    Default Can a day/weekday manager stop me from working? Contract quote inside....

    Our club has 3 managers. 2 of them are okay. One sucks. Im not sure what the deal is but he has refused to let many of the girls at the club work. He has weekday evenings and is the goto guy when none of the other managers want to work ie. Halloweeen Xmas NYE etc. Guess which night I just found out this guys managing? NYE!

    So the problem Im having is, well besides having lost $20k over the course of the last 9 months to this guy,
    Our club has ONE contract. a single page pile of YOU CANT SUE and ITS ALL ON THE DANCER.
    We do not have separate day and night contracts and really dont have a separate day and night shift as we only open days, sometimes.

    I pulled my contract and am going to transcribe the last clause here for discussion

    5} The Dancer Acknowledges that she is not economically dependent upon (insert company name) because;

    a)she can work at other clubs; and can work when she wants (this is the part I am actually questioning as it seems to say that I can work THERE whenever I want)
    b)she can control her own profits and losses by the amount of work done, and by her own marketing efforts which will yield her additional income/profile
    c)she can wear what she wants
    d)she can have tattoos and/or piercings exposed and uncovered and
    e) she is in business for herself.

    Am I crazy or is this manager violating MY and all the other dancers contracts if he refuses us the ability to
    "work when she wants" and to "control her own profits and losses by the amount of work done"

    has anyone here ever dealt with this sort of thing successfully without getting fired and/or blacklisted around town? What do you think the best approach is?

    A) ask a decent manager to explain how this shitty managers actions arent a contract violation
    B} ask the shitty manager to explain how he is not violating our contracts when he refuses to let me work
    C) Ask for a meeting with the owner and the manager to discuss the matter
    D) Lawyer? The contract forces arbitration but I think you can still have your own lawyer for that
    E) suck it up, keep earning half what I can, go broke, leave town, never dance again

    I know there is no cut and dry answer but I am hoping that maybe one of you has some insight or advice.

    Unless you have back up at another club from my experience that contract doesn’t mean anything unless you want to get a lawyer involved- legal aid is helpful. Also, some law schools may take your case pro bono. If you have other places to work maybe try to talk to him. Most the time I have brought up my “rights” to an asshole manager he starts talking about how “full the list is and how he doesn’t need me because the roster is full” The legalese way of saying, “you don’t have a job if you start threatening me with lawsuits.”

    At the very least document his “illegal” behavior in case there is ever a class action suit.

    A lawsuit would be costly and time consuming. Honestly it’d be better just to find another club. You never know, u might just make a ton more

    This is a reason for making certain you have a back-up club and a back-up plan outside of this very ugly industry. And even so, if you start the process of a lawsuit I would be afraid that's on a record that anyone can check and you may be backballed from other clubs and possible other establishments because of this. And I would make sure I'm cool with the general manager or hiring manager/s so I don't get fired or can ask for my job back.

    Also there may be an issue when management changes.

    Amen. Some, well most in my personal experience, strip Club managers are like bad boyfriends. Once they feel comfortable enough and know your ass has no where to go they show their true colors. I think it’s good to switch clubs and jobs, so they don’t ever get too comfortable. Yep, don’t ever let these fuckers have the upper hand.

    Frankly he can do whatever he wants. You can quit if you want or deal with him.

    Technically he is violating the IC bit but realistically are you going to spend several grand on a lawyer? Doubtful.

    I also had one awful manager who was always looking for fault in me to deactivate my working account and expected a tip to re-activate. I spoke to the other hiring manager or general manager about this and it seems they don't like to step on other managers toes. So the only other option is to deal with him.

    It got too much for me. I got too tired, of the shit. Especially when I got to barely making anything and the customers got worst. It wasn't worth it.

    This is the weirdest "IC contract" I have ever read. The language used tells me they don't take what is in it very seriously.
    I have questions:
    1. How did you loose 20k off him?
    2. Why are you still at this club?

    What can you do?
    1. Find another place to work
    2. Contact your state's attorney general and ask about filing a complaint about how that club is treating its contractors as employees. Or talk to another manager/owner to resolve the issue...

    If they won’t let you work certain days, my guess is that by putting up a fuss they will have no problem saying you can’t work ever, aka firing you.

    Go find another club before you are out of a job.
