos of them performing nude. Now, if some 'for profit' element arises in regard to the customer's use of said pics or videos, that's a different story. But in the absence of customers 'profiting' from said pics or videos, they are legally entitled to use those pics and videos for any and every sort of 'non-profit' purposes they choose.

    The club OWNER / Franchise Manager has the legal right to prohibit customers from bringing cell phone cameras and other types of recording devices into the club ... but this is accomplished via establishing a legal agreement with the customer as a condition for admission. This typically requires, at minimum, a posted notice which is viewable by the customer before they pay the cover charge ... with payment of the cover charge constituting legal agreement by the customer to the terms of the posted notice. But there is no mandate that a clubowner / manager must post such a notice - it's strictly a matter of choice on the part of the clubowner.
