    Default Is this solicitation?

OK, I had a question for anyone that knows about how laws work. My friend and I just started our own private dancing service. To promote it we sometimes go out to bars and pass out cards to guys while we chat and have a couple of drinks with them. We only dance, and we don't offer any kinds of sexual services besides an erotic, nude dance. Sometimes guys take us up on the private dance offer right then and there, and if we are in a hotel bar we go for it because we feel that hotels are pretty safe. The other day, my friend brought up the point that this is soliciting. If we talk to the wrong person could we get in trouble for solicitation, even though we only dance?

This is not a legal opinion, just my own. That's damn scary. If I were you I would right now find another way to promote my business before you wind up in jail.....or worse.

You should find out your state laws because I would assume it is illegal.. You don't have a registered business, or license etc. I also have to agree with Destiny.. sounds very dangerous. Why don't you work a club? Just a though..

Yep, I can see this really blowing up in your face - again, not a legal opinion.

Yeah, you guys are right I guess it would just be better to only have an ad in the paper instead of going out to promote in person. I usually do work in a club but I am so burnt out from strip clubs right now, I just finished working three weeks in a row with no days off, but I can't resist the urge to make money even though I don't want to go to the club right now, I guess I'll just wait until I get down to Jacksonville for the superbowl to work, thanx for the advice.

There is nothing wrong with handing out business cards for your business. However, in some states that is illegal (when done in conjunction with an adult/sex orientated business). You are going to have to find a lawyer who knows these laws and ask them what you can and cannot do. Any "layperson" interpretation is likely to get you in trouble.

    Good luck!

To me the scariest part is not even the legal issue, but going to a hotel room with a guy you've just met in a bar, with him most likely thinking he's going to get more than a dance. That's a disaster waiting to happen.

Most big cities have what they call "alternative" newspapers. They come out once a week, and are usually given away in racks in front of restaurants and bars. I'd look at taking out an ad in one of those (some mainstream newspapers won't take these types of ads so there are usually a lot of them). You could have a cell phone number, which would give you the opportunity to screen the guys before you agree to meet them. That way you and your friend would always know who you are meeting and where. Personally, it's still to risky for me, but if you are set on doing this I would think that would be a minimum. You should probably look through the "other work" forum for more ideas on how to do this safely.

    Good luck.

Of course this is solicitation. If i came into you're place of business and started handing out my business cards, i think you may get a bit peeved. I have been thrown out of clubs because they thought i was soliciting their customers. You see when you have people in a bar/club, they are under that roof for the fun and company of the dwelling. It's wrong, illegal (hmmm depends on the situation)....well the owners could have you're ass thrown out, and if wants call the police, and you may have a court date.

Especially when this comes to the adult industry people get pissy. They will push the envelope.

We have people who want to hand out (seems innocent enough) AVON books at my "real" job, a big no-no. They get security called and thrown out.

You may be doing a great service and legal (again depends how slick a lawyer grabs it), but get a lawyer who says this looks like a "front" for prostitution and you could have some fines.

Ok, this is what i was told by authorities, and i don't pass out business cards because of this.

Run a small ad. Or hit the internet! Be careful wit passing out private party cards in other establishments, or on the street. And screen, screen , screen these guys!

    Good luck,

    Pamela

Crim defense lawyers have a term for how cops recall conversations with those they've decided to put in handcuffs. They call it pencil fucking. The cop writes down absolutely anything he wants as his "notes" of his conversation with you.

You: Hi, my name is CK, I do private exotic dances, here's my card.
Undercover cop's notes: "White female, approx 20 yo, approached and identified herself as CK. CK handed me her card and asked if I'd lke a BJ for $50, or straight sex for $55."
Undercover cop: How about I get anal for free or I bust you right here, CK?
Cop's notes: "I asked CK to repeat the offer."
    You: Forget it asshole!
    Cop: You are under arrest.
Cop's notes: "CK repeated the offer of sex for money, and I arrested her."

Watch "Leaving Las Vegas" or "Showgirls" for some truly stomach turning cinema of what can happen in a stranger's hotel room. You may end up wishing this person was a cop.

edit: Referring to "Showgirls" as "cinema" I believe is unlawful outside the greater Hollywood area.
