    Exclamation Oh My!

Just a quick question..a girl I know at the club I worked at messaged me and said she wasnt sure what to do about her taxes, that she got some tax papers (w2 I assume?) in the mail from the club..but the club doesnt do business that way, because all of their dancers are independant contractors, so they have to just take all their stuff in, right? You dont just get w2s in the mail from the club do you? Especially if you are independant?

Ricks sent me a 1099 before, which tracked any dances I've done on a credit card tab, ie traceable. You MUST declare any income made that has a record at the club because its a huge red flag since they know you took home that money.

The clubs are not required to do this for IC's though, you should call your club's business offfice and ask.

    Here we go again ...

Under IRS rules, dancers who are considered to be 'independent contractor businesspersons' and dancers who are considered to be 'employees' both are required to declare and pay taxes on all of the money they earn. The only major difference is that in the case of clubs which treat their dancers as 'employees', the club's payroll system withholds taxes from every paycheck and sends that money in to the IRS on behalf of the dancer throughout the year - with the club issuing a W2 form in January listing the amount the dancer earned and the amount of withheld taxes the club sent to the IRS on her behalf.

Where dancers work as 'independent contractors', the club has no payroll system and it is the responsibility of the dancer herself to send in quarterly estimated tax payments. Clubs use a 1099-MISC form instead of a W2 form to report any money paid directly by the club to the independent contractor dancer. It is also of course the responsibility of the dancer to report any money she directly receives from customers i.e. tips to the IRS on top of any 1099-MISC amounts.

Traditionally, in the days before the IRS had more computer power than NASA and before clubs had corporate owners with stockholders, attorneys and accountants, clubs usually only reported 1099 amounts where the transaction between the club (on the dancer's behalf) and the customer was 'documented' i.e. a credit card charge. However, as clubs have begun to institute pay systems where dancers are paid a 'commission' for private dances and champagne room trips which customers pay for through the club's cash register, this dancer income is now likely to show up in a 1099 issued by the club as well.

She said this was her first year of dancing, and she got a form in the mail, so I assume it is a 1099 form. I donno if she has saved the $ she made (I hope she did!), because she was a high $ maker and made -lowest- at least a grand a week, sometimes 3 grand in the good weeks. I will suggest to her she go to an accountant, and give her this information. Thanks!
