    Default legal or illegal

    I was at a club earlier today, and the management was on a mission. They were searching every dancer apparently for drugs. They made everyone turn in their purses and open their lockers. The manager even went up to the girl on stage and made her turn in her change purse(she threw it at him).

    Before I started working for myself, I was in retail management. We could detain and call the police if we had evidence of wrong doing, but could not search them. They can't legally do a search like that by themselves can they ?

    I'm sure there is more to the story than I know, but it still sounds like an illegal search to me.

    Sounds illegal to me, still I applaud them for trying to run a clean club.

    Maybe they need to crack down some. I had not been to this club in about six months and things look like they have made a turn for the worse.

    it happens. sometimes it's because they know certain girls are doing it. other times, like at my old club. they do it to protect themselves in case of the cops trying to say it's going on there. that club brought in a dog (at their own expense) once a month and had it sniff lockers.
    you guys should know by now we have hardly any rights at our clubs. cooperate or lose your job. they count on no one actually following up on the legalities

    I believe it's illegal since from what you wrote management had no motive to believe their dancers had illegal substances. Even then they could not summon police because they hadn't observed any wrongdoing on their part. A different story would be having undercover cops inside the club making transactions with the culprits and compiling evidence in order to obtain search and arrest warrants. Of course in that case the club would acquire a bad reputation even if they don't condone drug trafficking and consumption or promote it.

    Mind you we're talking about an industry that is often embroiled in questionable labor practices, money laundering, and implicit condonation of prostitution right on the premises. I think when looking at the criminal penalties that those things can bring, the idea of a club not giving a rat's fink about a dancer's privacy rights isn't that much of a stretch.

    Secondly, consider that the privacy rights of a child in an American school these days aren't a hell of a lot better. How ironic that at the same time kids are in civics class learning about the Fourth Amendment, we have LE bringing drug dogs to the school to sniff their lockers. So much for innocent until proven guilty, huh?

    Ive heard of locker searches but never purse searches. Doesnt sound kosher even if the dancer signed a contract.

    I'm pretty sure it's legal for them to search a purse; definitely a locker. While I don't agree with that, it's not smart to bring your drugs to work, anyway, regardless of the privacy issue.

    additionally, the club could have workers sign a contract before emploment which waives these rights. Contracts like that do exist, and under the right circumstances even VERY smart people sign them. While Id be suprised if a strip club had its shit together enough to think that far ahead, business practices certainly do exist in other industries. Take for example the sports player who agrees in contract to shceduled drug tests, not really any different from signing a waiver that states that the locker is the club property and is provided as a courtesy and if you decide to use it for your personal effects, we reserve the right to inspect its contents (if they are really sneaky) and the contents of any containers stored within. Common.

    I have noticed that some of the independent contractor contracts I've signed have said that the club reserves the right to search personal property that is on the premises for their own legal protection.

    Well, you could say that there's consent on your part so any allegation of invasion of privacy would fall by the wayside at least in a civil proceeding. I reckon it would be accepted to validate a search for illegal substances if there weren't any motive whatever for the search, other than what the contract states.

    to quote a movie, "it isnt what you know it is what you can prove"...everything is legal until protested. every employee of my company has to sign of on the rules and regs of our company (employee handbook). since the company owns everything we have the right to search offices, internet history, email etc... whether or not truly legal who knows, anyone canned for a violation has an uphill battle and not a soul has fought anything. same principal i guess....

    I've never worked at a club that didn't have some sort of 'search clause' in the contract, saying we agree to having our belongings searched by management for illegal substances at any time without warning, and having contract terminated if caught with said substances. I've also never worked at a club that didn't require a signed contract at time of hire. I've worked in alot of clubs.
