    Actually, regarding the legality or lack thereof of whether or not the picture taker needs a release- I have my own website, so, at least in my case, it's airtight that it's illegal since they did not acquire my permission to release it anywhere- not whether or not they plan to have any monetary gain or not.

    Taking picture's inside a strip club without permission from the subject is indeed illegal. If a person is caught taking a picture and the equipment confiscated with the picture on it for proof, you can call the police and have the person who's picture was taken, press charge's against the customer. By law you are granted a reasonable amount of privacy, as in you wouldn't get nekkid on a stage set up in the park on a sunday afternoon infront of god and everyone. You only do it in a controlled enviroment where you know only the patron's will see. Any picture's taken without your consent, permission or knowledge are a violation of your privacy. On the other hand what you do with the photo equipment is a gray area as in If you smash it then you are in violation of distruction of property. It's a mess with these gadgit's and it's only going to get worse as technology improve's.

    I was on stage last night and a guy had his phone just sitting on the ledge (about 8 inches lower than the stage. It was closed and his hands were up on the tip rail but a bouncer walked over, picked it up without saying anything and walked away. The guy was totally confused until I told him about camera phones and he understood.. I told him he can get it when he leaves. Phones are NOT allowed in our club AT ALL. Bouncers will take them if they see them and hold them up front until you leave.

    Some of you'all might think this is mean but in my club if someone gets caught with cam phone taking pics it will get taken and erased or broke the dj tells them all nite long so its their bad, no one has called cops over it yet but im sure it will happen sooner or later but i honestly believe the cops that work our llittle area prob wont side with the custy.We only have about five different officers that come to our area and they know our girls pretty well.

    ^^^ In regard to that (I didn't want to quote it when it is right above this):

    Is it still theft if it is clearly stated that items of that nature are NOT allowed insided the building? Everywhere I have been has a sign right next to the front door, clearly saying camera phones are not allowed.
    It seems to me that taking something prohibited makes you lose your right to have it. Like taking scissors through airport security, no?

    I thought I had a pretty decent camera phone but if you take a pic or video in a club it doesn't come out well. I've never tried to pull it out in a strip club. I thought it was just known you don't take pics in there.

    The difference in the scenario you paint with the airport and the scissors is that the person taking them is acting as an agent of government, with powers granted specifically for that purpose. Where, in the club scenario with the camera, the person doing the taking is a private citizen with no such special powers under the law.

    All the club staff or management can do is ask them to give it up or leave. They can't seize anything. They don't have the authority to do so.
    Ah, ok. That's all I was looking for.

    I myself have never seen a phone fiasco like the ones mentioned above, bouncers just make people leave them at the front door or take it to their cars.
