Our club has 3 managers. 2 of them are okay. One sucks. Im not sure what the deal is but he has refused to let many of the girls at the club work. He has weekday evenings and is the goto guy when none of the other managers want to work ie. Halloweeen Xmas NYE etc. Guess which night I just found out this guys managing? NYE!
So the problem Im having is, well besides having lost $20k over the course of the last 9 months to this guy,
Our club has ONE contract. a single page pile of YOU CANT SUE and ITS ALL ON THE DANCER.
We do not have separate day and night contracts and really dont have a separate day and night shift as we only open days, sometimes.
I pulled my contract and am going to transcribe the last clause here for discussion
5} The Dancer Acknowledges that she is not economically dependent upon (insert company name) because;
a)she can work at other clubs; and can work when she wants (this is the part I am actually questioning as it seems to say that I can work THERE whenever I want)
b)she can control her own profits and losses by the amount of work done, and by her own marketing efforts which will yield her additional income/profile
c)she can wear what she wants
d)she can have tattoos and/or piercings exposed and uncovered and
e) she is in business for herself.
Am I crazy or is this manager violating MY and all the other dancers contracts if he refuses us the ability to
"work when she wants" and to "control her own profits and losses by the amount of work done"
has anyone here ever dealt with this sort of thing successfully without getting fired and/or blacklisted around town? What do you think the best approach is?
A) ask a decent manager to explain how this shitty managers actions arent a contract violation
B} ask the shitty manager to explain how he is not violating our contracts when he refuses to let me work
C) Ask for a meeting with the owner and the manager to discuss the matter
D) Lawyer? The contract forces arbitration but I think you can still have your own lawyer for that
E) suck it up, keep earning half what I can, go broke, leave town, never dance again
I know there is no cut and dry answer but I am hoping that maybe one of you has some insight or advice.
