    Default warrant for my arrest

    There is a warrant for my arrest out. I received the one page sheet of paper in the mail at my birth parents house. As I have learned from other girls here what the police have been doing is not sending out a ticket. They just move it strait to warrant status. Is this legal???
    It is a violation on the no touch rule so it is a misdemeanor. But now I have to go turn my self in! Which means I will be in jail for 8 to 10 hours while they process me. I have never been to jail before!! I have never had more than a traffic ticket!!
    I have a lawyer. But after he told me yesterday that I should think about doing something else. and "You are beutiful and smart you could get a job somewhere else." I hate people who over simplify things. I need this job to pay my bills. Living is expensive, and money affords opportunity.
    The part that I find most disturbing is that on the bottom of the letter I received it says "Homeland Security and Special Operations". I did not realize that the strippers in Dallas are actually the terrorists.

    I had a warrant for my arrest once. I'd been sent a fine and was out of town, so didn't pay it, so they issued a warrant for my arrest. Of course, I was out of town, so they couldn't arrest me. I got home and there were all these constable cards taped all over my door with notes about how I should turn myself in. Um, DUH, I wasn't HERE.

    Anyways, I just drove away from my house and called the magistrates office and negotiated a price to not arrest me, and then brought them the money in cash. Good thing I had it.

    Do you have any dancer friends who may be able to suggest a less judgmental lawyer?
    Then again, you might need to accept the annoying possibility that your current lawyer's attitude about stripping is consistent with the judge's attitude about stripping.
    Maybe you should play into the whole stereotype of being"too beautiful/ smart/ good" for the place. If the judge believes that you have seen the error of your ways (you Jezebel, you!) and that you view this ticketing as a wakeup call to, oh, I don't know, get a clean job as a checker at Walmart, maybe he will be more lenient.

    It is stupid to have to play up to this attitude, but the courtroom that may brand you a registered sex offender is not the forum to seek any converts to your way of thinking. The most important thing is to get out of there with as little on your record as possible.

    I hope I am wrong about the possibility of you recieving reg. sex offender status. Maybe that doesn't happen with misdemeanors?

    P.S. I love your avatar! I went to Mexico City a few months ago and visited the Frida Kahlo museum. It is in one of the homes that she shared with Diego in Coyoacan. It is preserved/ restored as it was when she died. It was amazing!

    Your future employment is not the important thing here, dealing with the warrant is.
    Your lawyer should call the police and negotiate your surrender (time/place) and accompany you to it.
    The name of the outfit is simply them throwing homeland security someplace in an already existing booracracy. It could as easily be "cleaning bathrooms and special operations".
    Until this is sorted out (hours not weeks) drive very carefully so it does not look like you got picked up while speeding.
    Take care of this ASAP.

    Where did this happen? In what state and city? So you gotr an aresst warrant for working at the club? Did every dancer and the owners to? You should explain more.

    I have broken a law or 50 in my day so here's is my advice.
    1) don't answer the door if it is a police officer
    2) from a cell phone or outside line call the police station and ask what needs to be done to satisfy the warrant.

    I don't know how things are there but where I am from usually you can just go to the police station and the warrant can be satisfied for the amount of the offence and then a few bucks. However if you go to them you can be taken care of more quickly and usually without being arrested. If they come to you then you will be arrested and put in jail until bail is amde and so on.

    Don't worry about a thing Carmen. If you don't have a big criminal history and have been a fairly clean record, this is not a big deal at all. If you have a less than perfect record, then you may indeed need to spend a few hours at the jailhouse or possibly post some fees.

    Look at your original citation to see if there was a date on this. This is usually an arraignment date which you missed. It's just a stupid court date where you are supposed to show up, plea guilty/not-guilty and then leave (and likely get a fine or a real courtdate for sentence or trial). If you miss this, and your name is called at that date/time, it automatically becomes a bench warrant and it's issued/sent to whatever address they have on file. This is likely what occurred with you- you missed the arraignment, so a bench warrant was issued and mailed.

    90% of the time, when you walk-in for a warrant, and you dont have a history of other crimes, they allow you to sign yourself out right then and there, and issue you a 2nd arraignment date to show up.

    It's not like they are actively pursuing you (yet), but if you're stopped or pulled over for a traffic violation or routine vehicle pull-over, they WILL haul you downtown, impound your car and the sign-out option becomes less likely.

    No, they did not give me a citation. It is like I said the Dallas Police have just been giving warrants to the dancers. The time they came to the club they just took like 12 girls back to the office and got all their basic info. Then took photographs of the dancers. They have some of the pics up on the internet. Just look up the Dallas police department then go to crime info, and then click on indecency related offences. They did not post a pic of me, but they did of one of my friends and several other dancers. They too did not give her anything, and did not arrest her as it says on the internet. They only said she would get something in the mail. Which she has yet to receive. Both of us had tried to find out about the ticket we thought we would recieve, but they would always say we had nothing.
    I never recieved anything in the mail. I am not that hard to find as the address on my drivers liscense is the same one I have been using for over twenty years. The whole situation just is very fucked up. I am so stressed. I have to go to the bank now to get my bond money. I am taking the bus.

