    Ok I had an earlier thread about how I was using an agent to rent my property this time for various reasons. She and her assistant are inept and a nightmare! She did stuff to the property and since I was out of town I just paid ( her assistant was supposed to send me invoice copies but didn't). It took me a few months to get a copy of the contract I signed with her. Any ways I have tenants since july 1st( in my are it doesn't take more than 2 weeks -1 month to rent property. Anyways her assistant called me today and said I need to pay the invoice for the cleaning! I went off. The cleaning id where we got into it in may and I actually fired her( she begged me to give her another chance) well the lady lied ( she was only 10 an hour which is why) she called me the day after I hung blinds and saw the cleaning lady had been there and did nothing but take apart the fridge and somewhat clean it. She said at that point she clocked in 12 hours. First of all the house was gutted and EVERYTHING was new except the fridge and stove. So all together the lady said she clocked 20 hours. Which was a complete lie! When she said she was at 12 I went there and nothing was done so she said she'd take care of it! What agency calls 4 months after and 2 months after I have tenants. Something should of been said at the lease signing! So I screamed at this women how inept they are and I was suppose to be getting 1150 well the idiot wrote 1100. So as far as I'm concerned were even that's 600 less a year because of her mistake! I call back because I realize the lease copy she sent me was blank and she said she won't speak to me! Really when I hung up on her I heard her say " you're a bitch! I called another remax office and as I suspect , threy're all franchised and the realators are independent contractors. I could call the office and ask for the office manager( I got his name from another remax office or report her to the board. What would you do?

    ^^^ essentially, this boils down to a potential 'small claims' action, with the independent contractor realtor having the 'home court advantage'. You are lacking iron-clad contractual paperwork, as well as iron-clad proof of how many actual hours were clocked by the independent contractor realtor's cleaning service on your behalf. And poor performance by a 'sub-contractor' ( cleaning service ) doesn't automatically allow you to make a proxy claim against a 'general contractor' ( the realtor ) in lieu of going after the sub-contractor directly.

    While you were obviously 'screwed over', with the amounts of money involved being less than monumental, and with the amounts of legal gyrations necessary to secure small claims court judgements in your favor being fairly substantial, this is probably a 'no-win' situation from the standpoint of actual financial recovery. And given that the problematic realtor is a national chain franchisee ( which has a reputation to uphold and lots of corporate attorneys on retainer ), you also have to be fairly careful in regard to publicly 'bad-mouthing' the problematic realtor unless actual wrongdoing can first be documented in a court of law.

    To answer your question regarding 'what would I do' ... well, this is why I never invested in rental properties !!! Under the circumstances, I would first decide whether or not I was in a position to totally manage the rental property on my own ... because making a stink with one rental property management realtor is likely to cause other rental property management realtors to refuse to deal with me in the future. If I WAS in a position to take 100% active management responsibility for the rental property, then I would attempt to meet personally with the office manager in hopes of reaching some sort of 'settlement'. If I was NOT in a position to take 100% active management responsibility, then I'd probably chalk this one up as a 'learning experience' ... and be absolutely sure to have iron-clad contractual paperwork before entering into future management agreements with other realtors.

    They are not manging the property for me. I think it's unethical to call someone 4 months after the cleaning was done and 2 months after my business is done with them and for the assistant to call me a "bitch'! among more unethical things that occurred during my contract with her to lease my property. I don't want any damages or to take them to court! I was just ondering if I should either report her to the board of relators or her superior at the office she works?

    Call their broker first that is who the agent is accountable to - they may be under a broker at another location - if unsuccessful there the the board of realtors will be me to hear your complaint - keep or gather records of all correspondence of course - good luck that sucks for you and yes rental property is a pain in the butt
