    Default Big apt. management co. can deny for SC arrest

    A dancer friend of mine from Orlando wanted to move to Tampa and was looking at some area complexes. She brought over the info to ask me about the best area to live and I was flipping through all the info and read something in the lease approval polices I found interesting.
    They have a section that talks about criminal history and it included both misdemeanor and felony sex related crimes. That means that if you've been arrested in a strip club and charged with indecent exposure, illegal contact, prostitution etc ,etc you can be refused an apartment.
    I was taken aback by this considering that I have could not rent an apartment with this corp. ( they run tons of complexes) since I was charged with an exposure crime because my pasties were ever so slightly too small, as were 30+ dancers and I know of dozens more who were charged with lewdness. God am I glad I own my own home ! But I wonder how many dancers will have trouble getting apartments? Yet another reprocussion of anti strip club ordinances

    By the way- the company is Camden. I don't know if the are a local or national but they run a dozen or so middle to high end apartment complexes in the Tampa area.

    I work as an apartment locator in Texas and Camden is a nation wide company.

    Most major management companies have rental criteria that is consistant with what you read. Most will approve your application if you have a misdemeanor that is not a crime against a person or property or a sex crime.

    I've actually had a complex turn down one of my customers for working in a strip club. She even told them she was not a dancer but they turned her down anyway. (we found her a better place)

    So, yes this can happen and probably does quite a bit. I have also seen, on many an occasion, that complexes will relax their "rules" when their occupancy is getting low. A good apartment locator should know which properties to apply to. In Texas, apartment locators are a free service. I believe you pay for the service in Florida, however.

    I understand the sex crime part but lumping in pedophiles and rapists with a girl with a pastie/bottoms charge...... Wow is all i can say.

    Yeah I know right.... that is the problem with these ordinance arrests they look the same on paper as say a flasher for instance.

    And I read in that area of the policy that new residents should keep in mind that there may be some people living there that were approved prior to the policy- so basically a man who has been convicted of rape can stay living there, but a new applicant who was arrested for being 6 inches too close during a table dance can be denied.

    You're absolutely right, that is F'cked up. Usually, though, when a complex changes it's policy on something like this -- they simply refuse to renew the lease of the person that was living there with a conviction. Of course he/she is getting to live there until their lease expires.

    How can it be legal to deny someone because of occupation,I think she could have a law suit for that, they cant deny you based on color or creed,or what you do for a living,the offence part yes ,but that I dont think so.

    This is an unfortunate reality of the business. I have had this happen to clients as well. In Las Vegas, I have had companies turn down applications because the owner has a specific breed of dog. (Apparently, Pit Bulls and Rottweilers have bad reputations here in the wild west, something I found out the hard way when I moved to Las Vegas). Here's how they make it legal; they require the same application of every person who wants to rent, they run the same checks on every person, charge the same fees to every person and have pre-determined criteria that would make a person ineligible. They wouldn't get dinged for fair housing violations if they treated every applicant the same accross the board and kept paperwork to support that fact. So is it legal? Yes. Is it fair? That depends on who you talk to...
