*if this is best fit for another place, feel free to move!*
I'm asking these questions because I'm genuinely curious!

    1. How do porn and similar sites avoid "obscenity" lawsuits? Is it something in their terms and conditions?
1b. Similar to the above, how do BDSM type sites (like Fetlife and Collarspace) avoid "obscenity" lawsuits?

    2. What is the "best" age restriction to have on a site? I know numerous pornographic and similar websites have an age minimum of eighteen because that's the minimum age of majority for most spaces (both within the USA and outside of the USA). Would a website theoretically have a harder time if this age minimum was lifted to 21+? (I've seen very few "adult" type websites with an age restriction as high as 21+).

Hi. Porn sites avoid obscenity lawsuits because of jurisdiction issues. It is difficult for a party to bring a lawsuit unless they can prove harm and locate the defendant. Do you sue the host or the content creator? And how will the lawsuit benefit your constituents?

18 is the legal age, if you want 21+ how will you enforce it? The tubes don't even enforce 18.

The content on porn sites is dictated much less by laws & more by the credit card companies. The more money the site makes, the less the credit card companies ride them about following the rules. However, the obscenity laws in the UK have prompted the shut down of certain sites & removal of content from others. Sites are, one by one, cracking down on rule-breaking, likely as a result of the credit card companies. Fetlife recently deleted a ton of groups & photos due to pressure from their merchant who then removed their payment processing anyway.

Hi, I'm not an expert, but a DMCA and 2257 on the main page is a good start. Some people also insert a pop up that requires you to declare you are of legal age (UK mostly).
There are lots of online discussions solely dedicated and composed of industry people assisting each other with compliance questions, I highly recommend to check those too.
As for a credit card companies' Armageddon conspiracy to smash the industry, I have not seen too much evidence to support that on my end. I hope it helps.
