    Smiley Legal Rights of Strippers!

    Hi! I'm a law school student in NY and a part-time model/boxing ring girl/etc....and I am doing a paper on the legal rights of strippers and other employees of "sexualized" workplaces (such as porn actresses). It is mostly about how there is legal protection against sexual harassment in these workplaces but how rarely anyone takes action against anyone for it because lines are "blurry" because of the environment...or because girls don't want to complain to managment...who are also often sexual harassers themselves. Anyway, I am looking for dancers who would like to contribute their experiences, anonomously (or not if you want to use your stage name). I have a list of specific questions that you can answer (as many or as few as you want) or you can just generally give your feelings about stripping. This paper will be read by law professors and many law students, so its a great chance to get your feelings and experiences out there. (Lawyers are some of the biggest pervs out there as you probably already know!) If you want the list of questions I would be happy to post them or email them to you! I just want to make sure someone wants to contribute first! Please let me know so I can post them ASAP! Thanks so much!

    Just wanted to caution you to make sure you get those who choose to respond to you to specify what State they're working in and/or what their legal employment relationship is with the club, 'cause their rights/remedies may vary accordingly. Good luck with the paper... and if you eventually get it published in a law review, etc., please come back and post cite - as a card-carrying member of the "Perv Lawyer Club," would love to read it! LOL

    Haha, thank you for the warning! I will definitely keep the location factor in mind! There is actually a decent amount of law review material out on this subject, so if you don't feel like waiting a few months for my paper which is for a 'Sexuality, Gender & the Law' course (who said law school has to be boring!?!), I can give you cites to some great articles on the topic.     As my interests in the subject actually do extend well beyond my perv-lawyer status, would certainly appreciate cites to a few of the better articles you've found, as will save me the time & effort of wading through what I'm sure is a long list of articles just to find same (feel free to either PM or post).

    Hi again! My paper isn't just about bad experiences, but also highlights the positive aspects of dancing and experiences of those who do not feel that they have been exploited in any way. The majority of dancers that I have spoken to here in NYC have had some bad stuff to say about their management, wages, etc...like any other employee of any other workplace! But I do need lots of info about positive experiences too, not just sob stories!

    Hi! I was giving them to those who PMed me or said they wanted to participate, but here they are. If someone just wants to answer a few that's fine. They're written in past tense to include those who do not dance anymore, but if you still do, just read them as if they were in present tense. And please don't take offense to any of them, such as the one asking if dancers have "consented" to harassment because of the job they have chosen. I definitely don't agree with that, but you would be surprised how many people have told me they feel that way. These questions come from legal guidelines, actual cases, and the statements of other dancers and clients at clubs. You can email me answers, PM them to me or post them, whatever you like! Thanks!

    Survey Questions for Paper
    (Feel free to write as much or as little as you would like, although the more the better! If you have worked in more than one place, you can indicate that and speak about just one or as many of those workplaces as you would like to.)

    1. In what kind of “sexualized” workplace were you employed?

    2. Did you feel generally safe in your workplace?

    3. Did you feel that you were in control of your safety or did you feel dependent on management, bouncers, etc.?

    4. To what extent would management go to protect you both during and after work hours? Were they quick to throw out customers who they feel are verbally or physically threatening to their dancers?

    5. Did you find your work empowering as a woman? If yes, why?

    6. Who do you feel was in the more powerful situation in the club, the clients with the money or the dancers?

    7. Did you feel more or less respect from men clients in your workplace than you did from men in everyday situations (outside of the club)?

    8. Did you ever feel demeaned by your management or by your clients?

    9. Do you feel like you were ever exploited by management?

    10. Were you ever in a management position? If so, did your perception change on how to treat those under your supervision?

    11. Were you ever sexually harassed in your workplace? If so, how, and how often?

    12. Were you harassed by management, clients, or both?

    13. Were you ever in a situation in which you were not sure of what your
    legal rights were in your workplace?

    14. Did you ever feel that your management would look less favorably on you if you complained about harassment from customers?

    15. Did that fear ever go so far that you were afraid of being fired for complaining?

    16. Did you ever confront management about a problem or situation that arose with a customer?

    17. What did you wear (and not wear) at work?

    18. Were you given a specific uniform or were you free to choose your own attire?

    19. Did you know that employers are liable for sexual harassment of their employees by non-employees if that harassment was caused by the required uniform or dress?

    20. How did you feel about your wages? Were they fair or unfair?

    21. Did you have a changing area? Was that area the woman’s bathroom also to be used by female patrons to the club? If it was, did that bother you?

    22. Were you ever asked for sexual favors in return for your job, a promotion or other work related benefits? If so, what happened if you denied them?

    23. Was submission to such conduct ever made either explicitly or implicitly a term or condition of your employment?

    24. Did you ever find your work environment intimidating, hostile, or offensive? (ex. The atmosphere or situation at work becomes unbearably uncomfortable or offensive from sexual jokes, comments, touching, etc.)

    25. Did sexual harassment ever interfere with your work performance?

    26. Did you believe that your employer was legally responsible for the acts of clients (with respect to sexual harassment)?

    27. If so, did you feel that you could seek legal remedy where the employer knew or should have known of the conduct and fails to take immediate and appropriate corrective action?

    28. Did you ever feel that customers at strip clubs often view dancers as working for them or indebted to them for their business, and thus forced to tolerate sexual harassment?

    29. Did you find a tendency for dancers to endure harassment from patrons for economic reasons and desire to be seen favorably by their employers?

    30. Do you feel as though dancers have “consented” to sexual harassment by choosing to work in this field?

    31. What is your opinion on the widespread bans on physical touching of
    dancers in clubs?

    32. Did you feel that you had the freedom to reject lap dances with certain patrons?

    33. Where did you draw the line between “compliments” and harassment?

    34. Did you sign a contract of employment in your workplace, and if so, did it contain anything regarding your protection against sexual harassment?
