    Laws?

    Hello everyone, haven't been here in a few months (life is crazy busy). I hope you all are doing well.

    That being said, I have a question. Recently, one of the owners of my club moved to California to manage a new club he purchased. This guy was very well-liked by the girls at work- he made us stick to the rules and didn't put up with BS, but he was also very kind-hearted and easygoing. The new manager who took over for him is from a club in Portland (also owned by the same people). I barely work with the guy, but he has the reputation as being a bit of a tool.
    When we got hired, all the dancers had to sign a contract. In our contract, it states we must work a minimum of 4 shifts a week. However, over half of the girls don't follow that due to being in school, having other jobs, being single mothers, etc. This new manager is coming down on them. One girl I work with only works two days a week right now. She doesn't have another job, but she makes enough money so that's all she needs to work. I guess the manager recently cornered her and told her she has to work four days a week or she'll be fired.

    I was under the impression that we are supposed to be independent contractors. That's how they can get away with not paying us and charging us the house fee, isn't it? Because we're allowed to set our own schedules? Is there anything she can legally do about this?
    I need to read up on my stripper laws.

    Unfortunately, if the signed contract requires 4 shifts a week there isn't much she can do because it was part of the contract agreement between dancer and club.

    If it wasn't in the contract it would be a different story however. Clubs only have the right to enforce rules that are in the contract and ofcourse local and state laws.

    Yep...what LL said. Also, in this day and age, just because the club calls you an independant contractor doesn't mean that you actually are one. Until all of the strippers of the world get together and sue all of the clubs...the chances of it changing are very unlikely.

    This girl is either going to have to find another club that gives her this leeway or start working her 4 nights a week.

    Sucks, but that's the way it is now.

    LOL....thanks guys. Actually, didn't a bunch of dancers sue a club in SF in the '90's? The O'Farrell brothers or whatever? It's in that book "Strip City." They won back pay, I think, but obviously nothing changed.

    Actually, it was a class action lawsuit filed against all of the Club's in SF by all of the dancers. As soon as the clubs lost and filed for bankruptcy to forfiet paying back wages, Deja Vu was in bankruptcy court and bought all of the clubs in SF. Which is why they have such a monopoly in the city now.

    I think MBOT just paid off all of the dancers, rather than have Deja Vu take the buisness away from Jim, but I'm not sure.

    I just shudder at the idea of Deja Vu taking over the MBOT as I view it akin to Clear Channel Communications buying one of our local radio stations (KSJO) and destroying it. The MBOT Jim Mitchell owning/running it is a SF Bay Area icon, it has a local soul/ character while Deja Vu taking over would just destroy it and turn it into another cardboard corporate soul.

    Yes MBOT is copying alot of what Deja Vu is doing, but at least it's local...

    MBOT has added a lot more than 'local color' to the SF strip club scene LOL. It was the first club where dancers openly posted their "full service menus" with itemized prices on the internet !

    I agree that by requiring the signing of a contract, clubs are legally able to cover their butts in regard to future firing of dancers who breach the contract. Not only is this legal in regard to minimum X days per week, but it is also legal (thanks to the Disney precedent) for things like changes in appearance i.e. weight gain, tattoos, etc.

    It should be noted that those things, or any such stipulation for that matter, apply ONLY if it is stated in your signed contract.

    The word "FIRED" is part of the problem when referring to Independant Contractors. You are not FIRED .....You have violated the terms of your contract and therefore invalidated that contract. I really prefer the term DISMISS. This does NOT have to be fairly and equally enforced as it is performance based. Dancing as an IC is NOT a Job in the normal sense. Also .... Performance standards (like weight, appearance, ect.) can be part of the performance standards of the contracting Club and do NOT have to be listed specificly in your contract. They DO however have to be known and available to the IC's. Most CLubs refer to these performance standards as "Rules". It is entirely at the discretion of the Club whether to fine or dismiss the offending contractor.

    The best way to visualize the IC dancer/Club relationship is like (many) Real Estate Agents and cosmetologists. The same situation also occurs in Construction Manufacturing and Sales. Dancers working as IC's need to realize that the advantages are not free. They come with some responsibility.

    Does it all really matter??

    If you fight the power in this industry,your going to lose your job.
    Even if you win(and most times you wont)you still lose because you lose your job,possibly black listing you from other clubs.

    Until entertainers unite,your living in a like it,lump it,or move on world.

    The good side of it all is that your a professional entertainer.You can be airlifted and parachuted into any town or city in this country and get a job within hours making good money.

    just my 2 cents.
