    From a quick read of the website, it appears that the 'complementary' and 'gap' coverage does not meet the necessary criteria for being a 'qualified' health care plan under ObamaCare. If so, then the true cost of this coverage after January first will be not only the insurance premium itself but also the IRS penalty that must still be paid for failure to purchase 'qualified' medical insurance ?

    now that some of the 'final' regulations are finally being released in regard to ObamaCare, it appears that independent contractor dancers and camgirls may soon have a 'loophole' available that could save them a significant amount of money on the net cost of health insurance coverage. That 'loophole' involves the possibility of purchasing 'employee' health care coverage through the soon to open SHOP marketplace ...

    From the regs that have been released so far, it would appear that after Jan 1st independent contractor dancers and camgirls who have not purchased 'qualified' health insurance coverage for themselves, and who do not have 'qualified' health insurance coverage via others ( i.e. dependent coverage under a parent's or spouse's health insurance ), will be faced with the following choices ...

    A. continue on without 'qualified' health care coverage, and pay a new IRS penalty equal to 1% of their income ( = $500 for someone earning $1000 per week ) for 2014 which increases to 2.5% ( = $1250 for someone earning $1000 per week ) in subsequent years, or

    B. purchase individual health care coverage via a gov't run Health Insurance Exchange, which ...
    1. will cost one amount if your income is below 400% of the 'official poverty level' in your state ( = $46k per year in New York ) making you eligible for gov't subsidies.
    2. will cost you a higher amount if your income is above 400% of the 'official poverty level' in your state.

    Note that the high deductible, limited coverage health insurance plans which have traditionally been very popular with camgirls and dancers ( due to their low monthly premiums ) are NOT considered to be 'qualified' health insurance coverage. Thus sticking with these low cost plans will also trigger the 1% of income IRS penalty in 2014 rising to 2.5% of income in future years. This may result in the total cost of the new IRS penalty plus the limited coverage health insurance premiums approaching the ( subsidized ) cost of the 'better' public health exchange individual health insurance coverage.

    For a young single dancer with no dependents who is a non-smoker, early info indicates typical unsubsidized annual health insurance premium cost will be around $3000-$4000 depending on specific age. However, if the income amount is below 400% of the 'official poverty level', tax credit subsidies will kick in reducing this cost. Thus an 'income gap' will be created where earning 1$ more than 400% of the 'official poverty level' results in a significant and abrupt increase in net health insurance premium costs. This 'income gap' could very well mean that dancers and camgirls will need to make a decision as to whether they WANT to earn more than $46k per year in 2014 thus sacrificing the health insurance premium subsidies. If the dancer or camgirl is likely to earn $100k this is a 'no-brainer'. But if the dancer of camgirl is likely to earn $50k per year, the extra $4000 in earnings may not offset the increased health insurance premium costs net of taxes and tax credits.

    However, for higher earning dancers and camgirls, if the dancer or camgirl forms an S-Corp, her 'business' becomes eligible to purchase small business gov't health insurance coverage through the federal SHOP exchange. The terms of SHOP insurance coverage for small businesses provide a tax credit to the 'business' for up to 50% of the money which the 'business' spent to purchase health care coverage for it's ( sole ) employee. There is a $50k per year in average employee 'wages' limit for the tax credit eligibility. However, the structure of an S-Corp allows for total earnings to be split between perhaps 2/3rds being paid out as 'wages' plus perhaps 1/3rd being paid out as 'dividends'. Thus, by forming an S-Corp, and structuring the ( sole ) employee's compensation into a 'wages' component plus a 'dividends' component, it should be possible for a dancer or camgirl earning $75k per year to wind up with SHOP health insurance coverage at a net cost of about $1,500 to $2,000 per year instead of $3.000 to $4,000 per year cost of gov't health exchange individual insurance coverage.

    Additionally, the cost of purchasing the SHOP health insurance coverage for the ( sole ) employee ( net of tax credit subsidy ) remains 100% deductible as a business expense for the S-Corp, which means additional cost savings since the S-Corp purchased insurance premium will effectively be paid in pre-tax dollars while the individual insurance coverage would be paid in after-tax dollars ( making the cost in equivalent pre-tax dollars at least 15% higher if not 25%+ higher ). And while not directly related to health insurance, the S-Corp's ability to split 'business' income into a 'wage' plus a 'dividend' provides additional tax savings on social security / medicare taxes.

    The above may also apply to camgirls and dancers who form LLC's that elect S-Corp tax treatment ... but I'm pretty sure that obtaining a separate EIN for the LLC is an absolute necessity.

    Put another way, dancers and camgirls who are likely to earn significantly more than 400% of the 'official poverty level' in future years ( roughly $46k or $900 per week ) may face a situation where the future year IRS penalty cost for not purchasing health insurance coverage for themselves will be close to the same cost of forming an S-Corp and purchasing SHOP health insurance coverage !!!
