    Hey everyone, just wanted to quote this post from the FSC on Xbiz. Prop 60 does not only affect California. It is made to shake up the industry as a whole. If you are affiliated with any content that California IP addresses can access, you are vulnerable and at risk. Please help spread awareness as this is very important and can affect everyone.

    Here is an overview of who will be liable under Proposition 60. FSC Is raising money to fight this. This will be the last political battle AHF can fight on this, they have been discredited on this issue over and over.

    But the PAC fighting this needs money. We need to be able to reach the voters, buy pamphlet spaces, radio, maybe even TV.     We need the industry's help in this. As you see below - everyone will be liable.
    You think you are excluded because your company is not based in CA or you don't produce in CA? The threshold of getting involved in lawsuits is simply that if CA IPs can access content that you are somehow connected to (produce, distribute, affiliate, webhosting, process payments, perform in, did the wardrobe for, etc) -- you are liable.
    Who is liable? Anyone who has a financial interest, and/or anyone who aids and abets the production and/or distribution of adult content will be liable to lawsuits by ANY of the 38 million residents of California.
    For How Much? Fine Amounts of $1,000 to $1,500,000
    How do I fight? Legal Costs of $10,000 to $25,000 minimum.

    It's being blanketed as a Condom law, but it is so much more. It takes away performers rights allowing any citizen of California to open a lawsuit. It allows performers legal names and addresses to be accessed and published. It will affect anyone who is affiliated with content from the cam models and amateur to the mainstream porn.

    I'm linking an article that explains much better than I can but here is an important excerpt.


    "Most voters are unfamiliar with the industry and its workers, so the initiative appears to be an easy victory for progressivism — a one-two punch wherein the porn industry becomes a conduit for safer-sex messaging, while allegedly increasing workplace protection for the performers. But Prop. 60 is anything but progressive. It jeopardizes personal privacy and weakens workplace safety for adult film workers by empowering any resident of California to sue adult film performers — even a married couple producing content from their own home."

    ETA: Even if you don't live in California, if you produce content that is boy/girl, girl/girl anything with another performer in any capacity it will give ANY California resident the right to open a lawsuit against you if they feel you are in violation. Granted, once it reaches court it will most likely be dismissed since you can prove it wasn't produced in California but at that point how much are you buried in lawsuit jargon and lawyers fees?

    As much as I am an advocate of sexual safety, enforcing testing, condoms and making porn producers liable for diseases is ridiculous and downright stupid. No one is being protected, give me a break. How are they going to prove that a disease was actually caused by the production of porn as opposed to just having sex with the wrong person? California is one step away from being communist.

    If you are a cammer/clip maker and anyone looks at what you makes and think that it is somehow in violation of any of the rules dictated by prop 60, they can have your legal info pulled and published and sue you. The average joe soap.

    What this bill allows for is anyone with a California IP address to take action. Of course anyone in Cali who has internet access has access to everything, so even if you are in Europe or something, they can still get your info etc. It was designed to "protect" California citizens and to tailor the content they have access to.

    If you are a solo cammer and solo clip maker you are fine. If you want to cam with someone even one time and a citizen of Cali finds it in violation of the laws, they can harass and sue you with your info.

    Couples who cam, couples who make clips, anyone who does anything with anyone else will have to go to crazy lengths to show they are being safe. This means, condoms, dental dams, goggles etc to protect against the transfer of bodily fluids. Fail to be in possession of any one of these things while camming/filming with anyone else, and no matter where in the world you live, a California citizen has the right to take legal action against you.

    It is so important that if you can, you vote no against this.

    I just read the whole thing (prop 60) and wish I had some popcorn to munch on. This thing is so patently stupid I'm not even sure how it became a proposition in the first place, it basically puts a single guy above the CA state and federal constitution and says that if he's ruled unconstitutional, then he's able to sue for that...which is itself unconstitutional.

    Basically its a gun to the heads of the people of CA - rule me unconstitutional and I'll take $100s of millions of your state tax dollars -or- leave me be with my dictator-for-life power grab and I'll extort $100's of millions from the porn industry (and the banks, studios, film industry, credit card companies, etc that support them) and drive them out of state.

    Here's the thing, no honest court will let this slide if challenged which will put the state on the hook for the built-in "dead man's switch"...he automatically takes the state to court. Even if he loses, that's still millions in state funds tied up for years and he's looking at a healthy settlement.

    That Weinstein guy basically is trying to set himself up as dictator for life over all things porn, nationally and internationally...and if he doesn't get that, then he gets very very rich at taxpayer expense.

    While I do agree that condoms should be mandatory for porn performers, I also understand the consequences of it. They'll just hire models from oversees and/or shoot somewhere else, and it will remove a large industry in Cali. The porn industry is already struggling anyway. They're loosing a lot of money to online dating sites, so this would really be the final nail in the coffin.

    Also, I do think that the porn companies should be responsible for the expenses of STD tests. I think it's shady that they don't.

    Some of this is out of hand, however. Googles for eating pussy? That's hot...people will definitely want to watch that.

    It always would force married couples to use condoms too.

    Most of the big site would just block CA and the big guys have the teams to follow this law and fight all cases. This law would kill the little guy. In cali it would cost over 200 just to get the right paper work just make scene with no grantee that many will be made back. Allow ANY California resident to sue producers for violation of this Act with the incentive of receiving 25% of the money award and recovery of attorney fees. Scary scary. Oh yeah and you can say bye bye to anonymity if you shoot porn in Ca if this passes.

