    Default 2257 needed for affiliating/promoting and content site?

    I am a bit confused and I am not sure where to begin. I have a domain with whois protection via namecheap. I want to make a small site to promote my cammodel and cammodeldirectory (which both have my 2257 info) and maybe list few of teaser clips. I will not have a store on the site, just use cammodeldirectory for buying videos or camshows. I want to add twitter and wordpress to the site, too....

    Do I still must put 2257 on this site to protect myself? If so, how or where do I sign up for 2257 thing? I came across this 2257 program and I do not know if this would be sufficient. ~>https://itunes.apple.com/us/app/quic...774662043?mt=8


    I am a bit lost on this 2257 part.

    If you're just using your website to promote links to other sites and aren't planning on getting your own payment processing, you should be ok without 2257.

    You need to keep 2257 records if you sell pornographic material on your site, or if you have nudity or pornographic material on your site to prove that you and/or all models on the site were at least 18 years old at the time of filming. 2257 records include your photo ID and a model release type form (here's a generic one you can use: http://camconcierge.com/downloads/2257form.pdf ) for each production filmed/photographed. Since we tend to make so much content, you should probably just keep a list of links to where your content is along with dates of production and keep it with your 2257 records. You also need to list on the 2257 statement on your site the physical address where the records are located (no PO Boxes are allowed).

    Now, these records don't need to be kept in hard copy, so yes the Quck2257 app is a good option for collecting the records digitally. The app is basically a means to collect the records and send it to yourself or to your custodian of records. A custodian of records is someone who keeps your 2257 records at their location and therefore you would list their address instead of yours. There are some third-party 2257 hosting services like http://2257snap.com and https://www.2257services.net and and I also provide this service on my site http://camconcierge.com/services-225...-camconcierge/ but keep in mind, I'm just a small operation and don't have the full legal backing of the big sites. I just wanted to provide a low-cost alternative.

    If you aren't selling pornographic material directly on your site or posting pornographic material for viewing on your site, you should be ok without keeping 2257 records, but if you want to have a generic 2257 statement on it, you can use something like this: http://camconcierge.com/2257-statement/

    Since you do your own you don't necessarily need one but it couldn't hurt. You would put up a page where officials who might request to see your 2257 documents can contact you. All you really need to say on it is that you are obviously over the age of 18, can produce adult material in your state/country legally, and you can provide 2257 documents to prove this. You don't actually have to list your private info on the site, they just need to know that you can provide it. Most people just put this down but you can change it up for your own personal use if you'd like since you are the producer:

    18 U.S.C. Section 2257 Compliance Notice

    All models, actors, actresses and other persons that appear in any visual depiction of actual or simulated sexual conduct appearing or otherwise contained in or at this website were over the age of eighteen (1 years at the time of the creation of such depictions.

    The owners and operators of this website are not the primary producer (as that term is defined in 18 USC section 2257) of any of the visual content contained in the website, but we keep all documents proving legal age for every model on the our website.

    Records are available for inspection by appropriate authorities by appointment.

    This is what I use and yes, you may copy it if you wish.

    ^^^ based on my own research ... which was conducted before I decided to shut down my own indy website ... the key issue is whether or not nude or 'adult' images or videos are going to be hosted on your own server. And this is the case whether said pics and videos are samples with free access, or in a paid access section. If the answer is yes, then 2257 compliance is a necessity.

    Also note that there is 'fine print' involved with the maintenance and inspection of 2257 files ... for example if you keep them yourself you also give de-facto consent for a warrantless LE search of whatever location the files are stored at. There are now service companies available who will maintain 2257 files for you at THEIR location to avoid this issue ... at an additional cost of course.
