    Default Just wondering...

How do you think that Geragos's bombing defense of Scott Peterson will affect his defense of Michael Jackson? Do you think people will just focus on the Jackson case...or do you think that they'll kinda be "tainted" by the troubles that Geragos had with the Scott Peterson case/jury?

I had some thoughts about that too some days ago.

I think Geragos is a showboater - and not focussing on cases like he should be. It left me thinking he is more for his own glory than for giving an adequate defense for his clients (Peterson defense of mutant cult members sacrificing pregnant women - come on....)

He might also be a little foolish about the cases he takes on.

Jackson, from what I hear, is basically going broke. He had a gay porn director for a character witness (until that turned around - duh!) He is just so far out of bounds of the norm that one could think he might be capable of anything.

G is not taking cases that brings the public heart to him. The civil rights case or the "good question" case.

G is taking on freaks and phonies - which I guess most criminal defense clients are - but not to the extremes he is cozying up with.

As soon as the Peterson jury is free to talk we'll see how effective SG was. The verdict isn't the whole story. I agree with Deog that the alternative perp theory offered by SG seems weak, especially for a peninsula jury. Modesto might have gone with that theory, but San Mateo county is quite different.

My guess is that the tapes of the phone calls to his girlfriend sealed Peterson's fate. Great move by the cops. They deserve major kudos for this. Hearing this asshat dish out these bizarre lies to his girlfriend within a couple days of his wife's dissappearance must have been powerfull shit in the courtroom. Also notice that the cops and criminologists did a superb job of of keeping the evidence clean and tight. The girlfriend did a damn good job of smoking him out. Kept her cool on the phone while she knew damn well he was lying up a storm. I'm sure the jury probably struggled with the lack of good trace evidence and no evidence of the method of murder, but you can hear the evil in the tapes. San Quentin and a needle are in this non human's limited future. I'm personally opposed to the death penalty...I think it's too much power in the hands of the state, but I can be flexible.

As for Michael Jackson, I would bet money he'll do time, at least a year. When the evidence start coming out, people associated with MJ will start to run from the stench. I predict we may see some insiders come forward to testify against him.

As for the cases SG takes on, no self respecting criminal defense attorney would refuse a case based on the likelyhood of a favorable outcome. To do so would be antithetical to his profession. If what you meant was that MJ may not be able to pay his legal bills.... that's a different matter. Criminal defense lawyers almost universally have Clarence Darrow as a role model. In Darrow's most famous case, the Leopold Loeb trial, his clients eventually plead guilty, but he's nevertheless revered as great criminal trial lawyer, and his lengthy closing argument in that case is widely taught as desperate but brilliant advocacy. The defendants had switched their plea to guilty, and Darrow was arguing to save their lives. Here's a brief quote from his lengthy argument:

" I am pleading for the future; I am pleading for a time when hatred and cruelty will not control the hearts of men. When we can learn by reason and judgement and understanding and faith that all life is worth saving, and that mercy is the highest attribute of man."

Leopold and Loeb had their lives spared, due only to Darrow's overwhelming force of personality and insight to the human psyche. Darrow was a showboat of the highest order, but also an incredibly persuasive advocate. Gerragos is no Darrow.

Geezus, did I ever drop the ball...

I read a quote on CourtTV website, but failed to realize that it was dated November 20, 2003. Being that it was the 20th of November when I read it I "reasonably infered" that it was current. Oy vey.

Well, I guess that concludes this thread!
