    Default Independent Contractor and Taxes

    I have decided to become more financially responsible this year and begin paying taxes. I have searched through this forum and have not yet seen any situation similar to mine, so I am really confused. The club I work at has never had me fill out any papers of any kind-- they don't have a photocopy of our ID's or anything. We pay a set house fee and $5 per lap dance, but that is all. I've been asking around and none of the girls I work with ever pay taxes or have ever paid. Unlike some others on this forum, I do not have nor have ever had a regular job, so I have no w-2 forms or anything to hide behind instead of claiming dancing money. I am so lost and totally clueless about what to do. Can I just get some forms and claim the amount of money I make, or is there more to it than that? What are the proper forms and where do I get them? Please, any advice would be greatly appreciated!

    The first forms you'll need are California form 540ES and federal form 1040ES. These allow you to file and pay estimated taxes which are due to be sent in by A WEEK FROM TOMORROW JAN 17th.

    Then you'll need federal form 1040 plus Schedule C, and California form 540 (long) to actually file your tax returns by April 15th.

    I am enrolled to practice before the IRS. Last year I prepared over 1700 tax returns in Texas. Dealing with the IRS is a problem that many dancers have. In Texas many clubs do not provide dancers with tax documents. Some of the ones who do only include the dances that were charged on credit cards. The IRS does require that all income be reported. I have several clients who file just for education or credit reasons. It can be used as proof of income when buying a house. Being an independent contractor does have the advantages of being able to take work expenses directly against income. This can make a big difference in how much of your money the IRS will take. It will be worth your time in seeking out a tax professional who knows your profession. When you work hard for your money it should be worth a little effort to keep as much as you can. I even have a few clients who receive only cash, do not pay quarterly, and get refunds. It just depends on the situation.

    Hrb, a semi-related question if I may. What percentage of tax returns that you filed on behalf of dancers were audited by the IRS ? I'm just curious cuz the IRS issued a statistic that they audit 1.5% of all tax returns claiming $100k or more in gross income, and wonder if dancers are being singled out as part of the IRS announced effort to concentrate on returns with high possibility of unreported income.

    I am in much the same boat as AngelEyezXYZ. All this tax stuff is totally confusing. Sorry to intrude on this post, but it made me think of a question. Are you required to have an independent contractor's license to pay taxes quarterly? Or are you automatically considered an independent contractor if the club does not pay you a wage? Just curious.

    The IRS does not require any type of license. You may want to get a FEIN (Federal Employeer Identification Number) but your Social Security # is all thats required under normal circumstances. States and especially counties/cities have some strange rules about self employment and usually have more licensing requirements.

    As DJ posted, the IRS is not going to care whether you have obtained a state/local 'independent contractor business license' or not. However, your state tax people might cross-check, if you live in a state/city which is strict about these licenses.
