    Default Is a landlord allowed to show your space without your permission?

    Don't know where to put this so mods please move if necessary.

    I just got a text from my landlord saying "FYI- someone is coming to look at your room tomorrow at 6:00" This is the first I've heard of it and she didn't ask me. This causes a couple of problems because

    1) the room is a mess and I'm packing, and I don't have time to get it in 'show mode'
    2) I still have valuables here and I don't feel comfortable having my psycho landlord and a stranger comb through the place especially if I'm not gonna be here.

    So the question is, can she do this? Sadly I'm sure she can but just want to double check.

    Check your lease. There should be something about this in there. My landlord has to give us 24 hours notice, but not ask permission.

    Google your city's or state's residential tenancies act or board. It all depends on where you are, though it's fairly standard for landlords to have to give 24 hours notice except for in certain circumstances.

    you can also consult with a lawyer to see what rights you have a tenant. seems odd they barely give you any notice.

    Thanks for the advice ladies. It's not happening until tomorrow @ 5:30. Landlord texted me just a few minutes before 6:00 after I'd already left school to let me know it was postponed.
    I googled the laws for my state and found a huge PDF that I embarrassingly didn't have time to go through.. no table of contents.

    Looking at it now though...

    Generally speaking, a landlord cannot show your place without the tenant's express permission. Think of property rights as a bundle of sticks. One of those sticks is ownership. Another stick is right of possession. Although the tenant does not own the property, the tenant has purchased for a finite period of time the right of possession. The right of possession generally includes the right to exclude anyone from the premises who does not have a legal right to physically be on the same premises. Therefore, the landlord does not have the right to physically enter the leased premises absent express authorization from the tenant.

    All that being said, there may be a clause in the lease that says the tenant will cooperate with the landlord for purposes of showing the leased premises to a prospective tenant. Even absent a clause, the laws specific to your jurisdiction probably recognize a tenant's obligation to cooperate with a landlord for purposes of showing the leased premises under reasonable circumstances for all involved.

    I'm probably going to have to deal with this also, since im moving on the first...I cam a lot, so it could be very embarrassing if they don't give me notice---cant find it in my lease.

    A landlord should still provide reasonable notice of the visitation. Nobody, including the landlord, should be able to just show up at your leased apartment and expect to enter without prior notice or warning.

    Kiki, it should be in your rental agreement somewhere, assuming you had one written up at all. But generally speaking the answer is yes, with reasonable notice required (except in emergencies) and provided that the landlord does not abuse the right.

    It is also important to remember that you can negotiate these things before you sign a lease. Too many people just sign these things without reading them and proposing changes. When I was renting, I always made sure to negotiate the more objectionable provisions, such as:

    1. baking in a hard 24 hour notice period before entry into my residence, except in emergencies;
    2. removing onerous restrictions on parking and/or their rights to remove my vehicle;
    3. removing any right to evict me if they sold the property;
    4. removing any other silly reasons they might have to evict and building in a notice and "fix period" should I be out of compliance with the lease for any reason;
    5. building in requirements for them to meet their maintenance obligations and my right to void the lease should they, after reasonable notice, fail to fix the issue;
    6. removing any right they had to store anything in my residence;
    7. removing provisions that would require me to maintain some specified level of insurance; and
    8. altering any other provision that I found objectionable or unreasonable.

    However, the right to show a place when you are leaving is something that is difficult to get a landlord to negotiate away, since landlords understandably want a chance to avoid any gap in rental income if they can.

    I had to deal with this issue when I moved out of my place-- it was so frustrating. I was escorting out of my flat and had to cancel clients nonstop because I never knew if someone would be viewing my flat when they were supposed to come by. Basically what they told me was:

    - they have to give a 'days' notice-- not 24 hours. This means they can inform you at 4pm that someone will be there in the morning.

    -as long as they give you a days notice you cannot refuse the viewing. I was told that if I did not allow the viewing my landlord could deduct from my deposit because I cost her a potential tenant.

    I think I was dealing with a particularly shitty agency, but it was seriously a fucking nightmare. I gave them my keys only with the understanding I would have 24 hours notice, and one of the agents thought I was gone all day (I never explicitly told him that, he just assumed) and came in without asking my permission at all while I was with a client. Like, I was upstairs in my bedroom about to take off my robe and my client was half-naked and we heard the door open. I wanted to die of embarrassment (luckily the client was amazing and just rolled with it). He wouldn't even apologize to me afterwards. I just ended up not working for my last 2 days like I had planned to avoid any more embarrassments!
