    Default Another NEW site! Check THIS out, girls!

    Caught your eye? Sorry. I have no new site to report, but the good news is ... you have all been selected to join the "I'm not a sucker" club. There are no VIP or Elite membership fees. This club is absolutely FREE and will actually SAVE you money, time, effort and the trouble of having to sue for content theft in the future, once you realize that cheap little websites with copy and paste programming are just there to steal and run. They make a website that looks promising, grab up a few girls from this forum, get them to bring in other girls, toss in a few members (or heck, pay you themselves, pretending to be members) with claims that the more they grow with girls, the more members will come. Build it and they will come (hey, that should be a camgirl catch-phrase/pun!). Steal all the content from your live shows, plus pics, vids that you upload and then take it off their site and sell it or add it to the content on sites where they charge membership fees. There are millions of those (several new ones popping up daily). ALL of these sites hide under privacy monikers. Why do you think that is?
    Just a heads-up to all who might be thinking that these NEW NEW NEW sites will be better than the big sites. They are but little branches of a much bigger tree; one whose roots were so damaged, it must conceal itself in order to survive. Think of a cockroach that lays a million eggs. These millions of little sites that are ripping everyone off just want your content. If you're OK with that, go ahead and sign up to all those dinky little sites but you can't say you haven't been warned. In 3, 5, hell maybe even 10 years, you'll start to see your content all over the internet and you will never be able to get it taken down; not all of it. P.S. Block zones don't stop them. These scumbags don't give a fuck if you have block zones.
    They post in SW forums, too, girls.
    If you've been reading these forums, you should be aware by now of the games and have a pretty good idea of who they are, or at least who their posting handles are. Then again, anonymity is their game, so just do yourself a favor and watch out for those little sites. Don't be fooled.

    Oh and I never back down from bullies.

    @amanda, Stripperweb is a wicked place to discuss issues in the industry such as the ones you raised (content theft, the unreliability of geo-blocking, etc) but with all due respect writing threads laced with conspiracy theories detracts from the valid points you have to make

    Part of the reason this forum exists is to share info, including critical analyses of new opportunities and finding ways to combat issues such as content theft. We also deal with issues of privacy (or lack thereof) quite frequently here as well. None of this is news to any seasoned cam chica, and we do our best to educate new cam chicas as to the issues and concerns they'll encounter in camming

    The only problem with the central tenet of your OP is that if everyone stayed away from smaller sites, we'd all be working on at best four or five sites. I'd stop camming if I had to work on the largest, most well known sites. They are simply just not my style. I doubt the oversaturation would result in great $$$$$ for the chicas who did stick it out. There's nothing wrong with exploring opportunities available in the industry, provided these explorations are entered into from an informed perspective. That's what we try to do here.

    For what it's worth, issues in the industry are systemic in nature. Even sm allows incredibly liberal use of cam chica content in it's advertising campaigns, and those of it's whitelabels. This is not an issue inherent only to smaller/newer sites. Pretending it does to suit your own argument makes it harder for new cam chicas to accertain what issues they may/will encounter and how they can strive to protect themselves.

    What we try to do here is talk about those issues, not pretend they don't exist or censor ourselves from discussing them.

    There is alot of crap that goes on in the industry that doesn't benefit cam chicas, and we do need to resist and challenge that crap.

    Frankly, I feel bad (well, not really :-) ) for most of the site reps who try to promote here, as sw contains within it's membership incredibly articulate and knowledgeable chicas who can and do tear their problematic business models to shreds. In the process, those threads provide new chicas with a demonstration of how to critically examine new opportunities, what to look for, what to avoid...

    There are one or two site reps on sw with whom I do have issues, and I've raised those issues in those threads, as have many other chicas. No one is perpetrating a conspiracy here. We simply believe that discussing issues is better than censoring them, or burying them under generalized rants against the industry. Sw is designed to inform and enlighten, not conceal.

    Accusing every chica who doesn't agree with you as being a 'bully', having hidden motives or being an undercover cam site rep doesn't further that cause.

    My only comment on this:

    You cannot run around suing people. I don't know where this idea comes from, perhaps the general lack of knowledge about the law and the legal process, but I always find it amusing when people threaten to sue. You have to have an actual legal cause of action in order to bring suit upon an individual or company. It has to be substantial.

    In terms of working on cam sites and having videos of our cam shows end up all over the internet, the one and only person that can sue to have any of that content removed, or to sue to recover any profit from that content is the owner of that content. You and I might be the person IN the video/photos... but once you upload or stream to a cam sites server, the content no longer belongs to you, it belongs to the cam site. This means that the cam site can do whatever it pleases with that content, without regard to you and I, and they can even continue to profit off of it for years to come. This is all outlined in the contract that you sign. Therefore, the ONLY person able to sue for any "content theft" is the owner of that content - the cam site, not you.

    Sites such as clips4sale, you remain the owner of the content. They are simply providing a means to sell your own content that you own. Cam sites do not operate this way. The only way to retain your rights over the content, and the right to sue over it, is to not stream or upload to any webcam sites that do not explicitly state that you remain in ultimate control over the content which you produce and stream/upload to their servers.

    From Streamate's Performer Agreement:

    Section IX. Content:
    Performer understands that he/she will upload content/images to Streamates' system for re-broadcast. All content/images uploaded to the system shall become the exclusive property of Stremates and Streamates will have the sole discretion to use all such content/image in any way it deems necessary in all sales and marketing efforts, during the Term of this Agreement and upon termination.

    What this says is: "We own your shit now, and we can use it forever and ever amen."

