In relation to the Chaturbate and DMCA thread in Cam Connnection area.

Hello Ladies (and Gents if there are any), since this is my first post please allow me to very briefly introduce myself out of courtesy... I have been in the Adult Business for a considerable number of years in various capacity's from programming to affiliate marketing, affiliate management to doing all the back end work (no pun intended lol) in what was a successful Gay porn awards program at the time, at present I am in co ownership with a few movie paysites but also heavily promote Chaturbate from an affiliate perspective with my own sites... Some of you may well know of me already or have contacted me in the past for numerous reasons, in all cases I hope the experience was pleasant however there are always exceptions to the rule...

Ok, now down the reason what prompted me to join as my thread title states is in relation to the aforementioned thread the OP being "bugfix" the thread being located here !!!! (of course I do not have posting permissions in that area, though I do feel that the subject is relevant here also).

Please try not misunderstand me here I am speaking from a website owner / affiliate perspective and in no way represent any of the webcam sponsors in any other capacity other than an affiliate one.

My thoughts, the privacy policy and copyright on chaturbate is very vague in comparison to others leaving both the affiliate and the performer in a "grey" area as to what actually constitutes a violation of either... We all know the basis of a cam site is "real time communication" and in order for the host site and even the affiliate site to effectively promote themselves such information needs to be kept as current as possible, my sites for example pull the performers "mug" shots from the chaturbate XML feed that is updated as often as the chaturbate home page is itself every 5 mins, the copyright problem starts to arise when some performers are using software like manycam etc and forget to close certain feeds off when doing private shows whilst being logged into different sites at the same time, so depending on what site your on you may see her private show for free! (sorry there is so much to say here and I am trying to condense it) where different privacy / DMCA and copyright rules apply... In the last 6 months or so quite a popular DMCA take down company contacted a lot of times in quick succession resulting in me eventually speaking to the lady in charge of the investigations she did not understand exactly how a cam site even worked! or any of its methods... I took the time to educate her from programming perspective translated into layman's terms, she got it and thanked me for my assistance and advice... The result was chaturbate stopped storing offline images of the performers instead replacing them with the grey image with the chaturbate logo, until you logged back in again and started broadcasting them images would be stored again and when you log off then deleted from their servers... you can also set your privacy to show the grey image with the logo BUT the privacy setting is not registered in the chaturbate affiliate XML feed and will show me the cam picture regardless of your privacy settings ! (from a programming perspective this is not difficult to fix, and I would say is just an oversight on chaturbates part) therefore my sites will pull your picture from that feed, and what about the embedded live cam feed that can be placed anywhere? that contains exactly the same but live however that will not show your feed if you are in a private show but the home page will still show screenshots from that private show, This is where I think a little of the confusion lies when some performers say "hey you have stolen pictures from my private show!" I have not stolen anything.... again I say it is merely a programming oversight on chaturbates part...

New paragraph me thinks that's some wall of text sorry.... You girls use your initiative to retain viewers and gain tokens or private shows I use my own initiative to get potential paying clients to your room in the first place and a webcam site that has only grey images and is full of private show only boxes is a no win situation for either of us... So from an affiliate perspective how the hell do I promote a webcam site based on that ?
Please note I do not steal or record anything I only make use of the feeds and information that is available to me from the sponsor company chaturbate in this case... the only people that are recording your private shows are your paying customers or in some cases because you forgot to close down cam access from other cam sponsors whilst doing a private show for another... I seriously doubt any individual webmaster or website owner has the time to go though all cam sites hunting for shows to record, there is software that can do it but it's success rate is very poor, so your main problem lies with your clients and also in some cases lies with tube site owners and other free membership site owners that encourage members to upload the recorded content.

Myself I receive around 2 to 5 DMCA / copyright take down requests on a daily basis and I honour them all and do not request the person to fill out a proper DMCA form though technically I should... Then again I could argue the fact I am outside of that jurisdiction on quite a high number of points (yes I do actually know more about DMCA than most including the many DMCA company's out there that pray on cam performers) all I ask on my forms is essential information, a link to your profile on my site/s, your username and a valid email address... Oh and to be polite ! I would say out of the form submits I get 30% can't read, 50% are very pleasant and have struck up brief conversations with a few, the reaming 20% is a mixture of pure aggression and empty threats...

I know this is a very long read and for that I do apologise (I only touched the tip of the iceberg much more I would like to say) I sincerely hope I do not come across as being an asshole as that is not my intention, my intention being to make it a little more transparent of how this works from all perspectives.... please do ask me questions and feel free to contradict me, my only request being treat me as you would like to be treated yourself and maybe just maybe like "bugfix" said we might be able to sort something out here if the right people take enough notice.

