    Default Martha Guilty!

    And they think strippers are bad! Damn those evil caterers!

    So what do you think? Was Martha naive? Got the money but didn't know how to keep it? Did she deserve a guilty verdict? Should she go to prison?

    I think "stock tip" corruption happens all the time but Martha just got caught because she wasn't covering her ass.

    i highly doubt she will go to prison because of who she is. i think unethical practices are not uncommon in the stock market bizz- this is such a big deal because Martha is Miss Domestic Diva Goody Goody, and the public looooves watching her get slammed.

    i kind of feel bad for her.

    I'm pretty sure Martha also had a seat on the AMEX stock exchange at one point, so to say she understands how the markets work and what the rules are is an understatement. That's why I don't buy any of the claims that she "didn't know" what she was doing. That being said, I don't think they should have been pushing for the sentencing that they were-something like 4 times as much prison time as the enron / arthur anderson folks got!? It should at least be fair and on par with related offenses.

    I think she knows how the stock market works. I just don't think she knows how the real world works: black mail, extortion and covering her ass.

    The lead dude in Enron is looking at 150 years. That would most likely mean real prison (anything over 3 years) She's looking at 16 months in federal pen.

    There will be appeals right?

    She should surely have known that what she was upto was not legal, but as I understand it she is being convicted of trying to cover up what she had done, not stricltly for insider trading.

    I suspect that she will see some jail time, she is still proclaiming innocence, and saying she will appeal, but I wonder how much of that is an attempt to reduce the impact her conviction will have on her company?

    I often wonder when individuals get nailed for this sort of thing, is it just one example of many other instances of similar behaviour that werent caught? It certainly demonstrates a "character weakness"/tendency to respod to problems in a less than ethical way.

    I dont think she's guilty. I get stock tips on what stocks or companys that are not doing well, or might go under. Alot of people do that, I think they are making an example of her.

    She wasn't on trial for insider trading. The charges were obstruction of justice related. And, I doubt she'll do jail time. She was stupid. She should have just said "Oh, I made a mistake, here's the money back." That is a valid defense for insider trading, and the amount she made was trivial compared to her net worth. She got some terrible advice somewhere along the way and, shame on her, followed it instead of doing what was morally correct.

    If the facts as laid out are true(and I was not there to hear them all) Martha deserves to pay a 7 digit fine and do some time in the pokey.
    1. Trading on a known illegal stock tip is a significant crime and not some victimless crime. The broker should never have revealled that information and if he did the first thing Martha should have done is go straight to the SEC. She had been a licensed securities trader and was a member of the board of the New York stock exchange.
    2. She knew the law, she violated the law, she tried to cover it up.
    3. Theis gets to the third crime--she is the head of a company whose principle asset is her image/mystique. She destroyed that value and pursueded and tried to persued people with a lie that she had not. That stole from every stockholder by that act and again by making people make false decisions.
    4. She did not profit just 57,000 dollars she robbed her investors of hundreds of millions of value just as if she sold shares in her company based on its owning a Picasso, ripping it to shreds, then tells everyone it was in a safe deposit box. That is a direct violation of her fiduciary responsibility.

    Personal prediction -- $2.5 million fine and a year and a day---out in 4 mos. MathaStewart/Omni Media drops 50%-75% from current levels.

    Here's the thing that sucks: corruption is pretty much standard operating procedure in that world (The World?). Witness Tyco, Worldcom, Enron etc. It just seems that enforcement is arbitrary and capricious.

    That is the thing--its not. It does happen and the more complicated the fraud the longer it takes to unravel. Enron unravelled the same month as Martha Stewart sold her Imclone and cases are just hitting the courts.
    Tyco-Koslowski convicted of tax fraud on the original art thing. Indicted for 33 other crimes.
    Worldcom-Bernie Ebbers indicted/arrested this week.
    Enron -About 5 people indicted and about 3 convicted. Skilling indicted last month.

    Look at the number of companies listed on the stock page of the paper. Now compare 6 to 8 to that 10,000.

    Don't assume she was naive. Have you seen that woman in interviews? She is not a nice woman. She is extremly rude and patronising. She is too shrewd of a woman to have not known what was going on expecially with her money.

    Martha got shafted. A thousand blue collor people a day do what she did. This crap is ridiculous, there is one law, for everyone not one law for some people and one law for others.

    And I don't even LIKE Martha Stewart, she's a total bitch. I'll stick up for her on this, though.

    Well, I for one, love Martha. She is the McGyver (sp) of housekeeping. Inside trading goes on daily, and they're making such a big deal of this because she's who she is.

    I will say though, that I hope she doesn't get jail time. BUT, if she does, she'll have the prettiest cell in any jail!

    While I do somewhat feel sorry for Martha Stewart, it is my opinion that she should be punished exactly how any "ordinary" person would be if they pulled the same thing. Oh yea, Rhiannon, I too would love to see how she would fix up her cell. lol

    I agree about everything but liking Martha. She has a reputation for being a terrible bitch. Plus, Martha was never CHARGED with insider trading! She was charged with obstruction of justice but everyone THINKS she was up for insider trading. She's basically getting shafted with a crime she was never charged with.

    Doesn't matter. She's already lost 250 million dollars on this (on paper anyway). Jail can't be much worse than that. She might get a year or so, but the principal of the issue is very annoying. Whatever she is guilty of, and i'm sure she's guilty of something, she was found guilty of, and will be treated as being guilty of a crime, that she was never charged with!!!

    It is not unusual for a number of crimes to not include the original crime in the trial. To the crime of "insider trading" there are in fact only 2 witnesses--there were only 2 people on the phone and they were co-conspirators: Martha and her broker. To the crime of lying to federal authorities and obstruction of justice and the charges of manipulating her own stock there are dozens of witneses.

    This is the same as getting Al Capone for tax evasion rather than liquor smuggling or getting Richard Nixon almost impeached for the Watergate cover-up rather than the original burglary.

    Yeah, difference is that Al actually evaded taxes. Tricky Dick actually did watergate. Martha did what anyone would have done. If she goes to jail, how many others should join her?

    I don't like Martha, but i'll defend her to the death.
