    Wow!

    Pornography depicting a number of previously banned sex acts has been made legal in the UK after a review of obscenity laws.

    Essentially, sex acts that are not illegal in another context can now be shown in pornography.

    Certain types of violent porn are now permitted so long as the sex acts are consensual (focusing on ‘full and freely exercised consent’,) do not cause serious harm to participants, are not ‘inextricably linked with other criminality’ and are not likely to be viewed by anyone under the age of 18.

    Obscenity lawyer Myles Jackman, who has campaigned for these changes for a number of years, told Yahoo News UK that the change had wider implications for the law.

    He said: “It is a very impressive that they’ve introduced the idea of full and freely exercised consent in the law.

    “Even for people with no interest in pornography this is very important for consent and bodily autonomy.”

    Activist and queer porn filmmaker Pandora Blake, who also campaigned to have the ban on the depiction of certain sex acts overturned, called the news a ‘welcome improvement’.

    They said: “This is a happy day for queer, feminist and fetish porn.”

    Acts that were banned that can now be depicted include:

    Spanking
    BDSM
    Female ejaculation
    Urinating (also known as watersports)
    Strangling
    Face-sitting
    Fisting
    Humiliation

    In 2014 laws were altered to ban pornography created in the UK from showing certain sex acts, sparking accusations of censorship particularly targeting female pleasure.

    The laws also failed to distinguish between consensual and non-consensual acts, particularly when force or humiliation were involved.

    UK viewers could still view pornography of this type created elsewhere in the world.

    When the ban was brought in, Mr Jackman said: “Pornography is the canary in the coalmine of free speech: it is the first freedom to die. If this assault on liberty is allowed to go unchallenged, other freedoms will fall as a consequence.

    “This declaration of State censorship will affect millions of consenting adults who choose to view British pornography; impose an unnecessary trade barrier, which has already caused independent UK producers to shut down; result in a significant loss of revenue to The Treasury; is practically unworkable as it can be circumvented by proxy servers; and has implications for all forms of freedom of expression on the internet.

    “Of particular concern in terms of loss of freedom is the underlying intent to allow undesirable foreign websites to be blocked under UK ISP’s filtering systems. This has immeasurable implications on freedom of information and net neutrality.”

    Guidelines about what constitutes "obscene" pornography have been relaxed in England and Wales.

    The Crown Prosecution Service had previously listed torture and bondage, among other acts, as obscene.

    Distributing that type of pornography either on or offline could therefore have led to a prosecution.

    But the CPS has now removed the list and replaced it with series of "tests" that determine whether an image or video is classed as obscene.
    What has changed?

    Owning or distributing an "obscene" video is an offence under the Obscene Publications Act.

    Some of the acts previously listed by the CPS were legal to perform with a consenting adult, but were illegal to depict in photos or videos.

    "Distributing" obscene material can simply mean sending a video via private message and it can be punished with time in prison.

    While the definition of obscene is likely to mean more than just "shocking" or "disgusting", it is open to interpretation.

    For that reason, the CPS previously offered guidance that described the sort of content that could lead to a prosecution.

    The list included clearly illegal acts, such as having sex with an animal (bestiality).

    However, it also listed practices that others argued were not harmful among consenting adults, such as:

    sadomasochism
    torture with instruments
    bondage
    activities involving "perversion", such as urinating or defecating on to the body

    Now, the CPS has removed all the specific examples from its guidance.

    "It is not for the CPS to decide what is considered good taste or objectionable," it said in a statement.
    A new test

    Instead of a list of forbidden acts, the new guidance says owning or producing pornographic material is unlikely to be prosecuted if:

    it features consenting adults, where the provision of consent is made clear where consent may not be easily determined from the material itself
    no serious harm is caused, whether physical or otherwise
    it is not otherwise linked with other criminality
    the likely audience is not under 18

    The CPS said it would "continue to robustly apply the law to anything which crosses the line into criminal conduct and serious harm".

    Lawyer Myles Jackman, who fought for the change, told BBC News: "I have campaigned for this important change to the English criminal law, which has a profound impact for free speech and privacy... for over 10 years."
    Professional pornography

    The Audiovisual Media Services Regulations, introduced in 2014, mean professional pornography sold online falls under the R18 rating given by the British Board of Film Classification (BBFC).

    The BBFC's guidelines forbid "material judged to be obscene under the current interpretation of the Obscene Publications Act".

    The BBFC has not yet told the BBC whether it plans to change its guidelines.

    Wonder where "period play" falls... I am assuming it's still going to be considered as obscene as hardsports and vomit

    OOooh I see, they've taken defacation etc onto a body off the examples list... this looks promising. I cross fingers.

    Videos do fall under that umbrella. Live cam cannot as it is not and never will be 'wholly automated', rather it is on the same level as online teaching where a provider interacts directly with the consumer live.

    I expect whether you're causing ABH or even GBH, actual/grievous bodily harm. "Minor cuts and bruises or a brief loss of consciousness would be considered as ABH but most often requires slightly more serious injuries such as broken teeth or extensive cuts and bruising."

    All my content is solo verbal humiliation, is this now ok to do?

    Also do you know where the law stands with creating solo content that is incest roleplay i.e brother and sister/mommy role play?
    As I know this wasn't allowed either

    If it's solo the issue of consent doesn't arise...you're not physically doing anything to anyone else.

    I understood that taboo role plays aren't illegal, it's just that some sites won't allow them because their payment processors won't agree to their services being used for those type of clips.