    I don't understand why we don't just have mandated government officials to stand in our bedrooms when we're engaged with another human being and make sure we are having safer sex under a condoms-only law? I'd rather have some government official watching my boyfriend and I have sex with a condom than actually educating the general population on safer sex practices beginning in elementary and middle school. It's the most cost efficient and effective way of ensuring people are completely clear on the fact they should be more mindful about their sexual behavior because the government's abstinence-only program failed. I only learn to sing from American Idol auditions, and I only learn to drive from movies and go-kart racing.

    Honestly they could care less about the porn performers. If they really gave a shit if we got STD's maybe they'd actually be taking care of other problems in California too. Like homelessness, drugs, corporate greed, the WATER issues, gangs, - you know- actual problems. All I see here is them having open season on porn trying to make $$$$$$$ the easy way, by legally stealing it. The fact that it can reach out and affect people producing in other states screams blatantly of GREED. It's all about the $$$.

    Which is the LAW, all filming for commerce requires proper permits & insurance. A male talent once broke his cock on a set in LA, so his medical cost & out of work time should have came out of his own pocket? Where was the insurance to cover injuries that happen on the job? Workman's comp?

    It is the only industry without any regulations, how is that right. Why do we have to pay for our own test?

    If you do catch something on set you are Shit out of luck... How is that fair.

    Bang Bros director & team put LOTS of pressure a female to shoot with Mr. Marcus when he obviously had syphilis. The industry ostracized her & she had to sue Bang & Mr. Marcus.. Where was her workman's comp? Even though that went down in LA, I know several male talent in Miami are who also took about a month off during that same time. They had recently worked with a few girls Mr. Marcus had shot with while infected. The STD panel used during that time did NOT test for Syphillius..

    Directors & companies straight up tell performers if you don't forgo condoms we won't shoot you. So if you want to practice safe safe on camera you are not hired, you have no choice but to take risk you don't want too.

    How about how they now want to make an antibiotic shot every two weeks at your own expense mandatory? What is going around the talent pool & how often is it that they want to require mandatory antibiotic shots? That is what's scary to me..

    Why does the adult industry think it should be exempt of health codes, permits & such that all other businesses require?

    Performers with a vested interest is mainly the male talent who have dvd deals & production companies like Jules Jordan, every male director for Evil Angel and such. Most of the females only get a one time pay, they don't get a percentage of the sales. So this doesn't really affect the female talent cause we don't get residuals. EVERY stalker knows that he or she can go onto the content wholesale market & for as little as $50 buy content along with the performers Ids, address & SS#. Where is the industry protecting the performers in that scenario?

    This industry has operated as predators for decades with throwing the performers under the bus every chance they got, I have NO pity for them at all.

    The companies in LA have had several years to fight this & be proactive in working with Osha, but they didn't. Now they lay the whole thing at the talent's feet and make the performers, the least paid out of everyone responsible for fighting this. The pay won't increase, but your testing cost will. Why are the test so expensive? Why are there only two options for testing?

    Porno Dan got a permit, he uses condoms in his shoots & live cam shows on SM. He is banking.


    I have done many scenes with condoms & without. I prefer with condoms. I no longer to b/g scenes cause I refuse to make these companies money anymore. I'm one of the few who can demand condoms and still get shot. Unfortunately, lots of performers don't have that option. Companies take away their rights to use condoms in shoots. Anytime a company puts their profits over another person's safety, shouldn't be in business.

    Who want's to forgo testing if condoms are required?

    I used condoms all my adult life before I got into porn even in relationships. NEVER caught an STD or HIV since I did practice safe sex. Sucked plenty of dicks with condoms on too.

    Funny how lots of people, doctors & health organizations have proven that condoms greatly lower the risk of STDS & HIV. Only in the adult industry do we argue the opposite despite decades of proof and statistics.

    Who is saying we don't need testing with condoms? Yes, pop shot in the face or cream pies would be illegal.

    When you say it is OUR responsibility to check the test of the other performer. Then we should get a choice in who that performer is too? Right? Cause 90% of the performers have NO choice in who the other performer will be. That statement absolves the company of any responsibility, which I find to be illegal & unfair.

    STOP saying performers have a choice to use condoms on sets when several companies & directors have made public statements that it is NOT an option. So if you are on set, the male performer shows you a piece of paper but you heard he just got back from a trip to South America & demand condoms.. You would be thrown off set & everyone on that set pissed off. You would be blackballed from the industry.

    If the male performer has a cut on his dick and you request condoms, there will be an up roar.

    If you are working with a female & the pussy doesn't small right the male performer STILL can't insist on condoms without the whole crew getting pissed off & cancelling the shoot. The male performer will never be hired by that company & several others again for a long long time.

    I've been on set where the other female performer was sick & puking everywhere. I refused to continue to do the shoot. The agent screamed at the director & called back several times demanding I do the shoot with her anyways. Fortunately for me, I was the bigger star & the director loves me. So we rescheduled with a different girl for the next day.


    There are plenty of performers who would love to do condoms & testing, only they know if they do want condoms their careers would be over.

    Whether you test every 30 days or every 14 isn't required by law. These are suggested practices in the industry, NOT laws.

    My comment about posting signs etc. was more about residential homes with amateur couples filming content and if any California resident doesn't like it or wants to harass, they can file a lawsuit. Not to mention the insane incentive to do so since according to the FSC they will receive 25% of said lawsuit.

    Regardless of your feelings on condom laws and testing etc. (which you know way more about then I do from being such a heavy hitter in the industry) making it easier to harass people is not okay. Making it even EASIER to get a performers legal name and address is not okay. Of course there are already ways to get it, but there is no reason to hand it to them on a silver platter.

    You know whats even more fucked than that financial incentive about this. Is that person can do this wether they paid for the porn or not!!! Thats right d-bags can steal your content and then be financially compenstated for it by ratting you out. This whole prop is just fucked!
