Default Agency asking for prepayment to do a background check. Legit or scam??

Hey friends, I have applied for a high class agency who wants to hire me.
But they are asking for a prepayment of 97USD for them to do a background check. They would reimburse this after first job is done.

Apparently they just wanna make sure Im not a murder or kidnapper...and their insurance company requires them to provide this for every single employee.

They are offering a free photoshoot and airfare to palm beach for a coaching and photoshoot but are not gona pay for background check in advance?

What do you guys think is this legit or fraud? the website looks really good and they seem to partner up with some other high class agencies in nyc are..

Also Im a non us citizen and only here for a few months to work, so is a company allowed to do a background check on me while on my tourist visa? Am I not gona get in any legal immigration trouble? Since I know one is not allowed to look for a job in the US while visiting.

not sure but it seems strange to me - most agencies have independent contractors not employees

call the agencies they are affiliated with and ask for a reference

Look into them further. They are willing to pony up $ for a flight and professional photoshoot, but are going to nickle & dime you over 97 dollars? Hmm....

Don't get me wrong i think background checks are good however it would sounds odd you'd be considered an employee. Also they are saying they will "reimburse" you after the first job?!? So they are gonna take a portion of your profits from the first job to 'reimburse' you? That simply sounds like a sugar coated way of saying- you will be paying for the background check.

I would ask exactly where is the money to reimburse coming from.
