    Default ESPN aired my stage without release. FUCKTARDS!

    I am so insanely pissed off. ESPN was in my club filming for a Superbowl special; "Jacksonville Nightlife" or some such thing. They filmed for two days, almost all night long both days. Interviewed some out of town girls and the manager in Champagne, blah blah blah. They also filmed the stage while telling everyone in sight that they only wanted a few leg shots. Sure enough, on ESPN this morning there were split second appearances of Starr's shoes and feet, Chase's legs...

    ...and me, bigger than shit, on stage, full camera shot including my unblurred face for about ten seconds.

    I had told everyone in sight that I was NOT going on television. I never approached the cameramen. I signed no release form. I tried to get out of my stage show because of the cameras parked on back stage, but the DJ told me that they had sworn no faces/legs only and so I had no excuse to get out of going. Yet there I was, bigger than shit, performing on ESPN this morning.

    So. Gonna. Sue.

    I've tried to call the FCC but got nothing but an automated system that won't even allow me to leave a message. I'm calling a lawyer first thing tomorrow. My club's regional manager is calling ESPN; he'll be calling me shortly. This is so not right, in so many not-right ways. I am PISSED OFF.

    the chances of winning against espn are slim to none. If you do win it will be a moral victory and small compensation. ESPN has a multimillion dollar legal team. What is more likely to happen is to settle and maybe the segment producer gets admonished.

    I agree. Hopefully you taped it or can still tape it before tonight. otherwise your lawyer has to file papers to get what was aired and it will take some time. A lawyer will serve the papers but , i agree, your best bet is to settle as soon as possible for a dollar amount and no doubt they will retain the right to use your image. You see, they can run up lawyer fees for years while they know you cannot afford to do that.

    Go straight to a good civil lit lawyer and under no circumstances speak to ESPN or anyone else about the case. Including watchdog agencies of any kind who would not do shit for you anyway. Call a lawyer tomorrow morning so they can get started in the statment of claim. Don't ruin your chances by talking to anyone at ESPN or anyone else for that matter.

    And I think you should take down this post too before it becomes a court document. Your statment here can be manipulated and possibly entered as an affadavit if you're not careful...

    Sue? For what? Why do you think they needed a "release?" The club allowed them in, and allowed them to film... beyond that, it's not like they need a release everytime they take a picture of someone and air it.

    As for taking down post, etc., if you're going to file suit, what's done is done... don't start messing with the facts.

    They were allowed to film in the club yes, but they did not have permission to air her face or body on t.v.

    I'm pretty sure they do need a release unless she is a public person - e.g. a celebrity or politician. The fact that she is a performer does not render her public, and they do get releases every time they shoot a picture of someone and air it. As for the rest - yeah. Don't try to lie. That won't look nice. You haven't even said anything compromising.

    K... but I'm watching Superbowl on TV, and they're showing lots of people - think they have releases? Does news get releases from everyone they show when they do piece on shopping at mall during Xmas???

    Well, there's different aspects, probably in different states, but here's what a lot of professional photographers live by:

    Can the photographed subject be identified?

    If not, no problem. In this case, there appears to be a problem.

    Intended use of the photo.

    There's a lot of different possibilities here. News and satire are clear. Commercial use, you need a release. What's commercial use? That can vary. But I wouldn't say that ESPN is just automatically in the clear here.

    The manner in which the photo was taken.

    Public or private setting? With a club, it's a good question. Was the taking of the photo consensual? In this case, no. Was the subject aware the photo was taken? In this case, no. There's other variations here.

    Payment was offered and received.

    Obviously, that's not the case here.

    If the photographer has any doubt about any of these, it's wise to get a release. In this case, obviously, there was no release - if the club signed a release, I'm not so sure that the club can sign away the rights of employees/contractors. If I were a photographer/filmer in this case, especially considering the public image of those being photographed in a club, I would've gotten a release. No question. I'm frankly surprised that ESPN didn't blur the face. I've seen news clips on local stations involving strip clubs, and the dancers' faces are always blurred. This is really surprising.

    Talk to a lawyer. Money? In a contingency case, the lawyer keeps a percentage. If you lose, the lawyer gets nothing. However, the lawyer might hold you responsible for costs of the case, which can be substantial.

    And no, I wouldn't take this thread down. Let's say you have your deposition taken. "Have you talked or written to anyone about this matter?" "Well, yeah, I posted on a public board." "Can you print that out for us?" "No, I had it taken down." "Why?" Doesn't look good.

    You can settle out of court. It's doubtful that ESPN will go for that, but they might. It's worth a shot though. Call them, see what they say. I settled out of court once without even using an attorney. I just called the company and said I neede to file a complaint...worked for me.

    Yes, they need a release..
    When my club commercial was filmed I had to sign a release for them to show it on a certain channel let alone show it at all. They HAVE to have a release to show her on television, especially for their own gain.

    I'm not all that confident that that's within existing statutes, precedent, or public policy, Grn. Are you that sure of Florida and/or Federal statutes?

    I agree that a lawsuit against ESPN will tend to put the plaintiff's name right in the headlines. Witness the Kobe Bryant matter... there was shielding of the victim's name, but as soon as she filed civil suit, it's public.

    For examples, look at a pro sports game. do the fans sign releases for their imagews to be used on tv? no

    I agree it was low but the chances of getting more than a moral victory are about the same as the eagles winning the superbowl that just ended.

    A lawyer can help greatly but they need to keep it discreet, you dont want publicity and espn is a billion dollar company. Theyre not going to go away and in reality they probably have very experienced legal advisers and well paid as well.
