    Default Move, stay, HELP!

    Ok, my lease is up on the 31st and the owners aren't wanting to renew leases for tennants who've been here really long. A 500 square ft. Apt that I now have is 600 at my grandfathered rate, but will go up to 620 if renewed. A few facts:
    -I've been here almost 11 years, in three different apartments. This most recent one for almost five.
    -This current one has shifty carpeting the previous tennants, ironically brain surgeons, put in that is falling apart. Management is scared to shampoo it, even though the lease states they should twice a year. I can change the carpeting, out of pocket.
    -They were originally supposed to change the carpeting, paint, and put in baseboards in 2011. I'm still waiting. I've broken $500 in vacuums every month I've been in this sinkhole trying to keep it clean.
    -I'm on the third floor, but it's a split level with no elevator-so I have to go up six flights of stairs to get to my place.
    -I paid 800-a double deposit on a stufio-when I first moved in, which they've made very clear won't be returned.
    -I've given up on a garage spot, since I've been waiting ten years for one. There are twelve parking spaces in the tiny, ice covered "lot", so most have to park on the street and move their cars at seven am and four pm on weekdays, due to the rush hour parking bans.
    -Every place the same size I've seen advertised has been cheaper.
    -Every place I've seen for the same price has been bigger.
    Honestly, I'm really ready for a change of scenery and have a lot of bad memories in this place. It's also cold out and moving is a pain. Would you?
    -Stay here, despite the faults, just cuz it's easier? If so, sign a new lease or go month to month?
    -Go for a new apartment, which would either be cheaper or bigger? In any case, much more aesthetically pleasing?
    -Rent a house?
    -Extended stay hotel, many of which are pet friendly?
    -Only stay if they actually make the repairs promised YEARS ago?
    -Move into a different apartment here, just for the sake of carpeting?

    In my opinion I think you should look into renting a house. I personally prefer Single family houses over apartments. It's nice not having to deal with people right next to you and not have to go up stairs/elevator each time. Have you thought about just purchasing your own house or condo? I have heard that their are first time home buyer programs that only require 5% down payment.

    I would not sign a new lease. I would go month-to-month and look for a new place. I would also check your local housing laws for number of days' notice that must be given before eviction for various causes. If they can't evict you for over a month (in my area, the process takes a long time and is very tenant-friendly), I would stiff them on the rent for the last month, since you say they'll keep the deposit. Of course you've already paid for this month, but if you stay for a bit longer until it gets warmer, then you can live there free for the last month of that time.

    They can't take your money and treat you like that! If you pay them they need to make repairs or find a new tenet. I'd take one of those nicer places for the same price.

    Get a new apt which is bigger and prettier, possibly cheaper, and hire movers.

    Why did you pay a double deposit? Are you certain its not refundable?

    If they won't refund your deposit and holding onto it unfairly and you decide to stay you should press their ass to refurbish your apartment. I stayed in a nice community that rewarded residents with a free carpet clean when they renewed their lease. So since you've been a loyal resident for so long they should give you some type of freebie (carpet cleanse, better parking spot, some type of discount on rent, etc)

    But you sound like you want to move so to get the ball rolling, do a month to month. This way you have flexibility to move as soon as you find something you like better and you will have motivation to work faster to find something so you won't have to keep paying higher fees.

    Also if the weather will be sucky, pay people to help you move so all you have to do is pack/label/organize boxes then tell them where to put said boxes. It will cost you at least $150 for 2 hours and also have to provide an additional tip for them too.

    Thanks everyone so I'm not being unreasonable for.....ya know, wanting repairs done I asked for five fucking years ago.....I'm working as much as I can now to have the money for a nicer place. I'm really leaning towards moving. Is it against site rules to post pics of the damage and how ugly the place is lol? Miss a.p.1600, I had to pay a double deposit cuz this was my fourth apartment at twenty and I broke a lease at the second one cuz the landlord was entering apartments and stealing money and valuables. After 1700 went missing, I decided to move. Wow, do I have shitty luck or what. As far as the down payment, I killed my credit in 2013 after racking up ten grand in medical bills after almost bleeding to death. I really want to get my credit back, but have no clue where to start.

