    Default Making cash deposits under an LLC

    For those of you with LLCs established for your camming/dancing, how important is the actual LLC name?

    I ask because I have an LLC that was set up years ago before I started dancing exclusively. However part of the name is related to a specific field (ex/ Paul's Plumbing, 123 Webdesigns, etc.), that is unrelated to adult work.

    Since dancing is a cash-related business, can I effectively report my income under this LLC or what would be the legal ramifications (if any) of doing so?

    I have seen people use business names for all kinds of things unrelated to the "offical" business type. Then when they file their taxes they list the reality accordingly. As far as the legal issue I will leave that for someone else to answer.

    Yes. I got an EIN number for this LLC when I opened up a business bank account. For obvious privacy purposes, I won't give out the name of the LLC but I used to do freelance marketing under it. It's been a few years since I've done marketing work but the LLC still exists. Just wondering if I could report my dancing earnings under it now.... (if that makes sense)

    As far as I know, there is no US Federal reason that the existing LLC cannot be used for adult work. If there is a problem, it would originate at the state level ... i.e. was the state LLC registry listed as 'any lawful purpose' or some specific purpose ( that did not include adult entertainment ) ? Is camming technically illegal in the state where the LLC is registered ?

    However, convincing SM or DejaVu etc. to cut checks in the name of 'Joe's Plumbing' might be another hurdle !

    Please keep in mind that none of us are lawyers. All advice given here is done so second hand. Verify this information with your own lawyer, CPA, or tax preparer.

    I did ask an attorney friend about this issue....

    He says it all depends on how the LLC was set up originally. If the paperwork says "marketing (or whatever kind of business) and all other lawful purposes" as the type of business; you wouldn't have future issues. If the paperwork only states the business as "marketing" and you are making the bulk of the income for the LLC from dancing; it could put you into some hot water. Meaning if you were audited your income from dancing would be processed as personal income only.

    In some states you can amend the LLC paperwork thru the state's website for a small fee. If it is a big concern for you I would consult a lawyer to start establishing a relationship now before you need them anyway.

    Thank you all for the information! I still need to find a good CPA / tax attorney and I'll discuss the issue with them.
