    Default Lawsuit against GGW

    Two women are pressing charges against the creators of "Girls Gone Wild" productions for invasion of privacy. The first was at Lake Havasu and took off her top while on a boat with friends. Made the video cover. Now let's get something straight. If I'm the elephant man there is no way in hell I'm going to get caught exposing myself in public without a motive. Taking you top off in public and screaming your lungs off isn't? Are you embarrassed because you got caught doing something stupid during spring break? Shouldn't you have thought about that before you took your top off?
    IMO this lady doesn't have a leg to stand on but she'll probably get something for the publicity.
    The next case has more credence. The under aged teen said she was offered alcohol and drugs to perform before the camera. By all means that constitutes contributing to the deliquency of a minor but if they had chosen someone of legal age it really wouldn't have been such an offense.
    Don't people try to get others wasted to get them to do desired actions? When a girl dates a guy don't they go to a bar so he'll loosen up? When you go to a s.c. don't they push drinks on you so you'll spend your paycheck there? At a casino don't they try to blur your senses into following lady luck?
    We'll hear the results of the trial eventually but some of these cases stand about as much chance as the stars of "Cheaters" suing the producers for disclosing their impropieties on the silver screen for invasion of their privacy.

    I'm on the girl's sides here, sounds like they were both taken advantage of, it's one thing to be having some fun while on spring break but quite another for some slimeball to take your picture, sell it everywhere for everyone to see, and then to top it off not share any of the profits with you, and to take advantage of some kid by offering drugs, that's pathetic. I don't know if they have any legal rights here but I hope they win.

    Speaking as a private citizen, we have numerous rights which prevent this sort of thing. Her biggest problem (depending upon the angle of the photograph and distance) will be determining that this cover gal was indeed herself.

    My old club hired a fellow to handle the computerized sound system, set up a website and take professional pics of the girls. Unfortunately, he wasn't as scrupulous with the pictures as one would hope. He added the pics to his personal website, despite having a release form from NONE of us. Most notably, rumor has it that he had Photoshopped some pics to add in nudity for which we did not pose nor consent. Management confiscated his camera and the photographs.

    Photographs of private citizens are the property of said citizens unless the photographer has a release form, at which time the photographs become the property of the photographer. The only exception would be a celebrity or someone otherwise defined as a public citizen (the mayor, for instance).

    That is not entirely accurate. There are *MANY* caveats to this law. If you appear in a studio audience for say a TV show, when you walk into the building all production has to do is post a sign stating "by entering you offer your consent to be photographed" and that is good enough. You dont sign a release and they can put your face on a billboard if they chose. News organizations are another example, there is no photograph printed from a news wire service of a celebrity or a homeless person that has a filed release. You can publish just about anything you want under the heading of "news". The list goes on.

    The sad reality about the GGW case is that at this point, GGW is a multimillion dollar corporation wealthy enough to afford its own private plane, which it purchased two years ago. Regardless of who is in the right or wrong, GGW can affford to throw so much legal nonsense at the woman suing them that unless she is personally wealthy or has a lawyer working for free, it is likely that she will be unable to afford to even bring the case to court. This is the really sad reality when battling with very wealthy corporations.

    It is quite possible however, that because the gathering where she was photographed was in a public setting, the authors of the photograph need not have a release for publication. The law is multi faceted on this issue, but basically, whatever guidlines apply to news organizations would apply to GGW.

    These girls were photographed in public areas. Therefore it was legitimate for anyone to photograph them for profit or not. The only way it's your property is if you require a release or the photographer shoots you in private( hops the fence).
    I think that it was stupid for GGW to try to coax underaged girls to pose for them. There are plenty of legal aged women willing to do so which is what contributes to the outstanding success of the productions, but I also think that the law should not extend itself to protect people from the consequences of their stupid actions.

    Not stupid but ILLEGAL. You can not shoot nudes of a minor publicly or privately. That is a whole other issue. That is also one of the primary why a phtographer will get a release, to insure that the model is of age. Those two issues are very very different. IF the first is true, GGW has nothing to worry about, but if they were actually working with minors, they are really fucked, morally and legally...

    I saw on Court TV last night that GGW actually has 20+ cases against them with several being underage girls.
    Also the owner was arrested in FL for offering some of the women $50-$100 to have sex with him off camera. $50 :o The guy has millions- what a cheapskate !
    After that arrest the searched his plane and supposedly found drugs and video tapes (yup more than one) that had him on it telling underage girls to lie about their age on the consent forms so he could tape them for GGW.
