    Last year I got rear ended, I've been in pain on/off since then. The accident wasn't serious but it did gave me chronic back pains, neck pains, tingling in arms and legs. I have a 3 bulging disc in my neck. Nerve damage in my back, neck, arms, and legs. I've been going to the chiropractor 2x a week for the past 6 months. I got discharged because my car insurance cut me off. I am back at the same chiropractor and I'm paying $40 per visit out of pocket. My lawyers said I probably won't get anything back from settlement. I have the flu since last month and it's making my pain worse. This is forcing me to miss work and school. I am sure if I didn't have the flu I would be functional. Everything hurts and I'm having stomach issues along with muscle ache.

    Is this the end of the world? I'm tired of being in pain.

    I also don't hear from the law firm very often. Maybe once in three months. Should I keep calling them or get a new attorney?

    WHAT TO DO???

    New attorney. Lawyers in my opinion should respond within 24 hours (unless it's a weekend or holiday) if you're paying them to work for you.

    They do get back to me right away. They don't update me on what's going on.

    Oh ok. Are you thinking they're withholding information from you or they don't know what they're doing? Or something else? Idk. I'd say go with your gut then. Have you tried communicating with them that you'd like to be updated as new info comes up?

    They're trying to blow you off..yes, for sure get another lawyer. Be sure to keep a 'pain diary' along with keeping track of every expense, inclding over the counter meds, how much work you miss, what is compromised in your life since you've had this (activities you can no longer do, day to day stuff etc.

    I'm not sure if I'm being paranoid. They did sent me a letter for my primary doctor to release my medical information. That was in October. Should I give them a call?

    No a professional lawyer will call you and discuss with you first if they won't be able to represent you. Then they will send you a document in writing to confirm this.

    So if you want to contact them then call or email. Just write out a list of questions/concerns you have beforehand so you can address everything at once and BE EFFICIENT. Last thing you want to do is run up a legal bill by wasting time having them work for you doing things that you can do/find out on your own.

    They said they wanted to represent me and sent me a letter confirming it. Should I still be concerned? Would they be able to blow me off without sending me a letter saying they can no longer represent me?

    I hope you got everything figured out, OP. I'm sorry you're in so much pain. Are you taking any pain killers, whether it be pills or natural alternatives?

    Be very communicative with your lawyer. Don't be afraid of him/her, they work for YOU. You are paying them, not the other way around. You're acting like this person is your boss or something. Remember, they work for you, and you can replace them at any time.

    UPDATE: I got a copy of the complaint that my lawyer wants to settle for $50k. Is that enough? After he takes 40%, I'll end up with $30k. I have permanent damages and wondering if I should negotiate.

    I'd negotiate.

    I still have nerve pain from car accident injuries that happened in 2001. BUT my athletic lifestyle & dancing job aggravated those injuries. There's no way to know how your injuries will age until you are 5-10 years down the road.

    Hi, I used to work with PI ( personal injury ) lawyers, and I am pretty familiar with these types of accidents.

    There are a few questions that come up after reading the thread.

    1, You describe the accident as not serious. Was there over $1,000 damage to your car, or the car that hit you?
    Did the police respond and was an official accident report filed?

    2, Did you go to the hospital in an ambulance? If not, how long after the accident did you first receive medical treatment? Did you first go to an MD, or ever go to an MD. Or is all of your treatment by a Chiropractor?

    3, Did you miss work as a result of the accident and do you have documentation of this?

    4,You say that you have chronic back pains, neck pains, tingling in arms and legs. I have a 3 bulging disc in my neck. Nerve damage in my back, neck, arms, and legs. Is this the Chiropractor's written diagnosis? And do you have medical records with X-rays and MRIs to back this up?

    5, Back on 12 - 08 -2016, when you started this thread, you said that the lawyers told you not to expect anything from the settlement. Then today you said you got "a copy of the complaint" that the lawyer sent you. This is important, did the other side's insurance company see the letter you refer to, and then counter by offering your lawyer $50,000 to settle? Or was the letter you refer to, what is called a Demand Letter. This means that your lawyer has reviewed the case and he is demanding ( offering to settle ) the case for $50,000. It doesn't mean that the other side has offered anything to settle the case. It's possible they haven't even seen the demand yet.

    I'm on your side and I wish you the best. Here is my view from what you've said,

    Generally and historically, PI lawyers look on cases with low vehicle damage, and no MD involvement, as nuisance cases. That doesn't mean there is no settlement. but generally it will be low, as in $1,000 - $10,000. When your attorney said "not to expect any settlement money", I think he was priming you for a low settlement, and no money in your pocket. They justify this by saying that even if the settlement was $10,000, there would be nothing left after the Chiropractor and the lawyer are paid.

    So, it's very important to find out if your lawyer was telling you that he has been offered $50,000 by the other side to settle the case. Or if he has just started negotiations, by asking ( sending a demand letter ), to the other side, demanding $50,000 to settle.

    Finally, the leverage that you have is that it is necessary for you to sign off for any final settlement. So if you don't agree with the split of the settlement, you can refuse to sign off. Unfortunately, the injured party usually gets less than they thought they would, but you have some leverage, and I hope you do OK.

    How do you handle those injuries? It's hard for me to get out of bed nowadays. I feel weak. I mean I could get through a whole day if i force myself. I work at the club 2x a week for 4 hrs each day and I feel pain and fatigue. I was seen by my family doctor and they told me it's my muscles.

    I lay off of overexertion. I have bone spurs on my vertabrae where my ribcage hyperextended from slamming into the steering wheel. The damage to the muscle apparently caused the vertabrae to grow spurs ...for some reason.

    The nerve pain acts up if I lift in certain ways (like heavy trays of food or too-heavy weight.) I just chill out & find a different way to do what I'm trying to do.

    Honestly my experience is pretty unique & is only an issue because I think like Johnny Knoxville on "JackAss" (The mentality of "hold my beer while I do this.") Improper lifting, lack of medical care & ignorance can turn a minor issue into a permanent one.

    My advice, go to the doctor, go to the right specialists, and get a professional opinion. & Maybe skip team sports for a while.

    I really don't know anything about this. (Hugs) keep us updated.

    If it effects your job it's worth researching to make sure you have enough money to support yourself.
