    Default Club Contract - Deja Vu

    I just auditioned for Deja Vu and they told me to start tomorrow. They told me I would sign a contract when I start my shift tomorrow. I have never been asked to sign a contract before and never worked for Deja Vu..is this normal? What does the contract state? Does it state how many shifts you must work etc.

    Any info is greatly appreciated

    I don't have a copy of my old Deja Vu contract handy, but I recall that it made very clear that I was an IC and not covered by workers compensation insurance. It also said I was responsible for my own taxes. The contract also spelled out dance prices, my share, the tip out and all the fines. It also said that I could be fired for violating any rules of the club, any clause in the contract and any instruction from the manager. It did not say what shifts I would work, but it did say what the shifts were, and that I'd comply with the schedule the manager set.

    I've always thought that their contract was too clever by half. If I'd been injured on the job, I think all the fines and rules probably made me an employee and under Kentucky law (where the club was located) I would have been eligable for workers comp.

    Check the fine print too ...

    Since Hustler and Deja Vu partnered up, I have heard that another provision of some dancers' contracts is that the dancer also executes the equivalent of a model release which allows Hustler/Deja Vu to use pictures taken of that dancer in print or on the internet in any way they choose without further payment to or further permission from the dancer.

    I have also heard that some dancer's contracts also include a non-competition clause. This clause can prevent a dancer from working in any other non-Deja Vu club in the same city for a period of 6 months after leaving Deja Vu (for whatever reason). While the club could legally bring a breach of contract lawsuit against the dancer if she did quit to start working at a competing club in the same city, in most cases it's not worth the club's legal effort to do it (because most dancers don't have a whole lot of assets to sue for!). However, if the dancer owns a house or have sizeable investments the possibility of a breach of contract lawsuit becomes more likely.

    i actually got caught at another club after signing a non compete clasue. i was so young and had no idea what that really meant. the other club didnt persue it but the new one wouldnt let me work it was a small area. so i had to move for i think it was 90 days!

    The DejaVu contracts state that you agree to work a set number of hours (usually 7 or per scheduled shift. It also states that you are required to pay your house fees per scheduled shift even if you call out. If you show up late or leave early you agree to pay a late fee, etc.

    Now, whether or not the management enforces the rules in the contract depends on the location. When I worked at Hustler in SF, the management was lenient on me because I opened the club on Day 1 and was a responsible worker. (I never no-showed, only called out twice, and was never a problem) Other locations are by the book, and if you don't show up for your shift, you still have to pay your stage fee.

    Since you sign this contract, they can legally enforce these ridiculous rules for independent contractors. If you don't sign, you can't work there. It's a catch-22.
