Default i got called the n word, can i sue?

i got called the n word at work by a white dancer and she came towards me and an employee had to wedge himself between us to prevent her from attacking me. she was cussing and coming towards me wanting to assault me. i stayed extremely calm during the whole ordeal, telling her i think she's cool, why are you doing this. i am black and she's telling other dancers, i called her the n word. i have several witnesses to her saying it. she said it in front of the valet guy, door man and the locker room. the club terminated me and 86ed me. can i sue?

    Sorry to hear.

I doubt cause the strip club industry is hella racist as some clubs still have quotas limiting the number of non white women. They also limit the non white patrons by restricting the music genres.

They only way you know for certain if there's any way to sue and get some sort of compensation for missed work is to consult a good lawyer.

Sucks you were the one to get fired. If I were you and I got fired I would have left that hoe a parting gift

Gonna be an insensitive jerk here...
But this is the strip club world, in the sex industry, which is not nice or pretty... It's a harsh business. Pretty much anyone who isn't a size 2 blonde Barbie is going to have nasty things said to them, by both customers and other dancers. Hell, I AM a size 2 blonde Barbie and I've had a couple guys attempt to upset me. It comes with the territory and is why we tell girls to get a thick skin and that it's not an occupation for sensitive people.
Put on your big girl panties and find a new club.

Also, I can't imagine a lawyer taking on such a frivolous "but she called me a name!" sort of lawsuit, racist or not.

^^^^i think she's referring to hiring a lawyer for being unfairly fired not for the girl calling her harsh names.

    Agree w/ Selina ^^^^

If you're such a delicate flower that you can't handle being called nasty names, this probably isn't the industry for you. Name the slur -- be it racial, ethnic, sexual, or anything else, most of us have heard it b4. Look up the 'Bitchiest thing a dancer has ever said to you' thread, & the 'Stupid Customer Comments' threads, there are at least two each on the subj. Sry to be harsh, but grow up or get out.

Now, you didn't go into detail abt the fight, & details are mainly irrelevant at this point since you got canned. Was she wrong to drop the n-bomb? Most likely. Was it fair that you got fired? Idk. I got fired from a club once bc they booted ANYONE who got caught fighting, both the instigator & the defender. Another girl picked a fight w/ me & I ignored her til she put her hands on me, then it was ON. We both got fired, & for me it was a blessing in disguise, bc in more ways than one, that club didn't have my back.

Which I think is the more important matter at hand than being called a bad name. What in the fuck is so wondermous abt a club that blatantly threw you to the wolves, that you would even consider suing them to keep working there? Unfortunately, American entitlement mentality allows ppl to sue for sm very frivolous things. Being able to sue, however, doesn't guarantee you any benefit. Save yourself the $$$$$ & the headaches & find a less toxic environment for yourself.

I know, it still just amounts to "Why was your contract terminated (which your club has every right to do with no reason)?" "She called me the N word" "No I didn't"
I think a lawyer would bash his head into his desk listening to what is pretty much stripper locker room drama.

Good point you have though I am wondering about the laws and what constitutes "frivolous". from what she's mentioned, I'm not sure I'd sue in that situation but Hey I've seen and heard some cases i thought seems there was no chance and end up getting things changed in their favor.

I was just thinking if the strip club were like vanilla professions, they have a protocol of hiring and firing and face consequences for things like discrimination, unsafe work environments, harassment, etc.

Sad but the strip club doesn't have these sort of protections. And I don't think a dancer could sue UNLESS something major happens like extreme prostitution and drugs, trafficking, deaths, serious physical injury, etc

And Unfortunately emotional abuse doesn't count. I think many dancers have experienced emotional abuse whether from staff, other dancers, or patrons but not much legally can be done for being abused emotionally. If I sued the times patrons sexually harassed me or other dancers trying to mindf*ck me, I would have won at least a handful of lawsuits by now. Sometimes your energy is best spent elsewhere, work where you feel respected, and know people that put out negative will get it back in karma.

If she didn't get in trouble for that, we can all assume she's fucking and sucking cocks all night and giving the club her money. Nothing wrong with being a hoe, but we can assume that club is using her to keep business. Cuz that makes NO sense.

I would reread your contract. Most contracts basically say that the club can terminate you for any reason (at least in my experience). With that being said, I'm not sure what basis you can sue the club. Try consulting a lawyer if you wish. I'm pretty sure he/she will give you better advice then stripperweb. However, I still don't believe you have grounds to sue.

    Scribd,

I am sorry about that happening to you. However, I am proud of you for keeping your cool during the whole ordeal. Just find another club where you can be at peace. I would have to say the sex industry including everything from strip clubs to phone sex to web camming can be very dark. You will hear racial, ethnic, sexist, and other hateful language thrown at you. Now that dancer is just being a insolent child but your ex strip club is really bad terminating you only. Personally, I believe your termination was a blessing because you do not want to work for club like that. Your skin will get tougher as time goes on

I don't think you should sue, unfortunately. I think you should just find another club, hopefully a better one. This may be unethical of me, but I think you should beat the bitch's ass who called you the N word... I mean, it's not like they can fire you over it now.

