Don't they have to have some kind of real estate license?? If it were me I'd record the conversation or even wear a hidden camera and then if he kept acting shady after the deal was done I'd send it to the state's licensing authority (or his wife if he has one).

It sounds way to sketchy IMHO....but on a logical level even if there is a document this slimebag could say your copy is a forgery and still try to stiff you and of course they would believe him over you. He may even mention you came on to him to gain leverage and discredit you. Anyone that skeezy is likely to have a million other shady moves. So I vote no. On a logical (and personal) level.

I am not sure how the school you are attending works, but would it be another option to pay the broker fee with the tuition money, and pay the tuition / re-enroll next semester? Just one way to avoid the sketchiness aspect altogether.
Also, I am sure you have checked, but just in case, have you talked to the school to see if there is any way to defer the payment for tuition, or anything at all that would allow you to use that tuition money up front to avoid this dude?



The problem isn't just the money, it's that he's the only one I've found so far who will overlook my bad credit and no proof of income. I don't have a problem with it on a personal level either. At this point I'm planning on doing it, I just want it to be as legit (paperwork wise) as possible and have a back up plan in case he tries to play me. My roommate fucked the younger brother of this guy who is best friends with a broker guy, and that's basically how we got our apartment in a very competitive area. Recording laws are totally dependent on the state. In some, only one person being recorded needs to know/consent. In other places, both have to know.

Oh, yeah!! Definitely this! Make sure that everything he's giving you a break on (fees, credit checks, etc) is being written down as waived so he can't come back and say "Well, we never did go through this step so... fuck you." Go through all the details and close any loopholes he could possibly build with statements saying he's aware of the fact and is giving you the place, regardless. I think it's cool that you may have a lawyer-custy who's able to look at the paperwork and possibly verify it, for you.
As far as recording conversations: typically it's true that unless there's an understanding that the other party is aware, it's all inadmissible in court BUT, if it has to go that far, you've probably got an attorney who's heard the tape and can definitely use it as a tool, in negotiating a deal with his lawyers. I can't think of too many lawyers that would hear their clients brokering this kind of deal and not encourage them to play ball before it got to court. If you want to take the steps to record yourself and have the means to do it, it might be a smart move.

I'm in NYC too and definitely curious to hear how this turns out! It really is a place full of shady-as-fuck brokers, I remember when I moved here and handed my cash deposit over to a broker and legit I didn't know if I'd ever see the cash or a set of keys again. If it does work out for you LL, having this place could really make it easier for you to move on to a new place in the future. Keep your receipts from paying rent each month and it could go a long way with a future landlord to prove responsible rent payment history and such.
You know I'm thinking about it but why just the $1500? Why not him cover this fee and the whole down payment? Why not move in with nothing to pay until the next month? That would be a sweet deal. Just say well you want me to be your girlfriend right? Can't you make sure I move in first month rent free?
