    Default I need a Certified Public Accountant!

    I have recently been made aware of the fact that my 2002 taxes were not filed. I was an entertainer during this year. I would like some advice on an accountant in the Houston Texas area that can help me with deductions for, hair, nails, make-up and mileage. If anyone can help me I would appreciate it.

    I'll try to help you but to do so I need to ask a few additional questions ...

    #1 - were you married for any part of 2002 ? If so did your husband file a tax return in 2002 ?

    #2 - did you receive a 1099 form from your club in Jan-Feb 2003 ?

    #3 - is/was your club involved in a battle of wits with local government, or owned by a group who has been the subject of Federal attention (like the Galardi's) ?

    #4 - did you keep records of the nights that you worked in 2002 and the amounts that you earned ?

    #5 - did you dance in 2001 ? If so do you have records of the nights you worked and your earnings ?

    #6 - did you just buy something expensive, like a new car ?

    #7 - did you just receive something worth a lot of money, like your ex-husband's retirement fund ?

    #8 - is your ex-husband the type that would turn you in to the IRS hotline ?

    If you've received notification from the IRS that you failed to file a tax return in 2002, this would definitely tend to indicate that the IRS has received info from some source or another that you in fact had earnings in 2002. This may be related to your dancing income, but then again it may not. It's really important to try and figure out what's behind this first to know how to approach it best. You may be in need of a tax lawyer more than an accountant !

    Willful failure to file a tax return constitutes tax evasion, and if the IRS has proof of your 2002 income you could potentially be in deep shit if you didn't report any of it. Also, if the IRS gets rolling, standard procedure would call for your 2001, 2002 and 2003 tax returns to all be audited. Therefore if you had 2001 and/or 2003 income from the same source that the IRS has apparently been informed about in regard to 2002 income, your problem may be three times bigger than originally thought.

    Hopefully you can "play dumb" and plead ignorance of the fact that your 2002 tax return wasn't filed ... "honest, Mr. Auditor, my husband took care of all of that stuff!" ... and you can skate by with an accountant preparing a belated 2002 tax return. However, if your "ex" is the cause of this IRS attention, or if the IRS has obtained financial records from your club, that approach is not going to work and you should start looking for a tax attorney.


    Also, hair and nail salons and department store makeup are NOT allowable business expense deductions, because the don't pass the "housewife test". The IRS takes the position that anything that a housewife would spend money on without a business reason can't have a business justification and therefore is not a legitimate business expense deduction. This is negotiable to some small degree when a normal tax return is audited. However, if you've made it onto the IRS hit list as a willful non-filer/tax evader, they're probably not going to be in an accomodating mood for negotiating.
