    Default Theft Charges

    Don't have a lot of time to get into this now but... does anyone know what it means to be charged with an over $500 theft charge felony? I don't know if it differs in each state or what... I'm trying to look it up on the internet right now - but if anyone knows any info that's be great! Thanks.

    You're right that this varies from state to state. However, if your statement of felony charges is correct, then this is nothing to mess around with. First I would take a wild guess that bail will wind up being set at $5,000+ depending on the person's criminal record, job, commitment to the community etc. I would then guess that legal fees for a criminal attorney will start at somewhere around $2,500 and go up from there depending on how involved the case will be. I would also guess that the potential sentence if found guilty will be a year or more in state prison.

    Great - that's just fabulous! My b/f was pulled over for speeding on friday and was arrested for a warrent from 2001. Before he joined the military (late 2001) he tried to find out if he had any warrents but nothing came up. He got arrested while we were in Hawaii and nothing came up either!

    Well I guess it's classified as over $500 felony theft. He's got a bail hearing today. We are hoping he's either released or the bail is lowered. Right now it's at $50,000 which translates to $2500 through a bailsbond person!

    Sometimes people really disappoint me with their actions. I don't know what I'm going to do if he goes to jail!!!! I can't be away from him for that long! Plus - what am I gonna tell my father - my b/f is out of town for a year or more! OMG!!!!! Please pray for me guys! His hearings in 3 hours so I've gotta run and figure out where the hell the court is at!

    If you hear about some psycho lady strangling a judge - it was probably me - just kidding!

    Why is he getting arrested so often?
    Why does he not know if there are warrants against him?
    Why do these not seem to be the issue?

    You shouldnt strangle the judge, you should strangle your boyfriend.

    Anyway...i hope it works out best for the both of you

    If its his first offense...which is doesnt seem like it is...he probably wont face jail time....if its his 3rd or 4th offense...then yes he probably will.

    Calm down... and go find a good lawyer. Do your homework first, though. At this stage, you nbeed what's known as a "fixer," i.e., someone who used to work in the DA's office but left to do criminal defense, and is on very good terms with many, if not all of the ADA's. Barring some glaring glitch in their case which, obviously, he/she may try to exploit first, the most important thing at this point is for you to get somebody who can persuade the DA to reduce it to a misdemeanor.

    It will most likeely be reduced to a misdemeanor-depending...
    Anything over $1,000 is a felony where I come from.
    Prepare to make restitution and pay a fine, etc.

    Something just doesn't make sense here. There's something in the story that just seems "off". I dunno...I used to work at a lawyers office and I've seen this stuff all of the time. I find it really hard to believe that your boyfriend wouldn't "know" that he has an outstanding warrant.

    Other than that...you need to get the full story of what happened and follow Gn's advice. Laws, et al, are different state to state. Since your boyfriend was hit with a $50,000 bond...wouldn't it be $5,000 through bailbond? I thought the deal was 10%, cash, up-front to make bail. Either way...you're gonna need a lawyer. Unless you want to use the "free" lawyers--which I would never advise doing...they are over-worked and underpaid to make an effective lawyer.

    Anyways...just my 2 cents.
