Default "Caught" Shoplifting at Whole Foods

Yesterday morning I went to my local Whole Foods for groceries. I always get my food and then grab a cappuccino and bagel on the way out.

So I got my eggs, salads, and dips, and went to the cash. I asked to pay for a cappucino and a begel too when I was checking out.

I don't know how it is set up in other stores, but here, the coffee barista has no cash-register. So you either need to pay for the coffee before or after you get it.

I paid for everything, and then ordered my coffee. While she made it, grabbed my bagel.

So everything is normal, like 10000 other times I have done this to start my day. And I'm almost at my car, and then all the sudden...

This dirty looking unshaved man GRABS my (new) COAT and scares the hell out of me! I squeezed the cup so the hot coffee exploded all over my coat and chest. I was stunned. A man was holding my coat from the collar.

All he said to me was "Hey, I need to get you to come back in the store". And I was such an idiot, for a second, I thought he was COMING ONTO ME. And I was scared he was crazy and trying to get me in there to talk to him.

Then he tells me again to come back into the store, and I said "No" and I asked for his ID. And the guy flips open his wallet and the name and card is impossible to read in it's holder. So I get that he's accusing me of stealing. For a horrible moment I was scared that I really didn't pay for everything. But of course my coffee and bagel were on the receipt.

So instead of apologizing to me, the store detective guy didn't really say anything. I demanded to go see the manager. When we walked back in the store everyone was looking at me like I was guilty!!

I started telling off the assistant manager, about how I had been treated, and he made a little apology which was not adequate at all. I asked for all my money back, since I didn't want their stupid food anymore.

It was so shocking. Today another manager called to say sorry. Still, I can't imagine ever going back there.

^Yeah, I would go higher up on this too. A man grabbing a woman in the parking lot without identifying himself (and when she hasn't even stolen anything!) is not acceptable. This guy needs to be reprimanded at the very least. Wow.

I totally respect he was doing his job. It was all wrong.

Part of that job is being super-tactful in case you're wrong! Like giving a good apology when you stop the wrong person.... that's half the job, no?

He put his hands on me!! That makes me so mad!

I'd ask for the $ to buy a new coat, (f*** the cleaning, how're you going to get coffee out of anything) plus grabbing you is assault, or threaten a lawsuit..I'd also see about speaking to a regional mgr, or someone higher up than the store/ass't. mgr.

I would take it up the chain to whoever is the top person at that whole foods or regionally. Type out everything that happened. If they're not falling all over themselves to comp you and take care of your coat (especially scaring the crap out of you-- I know whole foods allows more alternative looks but if the guy looked that scary then he needs to clean his look up) then I would take it higher to the national headquarters office.

It would be one thing if the manager had apologized and made it right because hey, mistakes happen. Now, I'm all for store people chasing after shop lifters but most stores nowadays don't let their employees follow them out, let alone grab them. I also think it was very ridiculous for him to act like that over a coffee and a bagel. He should have started with "miss, miss! I need to check your receipt." Going to bodily contact right off the bat and scaring the bejeezus out of you is unacceptable.

I want to call the store for you. Srsly, I did that when a girl was assaulted by a 24 hr Fitness employee in Omaha, Nebraska (as you see, I'm in SoCal).

I get SO MAD to see all of the lovelies here who are being harassed or assaulted. So mad.

I have a feeling that a higher up would try to rectify this somehow (I know....a $20 gift certificate would be a pretty weak compensation for assault). Whole Foods is a pretty stand up company.

ALSO.....as someone who has worked in retail - IT IS ILLEGAL TO ACCUSE SOMEONE OF SHOPLIFTING ONCE THEY LEAVE THE STORE. Police or security may be called, but store personnel have NO LEGAL RIGHT to ask to see your bag or receipt once you're gone. (Not sure how this would be handled for a parking lot though.....prob still considered on the property).

    True story.

He looked so dirty. In the store I had noticed him, and I was like "that guy is out of place; no basket/groceries, not Whole Foods type clientele). If he had just said "Store Security" when he came after me it would have been much less scary.

It's the random guy who runs up behind me in an empty parking lot - that will bug me from now on. He was able to sneak up on me from at least 20 yards. I had no idea someone was running behind me until he grabbed me.