    Get the fuck out of there. They don't do repairs that are minor and need doing--what are they going to do when something important goes out like heating or water?

    They can't legally keep your deposit 'just because,' unless you somehow signed a lease that says you forfeit your entire deposit/it's non-refundable. In fact, unless the lease explicitly says 'non-refundable,' they must evaluate your apartment for return of the security deposit less any non-refundable portions.

    If they say they won't give it back, dig out documentation of everything that they've failed to do. Take photos of damage. Get copies of texts and emails. Find old work orders. All of it. Now when you move, make sure you put in proper notice to GTFO and look up your state laws. Landlord-tenant rights are specific state-to-state, but generally favor the tenant.

    In your case, you should be able to file in small claims court for the full cost of your damage deposit (to be returned) + court fees + cost of repairs you've been forced to do because they won't. Seriously--if you can prove they promised to replace the carpet and it's damage cost you $X amount per month, the court will award you those costs in damages. Small claims court is a simple process--usually $25-$50 to file and a 2-3 page document to fill out. The burden of proof in most areas (again, check local laws) is on the landlord to explain why they aren't giving back the cash or didn't do the work.

    Fun fact--carpet has an 'expected life' clause in many areas, meaning that if the carpet was meant to last 3 years and you lived there for 5 the landlord cannot charge you for damages to the carpet regardless of condition because it is beyond it's lifetime expectancy. That applies to nearly everything in your apartment. Battered/damaged flooring/walls/ceilings/etc. the landlord tries to charge you for? Trying to say you 'broke' a 40 year old refrigerator? That allllll gets thrown out in court normally.

    Again, GTFO and fuck them up the ass if they don't fork over your money on the way out.

    Re: your credit. Order your credit report and see where you're at. Get a few cards/credit accounts in your name and charge a small amount ($100 or so) each month then pay it off within 30 days (which means you pay no interest whatsoever). This builds your credit back up. Medical debt and even bankruptcy become less important after 3 years, while totally dropping off after 7 years of non-payment in many areas. Check your report to see how you're doing and check local laws for what debt is close to falling off. I'd then talk to several banks to see about the pre-approval process. You'd be surprised at what you may qualify for. Again, do your research--no variable rate loans, low percentages (compare for your area via google), and a decent down payment (or qualified 1st time buyer program) can get you in a lot of doors!

    MOVE. I lived in a shitty place for a long time because I didn't want to deal with the 'hassle of moving' but when I eventually did move the whole process was a piece of cake. And even if it ends up being a pain in the ass for you, it's only temporary and it will be worth it in the long run a million times over. Living in a home that you really like does so much for one's mindset.

    As for living out of extended stay hotels, there's many posts on this forum that will show you what an absolute nightmare that can be.

    Ok, so if I'm a few weeks away from 31, the broken leases from when I was 18-20 don't matter so much? Also, given I've lived in this cough*shithole* cough for almost eleven years, lack of repairs and all, potential landlords would know I was in it for the long haul and I'm really patient. PS- just got home. Parked ten blocks away. Gave two people asking for money ten bucks, another guy cigarettes, and stepped in a huge pile of (hopefully) dog shit. That, ladies and gents, perfectly describes how I feel about this place. Fun fact: I stopped in the leasing agents office when I'd been here two years to tell them I'd be late with rent that month and I'd have the hundred dollar late fee in with it. After finding out I'd been there a few years, the owner present that day not only waived my late fee, but offered me the land lady's job right in front of her. I declined and then, he went through my file, found my number, and left me a voicemail offering me the job again. So, wonder what they'd say in person when I'm going on eleven years and waiting five years for simple repairs(except, you know-the ceiling starting to fall in from water damage). Hell, if they offer me the job again, I may just take it. I know it comes with the nicest apartment in the complex and reserved parking, but that's only worth 800, max. Not sure if there's an hourly or commission on top of that, there'd fucking better be. Well, keep the ideas and opinions coming, beauties-I'm off to oxy clean the shit out of my shoes-literally

    This is definitely the law-abiding way of getting your money back, if you don't want to stiff them on the last month's rent. Doubtless they are counting on the fact that you won't sue them for the deposit. Most people don't pursue stuff like this, because the amount of money involved is juuust small enough that it's easier to move on and forget about it.