Just for the record I have not send bugfix a pm for that site list I probably know who they are anyway and may even know them personally... besides I would be most upset if any of mine were on it ! lol

Thank you very much for your response it is appreciated also, you are one of the few who actually see it as it really is and it is free promo but it works both ways you and me know and can see this but many others do not, then again you still have the so called content thefts and there is nothing anyone can actually do about that as no matter what scripts the sites run there is always a way around it... it is a problem for me also I invested over $250,000 in content and some of it is on the tubes and not by my submission I do know at one time that a lot of sponsors submitted their own material onto teh tubes in way of publicity / free advertising but it is all out of hand now and you really have to re-think your business model / game plan...

Regarding liveviolet yes I do but this bugger is a rule unto herself or even himself I have often wondered about the true gender of the owner as at times it has the halmarks of being female then at others it is male... i shall try I can not promise anything other than I shall try :-)

Besides if your almost 30 and still being able to be passed off as a teen like 18-21 then hell lady maybe you should promote the skin care lotion you are using as a sideline ? lol only joking :-)

I hear you on that, I see you affiliates like window shopping. I don't necessary think affiliates should used explicit shows, because dudes can just beat off to that. Why get a show, when you just saw one for free? Maybe it would be more beneficial to edit those clips into teasers?

I think you have missed or misunderstood part of what I posted maybe ? I do not record anything (but I do agree with your statement) if you are referring to my paysites then all the tour pages do consist of clips... On my chaturbate affiliate sites they consist of the live cams in a few niches and then the performer profiles with a screen shot and details along with 4 other recent screen shots that get updated every 20 mins on my sites... yes I store the recent images on my servers but I do not record any shows and all the images are taken from the official affiliate XML feed, to be quite honest I have no interest in watching porn of any description I rather watch a Whing Chung video (martial arts training) so I certainly would not spend the time recording cam shows, or even bother to write the code in order to do so as that would potentially place me in breech of copyright...

Ah ok thank you for clarifying that, now I get yah... I have never promoted SM due to them always banning my account right away for some strange reason, I could only put that down to me living very close to one of their registered offices at the time... quite possibly they knew me in person and nobody in the community had a clue what this office was actually for maybe they wanted to keep it that way lol. That of course is just an asumption...

XloveCams on the other hand has over 70,000 pre recorded webcam videos !! along with an advanced API script that will allow your surfers to do a free registration directly through your own affiliate website and in return the surfer if they verify their email address they will receive a link to download a full version of one of these videos (roughly 10 mins plus in length)... However this creates 2 major problems they do not check for multiple uses of the same IP address thus I found surfers were joining up to 5 times each to obtain 5 free videos, in order to prevent this I had to write my own scripts to do multiple checks for user name, email address, IP address...

The other problem and more serious one is because I had 100's of pictures for each webcam performer and every video they had ever created the webcam performers finding their profile and all this content on Google immediately assumed everything was stolen ! I was receiving a high number of DMCA notices from law firms along with webcam performers sending in their own I directed some of them to Xlove for them deal with and others I dealt with myself. Eventually I said to myself F this and removed everything and rebuilt to site to promote Chaturbate instead.

I seriously think that a vast majority of webcam performers do not understand the terms and conditions pertaining to copyright and DMCA and it should be the responsibility of the sponsor site to make all this more clear and make sure that performers at least have a basic understanding before being allowed to sign up and broadcast, along with understanding exactly what an affiliate is allowed access to and use in way of their profile information and content...

Said performers need to treat this as a business in my opinion, I mean for example you cant just go out and become a paramedic without knowing anything about first aid and medical treatments can you? just as a hypothetical example... as they can and do cause many problems even for the legitimate webmaster affiliates, I am quite lucky in the fact that I have a very good relationship with my hosting provider and they understand the problems and contact me first before taking any other action when an angry performer or law firm has requested termination of my websites, needless to say fortunately this has not happened and the misunderstanding has been cleared up after the exchange of only two emails ! now if I was doing anything wrong they certainly would not be taking any chances no matter how good of a relationship the law is the law... Other legitimate webmasters though have not been so fortunate and they have been shut down immediately without any investigation or in most cases any valid reason given ! whilst the real criminals continue to thrive.

One other thing worth mentioning is AWE I was promoting them for a lot of years (until all the tubes started using their popunders and my sales died) in all those years I never even once received any copyright take down request or later any DMCA either when it was made and I was doing nothing different with them to what I am doing now... makes you wonder why that is?
