    maybe so, but these two cases filed in the last 2 weeks involving tens of thousands of dollars, involving the CFO of the US division of a huge worldwide financial services corp etc. are getting some serious attention. Scores American Express merchant account has already been frozen, meaning they can no longer process customer charges against AmEx cards. This could happen to other Manhattan clubs very easily as well, because something that DOES carry weight in the real world is a major corporation like AmEx having to eat financial losses and being portrayed in an unfavorable light in the national news media. AmEx could very easily simply reclassify strip clubs as high risk 'adult businesses' and cancel merchant accounts across the board to avoid future incidents like these.

    These lawsuits IMHO, in conjunction with the new Manhattan city councilwoman (who has an axe to grind against strip clubs in her district) may have planted the seeds of big trouble for all Manhattan clubs.

    A few clubs here in dallas have limits on how much you can tip, spend, etc.. on your CC. They take your license and require you to sign a document noting you had read the rules before opening a tab.

    It comes down to personal responsibility. I feel that it is not right to hold other people responsible for someone's inebriated decisions. Bars are around to serve liqour and make money (SC, too). If someone cannot make a decision to quit drinking on their own, then they need to accept the consequences of those decisions.

    Yes, NY law does place some responsibility on the licensed establishment to control the serving of liquor to customers, and can find the licensed establishment guilty of wrongdoing if the customer should, for example, cause an auto accident while driving home drunk. How this law might be applied to this AmEx situation has no specific legal precedent, but there is precedent of being found guilty of wrongdoing.

    Actually, this does not have to go all the way through the courts to have an effect on the parties involved. To cover its own butt, after the second Scores overcharges lawsuit was filed AmEx froze Scores AmEx merchant account meaning that they can no longer process customer American Express charges. AmEx could also decide to do this to all NYC strip clubs, or for that matter all strip clubs no matter where they are located, to pre-empt future problems. This would be the 'kiss of death' for super upscale show clubs which primarily depend on corporate AmEx card charges for their high rolling customers. After all, no sane customer is going to carry more than a couple of grand in cash into a club. Also, MasterCard and Visa already have policies in place which require the verbal approval of the customer via phone call if a 'high risk' charge for a significant amount of money (like over $1000) is attempted - I can just envision the club manager calling the customer to the phone to talk to the security desk at MC or Visa before approving the charge and then letting the customer go to the champagne room !
