    Default music fee?

    ok on celebrity justice (cj- i think it's a rerun) it was talking about how some club i think called diamond dolls was being sued for playing music without covering a fee? is that a rule? is it because clubs are public facilities? cause that sounds really weird... ???

    Yeah its a rule...most clubs have an A.S.C.A.P liscens which is wha you need. Its not an overy enforced thing but, technicaly you need one. You know...Interpol copyright and such.

    but like if you had a party at your house obviuosly you wouldn't have to pay a cover charge for music... so it only applies to licenced public places?

    Exactly. In this particular case, it was a BMI license that wasn't paid up. If you own a public venue where you are charging customers in some capacity to be there as a place of business, you have to pay for these licenses. This pays for the right to be able to compensate the recording producers and performers for music that is paid for in a public place.

    Any business that uses the public performance of music (whether live or recorded) is supposed to have ASCAP and BMI licenses, and you would be surprised at the list of things that require them. Pretty much any recorded song is covered by one license or the other. See below for details:

    In the case of a nightclub, what they are charged for these licenses will depend on the size of their club, the amount of their cover charge, etc.

    My sister called and told me to turn it on because the club is located 20 minutes from were we live.too funny.I wasnt aware of such a thing either until I saw the segement.Thanks anala, I was going to start the same topic and find out know my questions answered.