    Carmen, I read all the responses, only a couple are accurate for showing resolve.
    1st , please note that it is NOT personal, its just Business, its all about the cash and the cash will fix this problem ASAP, charge it to the game and quit cryin girl, its only a game.

    You simply need to call the station like someone told you up above, have the money ready, CASH, go in, pay the money, get the notice to appear, go to court, plead no contest, have them take the money for the fine out of the Bail, take the probation, and get on with the biz.

    If u need to know what to do from there , give me a holler,
    the CLUB can be held liable as well.

    This tactic has been going on in Dallas for some time back when Laura Miller began her fight with Duncan. I don&#039;t know how they are getting away with not giving out tickets on site and only issuing warrants in the mail. Obviously the City Attorney General thinks that they can get away with it. The City knows its a legal maneuver that puts a big burden on dancers, that&#039;s why they do it. Part of their BS is that you can become registered as a Sex Offender if you plea bargain. So make sure your lawyer fights your case against that. The Dallas Morning News had an article awhile back that showed jury&#039;s were siding with dancers on the average and questioned why Dallas police were wasting their time on "boob touching" cases instead of real criminals.     The club usualy gets off if they fire the dancer on the spot. Which in this case it seems they didn&#039;t. Rest assured though...if the club is drug into it, there will probably be some firings. But I know the job isn&#039;t too important when you have the man breathing down your neck!

    Dallas is from what I hear a particularly nasty place for dancers to butt heads with local law enforcement. First of all, exactly what offense are you charged with on the warrant ? As a misdemeanor charge, you&#039;re probably talking about $500 cash bail, plus at least $500 in attorney&#039;s fees (if you don&#039;t have one yet try - I met this guy when I did his radio show on Live 105 and he&#039;s about as cool as they come in regard to &#039;entertainment law&#039; - ).

    If you decide to cop a plea, you&#039;re probably talking about another $500 in fines, plus probably a year&#039;s probation and possibly being listed as a "sex offender" in the state register. A year down the road, you&#039;re then probably talking about another $500 in attorney&#039;s fees plus yet another $500 in court costs to have your record expunged/sealed - PROVIDED that this is your one and only charge.

    If you decide to plead innocent and take the case before a jury, the outcome can be anything from a total dismissal of charges up to the maximum penalty for the charge which I&#039;m sure involves some time in the county lockup. This of course is totally dependent on the mood of the jury you wind up with - but in Dallas i&#039;m told that the odds of getting jealous housewives, bible thumpers, civil servants etc. is pretty high. Also if you take the case to trial and lose there is no way to ever have the conviction removed from your permanent record.

    I&#039;d also assume that if there is a "homeland security" angle involved in these busts, it&#039;s based on cops checking for illegal dancers. The info they turn up is also extremely likely to be shared with other government agencies like the IRS - so I hope that your estimated taxes have been paid on time !

    Homeland Security is now a branch of the Texas Alcoholic Beverage Commission http://www.tabc.state.tx.us/about/org.htm who oversees the Enforcement Division who is tasked with enforcing the Texas Alcoholic Beverage Code http://www.tabc.state.tx.us/leginfo/rules/CHAP35.PDF 35.31 (Offenses Against the General Welfare) - any sexual offense described in Chapter 21 or any public indecency offense described in Chapter 43 of the Texas Penal Code. It has nothing to do with "terrorists" if anyone has that thought.

    I agree with Melonie that searching for illegals is also on their to-do list.

    Good advice. I&#039;d emphasive that you should not take a plea on the original charge, if ever. This so-called sting BS is an old trick to gather lots of easy plea convictions in an election year. I&#039;m hardly surprised they&#039;d pull this kind of nonsense in Texas.

    Couple other ideas: Fire your lawyer ASAP. His comments border on a professional ethics violation, if not worse. Your new lawyer should help you get anything you paid to this hack back, along with an apology. Fortunately Dallas has lots of great lawyers. I&#039;d beware of those that advertise they handle traffic tickets for $55. Much better suggestion:

    He&#039;ll be expensive. This is an interesting case, however, and he may cut you a break. I read his article on entrapment some time ago. Do your dancer friends in Dallas a huge favor and hire him. If anyone can scare and embarrass the Dallas PD/DA into stopping this nonsense, he can. First, he&#039;ll get you off, of course. If you can&#039;t afford him, meet with him anyway, and get a referral to another lawyer from him.

    One more thing - don&#039;t post any more details of the bust. This is potentially evidence.

    Yes, it&#039;s legal - if there&#039;s a warrant, it means the cops signed an affidavit which a judge found sufficient to satisfy probable cause requirements. You can attack the basis for the warrant, but only AFTER you&#039;ve been run through the initial arrest/arraignment process.

    Get another lawyer. The attorney&#039;s job is to zealously defend you within the bounds of the ethical constraints under which he has to operate, not to pass judgment on or otherwise interfere with you and/or how you live your life.

    Curious re Homeland Security... who owns the club where you work? Is owner(s) of Middle Eastern descent? Have you been following seizures, etc. in Houston? You may be in the middle of something much bigger then you realize. Go get a lawyer familiar with industry and situation in Houston immediately - and until then, don&#039;t say anything more about what you may or may not have done, etc.l - especially in print, K?