Yes, you have to have a thick skin in this industry - especially as a black girl. But I don't think we should call girls "delicate flowers" for being insulted that they were called a word that is probably THE most offensive in the English language and has a nasty history attached to it designed to directly insult a person of the same ancestry as the OP. And it sounds like the OP kept her cool and handled the situation better than most black girls would if they were called that name, because let's be real, the N word is hate speech.

Op, sorry this happened to you. Hopefully the next club you work at will treat you better. That bitch who called uou that definitely deserves to get her ass beat and I hope it happens soon - sorry, not sorry.

I agree that people shouldn't tell blacks to "get over it" or "suck it up," but a lot of people who are not black simply don't understand, or are ignorant, to the struggles blacks face. Because you were born black, you face systematic racism that oppresses your race; conversely, because a person is born white, they may be oblivious to the harsh struggles a black person faces and may think those struggles are trivial enough for them to have a "suck it up" attitude, because they haven't experienced it. Some white people who've experienced it second hand (via a friend getting discriminated against or something), will be more understanding of the struggle. Just because someone isn't understanding doesn't mean they were born evil. That is a ridiculous statement to make, since racism is learned.

The definition of racism w/o all the bleeding-heart, psuedo-intellectual fluff.

No one who said 'don't bother suing' is siding against the OP, or in any way saying that what happened to her is ok. But bringing a lawsuit isn't anywhere near as simple as bringing a lawyer to the club, pointing at the dancer in question, screaming 'She hurt my feelings!' & magically getting awarded whatever damages you think you're entitled to.

None of us are being racist by pointing out that the simpler, easier (& cheaper) route is to find another club. We also aren't being racist by pointing out that pretty much every girl is going to get called nasty names at sm point while in this industry. It's a strip club, not a convent. This is the adult industry & being an adult means sm times you have to pick your battles instead of throwing a hissy & threatening legal action whenever your feelings get hurt.

Most strippers are used to being insulted, called all sorts of "nasty names" but the N- bomb is not "business as usual" imo even in the stripping world. Being called the most hateful and extreme of racial slurs may not be reason enough to sue to some, but if this were to happen amongst independent contractors of a different occupation, this would be grounds for a lawsuit. I believe that the cheaper "easy" way may be more beneficial in the short term, but if a civil rights lawyer were to take the case, I think it would force strip clubs to change some things. Even though some of you may think it's not worth it, you really never know. The industry has changed bit, even regarding labor practices in certain clubs.

I beg to differ, based on the yrs I have heard that word flung around in dressing rooms, VIPs & anywhere else in the clubs I've worked. 'N this' & 'N that' spewed by blacks, whites, Latinas & anyone else, abt anyone else. I've also heard wigger, cracker, chink & various other slurs thrown around, & yes, I find it all equally infuriating, bc those words were coined w/ the exact same intent as the N-word. Dehumanisation based on race, the core of Ivy's 'all whites are born evil & racist' remark. They hurt & piss off the ppl they are directed at just as much as the N-word. But no one ever tries to make a 'civil rights' issue out of it -- out of a freaking WORD.

We also only have OP's side of the story. For all we know, she could have been on thin ice already for smtg completely unrelated to this incident, & mgmt just used it as a cheapass excuse to get rid of her. Does that excuse her being called the N-word? No it doesn't. But it's probably racist to even think such a thing as 'We don't have the whole story' when the story involves a non-white person …

A point I think is important, OP: why exactly were you thinking of suing them?

Was it really just bc you think the other girl 'got away' w/ calling you names, or did you think you would be able to get them for wrongful termination? Would this even be an issue for you if you still had your job there?

I am in the UK so my advice is probably irrelevant. However, there's a difference between someone being bitchy and someone using language like the n word. What she said to you is unacceptable. So, regardless of whether you can sue or not I would make a formal complaint and (if it's possible where you live - it's possible here in the UK) report it to your local authority as a hate incident. Sorry you experienced this, it's not ok. xx

You can see the cognitive disconnect where people shout "You should have.....to her before you left the club." White women can indulge that feeling and get the benefit of the doubt form management and the cops. When non whites so much as complain and resist things like the Sandra Bland incident happen.

So, OP, you did the best you could under the circumstances. No one can really tell you if suing is worth it. You have to decide for yourself if making a point, getting publicity, and/or getting a settlement or judgement is worth trying. It has been for some! You are certainly entitled to an apology and damages if they've affected your expected cash flow. So research suing after harassment and talk to a lawyer specializing in Civil Rights violations in the workplace, retaliation, etc. I wish you luck, babe! And if it's any consolation you are handling this well just by using your wits instead of falling into the trap that trashbag tried to set for you.
