    Default I fell need legal help!!!

    I went shopping last night and fell on some glass and ended up cutting my bum and back up on some glass. I called a bunch of lawyers and only one called and said they would see me right away. They said they charge 40% percent because these cases are so hard to prove. Thing about this case is that the stock boy knew about the glass and there was no hazardous sign put up. I had to go to the hospital last and get dermo stiches. The lawyers are coming tommorow is a 40% a good cut for slip and fall. I only pay if they win. But they are one of those TV commeracial attorney's but I need one before this thing heals.

    And get copies of the medical forms. And call a local lawyer who deals in small torts (beyond just a tv advertiser) and compare deals offered. Someone is paying for the TV ads, don't let it be you. I may be wrong but I thought the standard was a third, not 40% but that could vary by state.

    Yeah, depending on what state you live in...don't sign anything right away...take the contract and tell them that you will have to look it over and get back to them. make them leave the contract. Then, call around and get a gander at some other contracts. Then make your decision. It seems to me that the fee is as monty said...about 20-30%.

    Also, if there were witnesses, make sure you get their version in writing, there full name, address, telephone number...and give the info to police so that they can put all of this in the report. And, yes, get plenty of pictures and video...save everything!!

    The usual cut for trial lawyers is 1/3rd. However, if no other local attorney is willing to accept your case on contingency, 40% of something is better than 100% of nothing. You also have the option of paying a trial lawyer to bring suit versus having him work on a contingency percentage, but then of course if you lose your suit you'll also be out the legal fee.

    A big factor in any settlement will be the value of "lost work". Thus it does matter whether or not you have self-kept and official income tax records of your past earnings to prove how much money you're missing out on earning because of your injuries. On the flip side, if you don't have these sort of records you face the choice of claiming to be an unemployed student or something (which will reduce your settlement), or attempting to claim that you have been earning very decent money as a dancer (which will increase your settlement) but also risking that the defense will refer the matter to the IRS. If it's the latter, you may actually wind up paying out more in back taxes than you receive from the settlement !

    With or without tax records, if you let it be known that you are a dancer or if the defense independently discovers that you are a dancer, then it IS possible that the defense attorneys will attempt to cash in on the "Hollywood Stereotype". One way they might do this is to claim that you were under the influence of drugs or alcohol at the time of your fall, arguing that you yourself are at least partially responsible if not wholely responsible for your own injury. If you don't have hard evidence like a blood test proving that you were NOT under the influence (i.e. taken by the hospital at the time you got stitched up), it then becomes a "word of a dancer" situation whether or not a jury of housewives, civil servants etc. will believe what you say versus what the defense attorneys say.

    It's very difficult for dancers to get a fair shake from most juries. Did you tell the prospective attorneys that you are a dancer ? If so, this may explain why only one guy was willing to take your case on contingency.

    Seems to me it's necessary to get certain things in order....

    First thing is to get medical asessment and help with the medical people knowing you work in a profession where skin appearance and physical dexterity are paramount. Pictures of your condition (use a macro lens) and of the store location is important. Might be good to use real film and KEEP the negatives safe.

    Tell the store manager that you have medical bills, not all work is complete and perhaps physical therapy. Further, you might be out of work awhile, and you expect them to help with ALL of these direct costs. Do not mention pain and suffering, or the words liability and lawyers, just your medical needs and lost work time. Say you will keep in touch with them as things progress. This part you can prove if the medical assessment is thorough enough and written up well. That review part is where I'd get a lawyer involved now, probably at your cost. Just for backup and insurance.

    You are more likely to get the store's liability policy to kick in YEARS faster than their bank of lawyers. If you cause the store manager to fear that some multi-million dollar nightmare will be coming along, you will very quickly get stonewalled. Then you will have no choice but hire a set of lawyers to breathe their hot air down their necks for a few years, while the hospital is breathing down yours for their payment.

    Staying away from lawyers (as with the police) generally is a good thing. But there are times when they can help you.

    If the store denies any responsibility or stonewalls your medical and other proveable costs or if there are complications, then hire a team. Good luck.

    Probably way too late in this case but, for future reference: NO, NO, NO!!! There's a fairly good chance you screwing yourself by presenting to a medical provider of any kind for anything other than emergency medical treatment before you've retained a PI attorney. He/She will direct you to the doctors you need to see - they're known as "Plaintiff's Whore Doctors", and their assessments/write-ups, etc. will almost always provide you with much, much stronger evidence in your favor - as will their deposition testimony when the time comes. Remember, when you file a PI case, your medical records - ALL of your medical records - become fair game, and the defense attorneys will most certainly request records from every medical provider you've seen since you sustained the complained-of injury. And if there's an "assessment," CLOSER in time to the date the injury was sustained and PRIOR to the date you engaged an attorney, EVERYBODY in the game understands that, despite the rules, etc., it's the only "real" assessment... and more often than not, THAT will wind up costing you.