    I mean this with the best of intentions: If you spent as much time actually upping your game, as you spent spouting negativity and coming up with and spreading bizarre conspiracy theories about camming, (including dwelling on SW posts from girls which you screenshot and paste to a blog that could be used for much more positive marketing purposes for the benefit of your business rather than the detriment) ~ you would be one wealthy motherfucker. But you spend too much time on the former for me to keep up with.

    If you want to make a point to help your fellow camgirls, at the very least back it up with some solid evidence. If not, I'm not interested.

    I appreciate your input and ability to actually touch on the topic, Loveshooks, but I fail to see where this "conspiracy theory" even exists in my post. When I mentioned "hiding under privacy monikers", I was referring to the websites that steal and sell our content. Try finding the owner (the actual person or company) of this site (as advertised right here in your forums):

    Bullshit, Sarah. They do NOT own our content *exclusively*. You might want to watch another episode of Matlock, dear. Try getting yourself a lawyer and suing for content theft (intellectual property theft). It CAN be done and in fact, IS being done, as we speak. You really should stay out of topics that you know nothing about and stick to doing ... whatever it is you do. I'm sure you're familiar with Google. Try a few extensive searches with the key words "intellectual property law" "dmca takedown" and you'll see that, even AFTER a DMCA takedown, you can still SUE (yeppers, SUE) the company.
    It is DEFINITELY worth the time and effort to sue, provided you have enough content floating around out there and know exactly where that content is. Copy the URLs, screenshot the google results, the pages, etc. There are ways to look into the historical records (as well as financial records) of all of those sites. If all us REAL cam "chicas" here got together in a massive class-action lawsuit against these scumbags, they wouldn't have a leg to stand on. But Sarah might tell you it's not worth it because she's a lawyer and knows how to translate simple english to simpler english.

    Curiosity brings me to post this question: If you sign a contract that states any broadcasted image over a website becomes the sole property of the website; how can you sue them when they resale the content? Especially if it states in the contract that you give them the right to? My contract states that all images I upload (whether live or still) are the property of the site I signed with. How would someone ever have the ability to sue over this?

    I'm not suing anyone or joining this in any way. I'm trying to further understand the logic behind this.

    Actually Amanda, I have never seen an episode of Matlock. I'm government major with an emphasis in legal studies. I study the law on a regular basis. I'm very familiar with intellectual property law, I have taken a class on intellectual property law taught by prominent legal professors, you on the other hand have not. If anyone is relying upon Google here, it is you. I prefer to stick to legal search engines provided by companies such as LexisNexis and Westlaw - search engines that legal professionals use which I am certain you have no access to, as I do.

    We gave "those scumbags" permission to use our content when we signed their contract.

    You wouldn't have the ability. I suggest that anyone call up an intellectual property attorney and ask them. They will tell you the same.

    And please understand that most of the girls here who use a false name do it for the sole purpose of protecting themselves from prying customers, not to bully each other annonymously or pretend to be site reps. That fact that you're broadcasting your recent issues with SW on your twitter and blog makes me THAT much more thankful that when I signed up here I didn't sign up with my cam handle.

    I've had a lawyer for similar reason and know there isn't really a case in something like this (although I did win because other side broke contract). I ask to fully understand OP's way of thinking.

    Just because Streamate writes it, doesn't make it legal. Go ahead Sarah and challenge it in a court of law and you will win your case. The "creator" of the content is the OWNER of the content. Also, they can only use our content in promotions, not for sale, only in "sales EFFORTS". Oh but wait, you're the lawyer. You already know that. Or do you? Hmmmm. Are you majoring in trademark law, too, along with intellectual property rights? The law is not black and white. You're a camgirl, just like us, even with that holier-than-thou attitude.

    I'm a rocket scientist (but that's only in my spare time).

    Where you see a threat, I see the OP of the Shake It To The Max thread as providing a demonstration of how to approach a new site, what issues to consider, what potential problems may arise.

    I won't cross-post, but you can read the OP here:

    Would you rather we pretend that new sites don't exist? That some chicas would sign up without taking an opportunity to examine them prior to doing so?

    And yes, it's somewhat ridiculous that a site that never even got off the ground is at the center of so much drama today

    What you need to understand is that this forum provides a venue for discussion. None of can write anything without expecting to have our ideas assessed and challenged. Having differences of opinion does not make any us of more 'real' or legitimate than others.

    The points that are being handed out in this thread have nothing to do with the merits of certain issues that have been raised raised (content theft, privacy, strategies to combat piracy) but are based solely on the fact that some posts in this thread have resorted to insults instead of rational exchanges of ideas

    most of us are tired of that

    sw is not the place to try to start a fight

    I'm leaving this thread open, because I do think important issues are being discussed here
    I hope we can keep it that level

    Yes, you CAN sue. You can sue for just about anything, because there's always a scummy lawyer willing to take on ANY case if you're willing to pay him for his research, time spent on pleadings/motions/discovery and court costs. But winning that law suit is another matter entirely. Just because a lawyer is willing to take your money in order to TRY, doesn't mean you've got a leg to stand on it court. Sarah isn't a lawyer, but I have an advanced paralegal degree and plenty of years experience working in law firms with lawyers and in the court system. If you WIN your lawsuits, Amanda, come back and tell us the name of your amazing attoreny so we can all hire him.

    Still I haven't signed up to any new sites as of recent. I've only worked SM maybe 3 days total and decided it just wasn't for me. So I guess I'm ok for now.

    Yeah, this just... I don't get it. I've looked over the contract and there's nothing illegal about it. It's a standard model agreement. No one was forced to sign it; if you don't want the risk of your shows on other sites, then don't sign the contract.