It can happen that fast, I had no idea.

By comparison, being suprised by a police office is more of a soothing experience, if you can believe it. When there's a uniform you feel kind of safe. But this guy was just a total question mark.

I wanted to hand him my keys and purse, it was that kind of "is this a robbery" thing.

yup, write up your experience I would fax or email it to that whole foods, and every whole foods office up the chain. That's just ridiculous that he'd be so scruffy and scare you.

Yes, anyone who is (a) strong and (b) not half-asleep could have punched his Adams-apple. I wish I was like that.

Everything about his approach would invite a self-defense reaction. There was no clue at all he was working, until asked me several times to come back to the store.

And maybe that sounds obvious, but in all the times I went there, no strange man ran up to me and asked me to go back in, so I honestly didn't get it initially. And I thought he was a perv or he wanted to steal my car or whatever people do these days.

Next time, immediately call the police and file a police report. You could have sued in court and won for emotional distress, assault, and I'm sure some other things. Now it would be hard to prove without the police report.

I know you only had a second to react, but.....be careful of dudes in uniform too! I've seen enough L&O:SVU to know that imitating a seemingly harmless figure is a way to catch people with their guard down.

If you want to, you might be able to bring a lawsuit against Whole Foods.

No, she can't bring a lawsuit against Whole Paycheck...erm Foods. I don't know what state the OP is in, but there is generally a law about reasonable detainer, and just grabbing someone's coat can easily be considered reasonable detainer. What he *should* have done is just talked to you as you went out the door. I'm sure you would have stopped and showed him your receipt. But he didn't do anything illegal either. He was just an idiot.

You *might* ask Whole Foods to pay for dry cleaning your coat, and they may very well acquiesce as a matter of policy. (but they don't even have to do that.)

I am sorry you went through that though! That had to be very alarming and upsetting!

It seems like people who are falsly accused of shoplifting in Canada usually win about $5000 when they sue the store.

    Here is one example

I dont need to sue them, it was just a bad experience :-(

I told a friend of mine who works at whole foods and he gave me the national headquarters address/number which you might have already looked up:

    Whole Foods Markets, Inc.

I admit I can be a bit of a dick about this sort of thing.
I would DEFINITELY take it further. He grabbed you, he scared you , and he could have burned you!
Had he been EXTREMELY apologetic, offered you compensation (free groceries etc) or the manager had, I would have perhaps let it go.
I would definitely take it further, to the regional MD etc, and I would probably embellish how scared/upset I was about the experience.
(I might even take it to the local rag).
Grabbing somebody unnecessarily could be seen as assault in this country and hot coffee can burn. All he had to do was ask to see your receipt.
And yes to asking for money to dry clean your coat, it was new but even if it was an old rag It's still your coat and now needs to be dry cleaned because of THEM.
    Sorry you went through that!

I like the idea of bringing it up to a regional manager but make sure they don't have your address to share with that weirdo who assaulted you.

You might also 'CC' a copy of your letter to a local news station and be sure that Whole Foods knows you are including local news. Nothing can get them to clean up a bad situation faster than bad press. If the local store knowingly allows someone to physically grab customers like this, the regional manager needs to step in and clean it up. In this day and age there are so many ways for an interaction like this to go bad that it needs to be changed for everybodies safety.

A lawsuit takes so much time and aggravation that unless you get a lot of $ after expenses it almost isn't worth it, but I have to admit I would LOVE to see you sue them just to be sure this asshole doesn't do this to someone else.

A bit of publicity about what happened to you would be an incentive to the store to train their security personnel properly.

That experience must have been fucking traumatic and may even take a while to recover from emotionally.

I am dying to know what city this happened in...

I used to work for Nordstrom. When a security guard falsely accuses someone of stealing, they get in huge trouble and many times lose their job. Companies know they open themselves up to lawsuits when this happens so they don't mess around with this type of stuff. I wouldn't be surprised if he was fired.

Very sorry about your experience. I have all but stopped shopping at Whole Foods since they started putting GMO and other garbage in their store products. They do that because we all assume anything with their name on it is going to be healthy. I also got tired of watching everyone eat out of the bins.
