    Default Spearmint Rhino Lawsuit

    I received a letter in the mail saying that I am part of a lawsuit and/or settlement due to unfair tipsharing. I guess a bunch of dancers decided to sue..... ha ha

    Did anyone else receive this? What the heck is going on? It pertains to any Spearmint Rhino in Nevada, Texas, California, Florida, and other places.....

    There hasn't been any official publicity as to what's happening at this very moment, but it's not hard to take a couple of 'educated guesses'

    - after floundering around the court system for a few years now, the legal process has gone far enough where an actual high profile trial is imminent.

    - Dancers who did not choose to 'opt out' of the class action lawsuit when given the opportunity to do so a couple of years ago are now being officially listed as 'plaintiffs' as the court documents are being filed.

    - the snail mail notification you received is official acknowledgement of your status as 'plaintiff' in the upcoming trial

    ^^^ you may not even be able to afford that if the official 'paper trail' of past dancing earnings established by this court case results in an IRS or state tax audit !!!

    Crap that would really suck, once you are named in a suit like that you can kiss your anonymity goodbye. Your name will turn up in the most cursory search of case law, should anyone decide to do a background check on you this WILL come up.

    Club in Indy got sued over workers rights/status as employees and the IRS was not far behind - so you are correct Melonie

    wait, I got the same thing. I thought it said I had to send in the paperwork if I wanted to take part in the lawsuit.
    Since I didn't want to be part of it, I shredded it and threw it away.

    Can someone double check their paperwork? I don't want to be part of the stupid lawsuit.

    Been in this situation myself once or twice ... and ran for the exit !!!


    This has the potential to fuck up everything. They might start keeping tract of all the money we make and taxing it all even before tips are given out. This could start with some clubs then they all will have do it. Its about becoming a employee instead of independant contractor.
    At least where the state of California is concerned, this is the stated intent of the California Dep't of Labor and the Cal Franchise Tax Board. They wish to step beyond the 'case by case' jurisdiction of individual lawsuits against individual clubs, and leverage Cal DOL rulings plus Cal FTB tax status determinations into a blanket statewide requirement that all exotic dancers working in California must be treated as 'statutory employees'. From this, the state would get thousands of new contributors to the state's unemployment and disability insurance funds ( which are beyond broke ). The state would also get millions of additional dollars in income tax revenues, thanks to dancer earnings being more completely accounted for and automatically reported to the state by the clubs' payroll system. As this would be a 'zero sum' game if strip club customer spending levels don't increase, those additional dollars going to the state would of necessity result in fewer dollars going to the clubs and to the dancers.

    I think I received the same thing. It's Trauth et al. v. Oxnard/ Gilardi & Co., right?
    They included a "Request for Exclusion" page, which is something you must fill out before June 4, 2012 to be excluded from the settlement. What's sketchy is that on the back of the page they want you to list the dates of clubs you've danced at as well as your stage name and address and telephone number at the time you performed.

    What would be the wisest choice? I'm leaning toward being excluded but bc I'd be paranoid that they'd be able to keep a better eye on me.

    ^^^ whether through the mandatory additional info you must provide on the 'opt out' form, or from club records and lawsuit records if you allow yourself to be added to the class action, there will be a record somewhere that a dancer with stage name ABC , real name XYZ, address 123, SS#999, worked at SR in wherever from date x to date y. It's a certainty that lawsuit / court records will become public at least to some degree. Whether the information provided on the 'opt out' form becomes public is open to question, but certainly possible.

    I never sent anything in opting out in the ricks or deja vue one and I didn't receive anything. I was freaking out about it because I want nothing to do with these suits but was out of town busy with other things and a lawyer I spoke with said I don't need to send in anything I wouldn't be involved I forgot why or how he said that would occur but since the deja vue ones been over and I didn't receive anything I believe that to be the case.

    Uhm.... all of the Class Action stuff I received indicated that I had to mail in a form to opt out of the lawsuit. They specified that if I didn't respond, I would still be bound by the terms of the settlement.

    The Deja Vu lawsuit offered us $500 cash (via check) OR $1,000 in rent credits which meant $1,000 off our total tip out to the club (since they take 1/3). The trick was you had to notify them in writing 7 days before you wanted to redeem the rent credits and they couldn't exceed $300 on any given night. So for two weekends (Friday and Saturday) if your tip out was $250 or lower you didn't pay them a dime, for example, and then you'd used up your $1,000 in credits. It's pretty much BS because they didn't change a single policy regarding why they were sued in the first place, they still do all the same illegal things they did before.

    Most of the girls opted for rent credits because it would only take a two weeks to redeem them all and it meant more money in your pocket.
    If you are willing to do for one year what other's won't, you can spend a lifetime doing what other's cant.

    ^ They can find out your real address quite easily through postal service. So it does not rally matter what address you provided them.
