Default New Canadian prostitution bill tabled

If anyone is interested in perusing the Protection of Communities and Exploited Persons Act that was tabled today, you can download a PDF of it here: http://ow.ly/d/2e8g

If you don't want to read the 49 page document: this is a much tougher stance against prostitution than the laws that were struck down that, most notably, makes it illegal to advertise sexual services, purchase sexual services, and benefit materially from sexual services.

^Last year, the Supreme Court struck down our old laws as unconstitutional, giving Parliament one year to come up with new legislation. While prostitution itself wasn't against the law, those laws prohibited brothels, living on the avails of prostitution, and communicating in public with clients -- thus actually earning a living and operating as a prostitute was illegal.

"Today our government is making prostitution illegal for the first time," Justice Minister Peter MacKay said in a written statement on Wednesday."We are criminalizing the purchase of sexual services and in very specific instances the sale … in areas where young people under the age of 18 could be present," MacKay said during a news conference after the bill was tabled in the House of Commons. "The bill recognizes that the vast majority of those who sell sexual services do not do so by choice. We view the vast majority of those involved in selling sexual services as victims," MacKay said.

To add -- the bad news is that the government that introduced this legislation has a majority, so it is highly unlikely that it won't pass through the House and Senate. The GOOD news is that it is likely to be struck down by the courts, though you never can be sure. This certainly isn't the end of what has already been a long road!

From what I can tell, this new legislation has as much a chance of being struck down as the old laws did, maybe more. But I imagine it'll be a few years before that happens. So Canadians and Americans traveling north might be in for a couple rough years. That's if this legislation even makes it to law without being significantly altered.
