    Default Just a question

The club I work at pays us hourly, so at tax time next year, will I be able to write off the cost of my make-up, gowns, dresses, shoes, and transportation to the club?

Also, some of the girls at the club said that they get a paycheck every week AND are 1099. How is that possible?

    Thanks!

It's NOT possible by the letter of US tax law. Case 1 these dancers are considered to be "tipped" employees, in which case the weekly check they receive is a paycheck (which should have income taxes withheld), thus their yearly total income is reported by W2. For "tipped employees", dresses, gowns and shoes are deductible as an employee business expense provided that they are too extreme to be worn in public. Transportation and department store makeup are NOT tax deductible for employees.

Case 2 is that these dancers are independent contractors, in which case the check they receive every week would have to be considered a "draw against commission" i.e. the club making each 'saleswoman' a short term loan which is paid back via the club receiving a percentage of the private dances each 'saleswoman' sells. In this case no taxes would be withheld from the check and the total amount of check payments would be reported via 1099. As independent contractors, everything you mentioned would be deductible as a business expense except department store makeup.