    They most definitely owe you the deposit money. Unless you've been trashing the place, it's just been accumulating normal "wear and tear" during your stay, which is for them to fix out of their own pocket.

    They will never make the repairs while you are there. You have no leverage over them to get them to do this.

    Edit: Saw your new posts. It's really unprofessional of the owner to offer you the apartment manager's job while she's standing there! It also doesn't speak highly of his style that he would offer you the job without more information, interview, etc. Sounds like things are not well-run there. If you're not desperate for the cash, I would refuse the job and just move. It's great that he waived your late fee, but you should still do whatever you can to get your deposit money back.

    First, where do you live that they think they can keep a deposit? Look up your state laws in that regard.

    Second, start communicating in writing. Like on the carpet cleaning, it will show you are serious, and their responses will show their lack of follow through if they decide to screw you.

    You need to make a list of deficiencies and email it to them and start asking that they get fixed

    End of the day, you need to move, but you need to be set up so they fear you and won't screw you for a reference or BS charges

    Another thing you might be able to do is call your city's housing/apartment inspector. I lived in a crappy apartment as well for a while (I wasn't aware of the complex's history or condition because when we moved in it LOOKED ok). After maybe 4 months our air conditioning broke and a hole developed in the ceiling of the bathroom from a water leak. They 'fixed' both issues for about a week then the ceiling collapsed while I was taking a shower (they had plastered a pokemon poster from burger king over the hole) and the A/C again stopped working. They dragged their feet with fixing anything. At the time my job had me working with the city for A/C installation permits so I was able to call around and get the housing inspectors to stop by and lay down fines on my apartment complex. After 2 inspections they offered me a different apartment or allowed me to break the lease so they didn't have to deal with me anymore.

    Yes, I recommend paying up and getting the fuck out, then going to court to collect your fees.

    If you have proof that you had to pay for work you requested and they did not do, the courts will award you those costs.

    If you have proof that they are withholding your deposit, then you will get your deposit back. Most states have a 14-21 day policy on returning deposits, meaning if they don't give you back your money or an itemized list of reasons why you're not getting it back then you are legally obligated to be given 100% of the deposit back immediately and a court ruling will side with you.

    Start making a paper trail. He said, she said won't do shit here, but documentation will. Photos of the status of the place when you move out will help--even better if you have photos of the status when you moved in.

    If you do rent your next unit, always photograph every inch of the place, email it to yourself (documented time stamp) and print that off for a file. Note any failures to do repair work and other inconsistencies. When you move out, repeat the process. It's called ass covering and it's a life saver.

    Scummy landlords are known to not just keep your deposit, but try to blame you for damages to get extra cash in small claims court. I've watched it happen with a friend of mine. Even if you only document on your way out of the apartment, you need to document leaving so they can't come at you for that.

    As always--laws vary state to state, so check into it.

    As for before--your previous breach of lease is more or less unimportant now with over 2-3+ years of good rental history. Many applications only ask for evictions in the last 5-10 years. Check the application for what it wants, or the local law for how far back you have to disclose rental history or, if you're comfortable, explain it to the potential new landlord as 'hey, I was 18-20 and broke a lease because of X situation. It's been 10+ years. I've had great rental history since. Do you care about that eviction and want it listed or is it moot?'

    Your credit history, assuming you've been establishing good credit since the medical bills situation, should be solid enough to apply for first time home buyer programs. Google first time home buyer seminars. Many cities offer them for free ever 1-2 weeks during the day and go through the process of qualification with you. Very enlightening.

    Yes, but MI is considered a closing cost. It also needs to be paid on conventional, subprime and some VA loans (called a funding fee). I was pointing out that it can be cheaper for certain people to purchase than to put a deposit on a new rental. Also, you can refinance out of an FHA loan eventually to get rid of the MI (the monthly charge is .8%) and with a conventional loan you do not need to refi, the MI comes off (upon request) once you have 21% equity in the property.
