I think you can still apply after the deadline up until January. But your coverage wouldn't start until February. And Don't worry, you won't have to pay a fine next year for not having it for one month.

You can surely do that. Every person licensed to sell financial products is regulated; however what likely happened is he or she couldn't find adequate/ affordable coverage and could not be bothered enough to be professional and call back with the bad news. It is not tactful, and unprofessional for sure but not necessarily a violation of their responsibilities or duties as a lic. agent. Sucking at your job and negligence aren't the same thing and filing complaints won't get her coverage. Open enrollment is still going on though. I looked today myself.
