    Angry Are you kidding me?!

    Im going to rant here... its kindof long not too bad though *bad spelling below... sorry im a little ticked*


    So my and my little family have been really sick almost non stop.. i mean in december i would have strep 2x then get the flu and my hubby got broncitis for the first time.. not to mention my son getting cronic tonsilitis and wasnt even sick for that long... it was a little bizzar but i thought it was one of those bad stroke of luck kindof things...


    Well it wasnt... we have had problems with our bedroom leaking water ever since oooo we moved in.. called about it a total of 4 times.. all they did was dig a bigger hole *kindof like a drain thing?* outside well low and behold it rains again... and im thinking oh LORD are you kidding me? well i move my sock drawer and what do i find... 5 big patches of mold in and on the carpet... yep that lovely BLACK mold and after all the problems i have had woth this place ive decided That enough im done.. i dont pay over a grand in rent to live like this...

    *examples of this that have gone wrong.. (termites... our fridge door is loose and the inside was broken upsince day one.. leaking sealing since day 1*what happend is someone will take a shower and a pipe will leak they "fixed it" by putting putty on the big hole the leak caused * the back sliding door wont close *the guy told me the patio had to be redone and the sement had shifted so it needed to be taken out*.. leaking faucet the nozzil on the shower is loose and falling off the bedroom windowcil leaks along with the floor*


    And yes this is ALL stuff i complained about the soonest they came too look and any thing was 4 days after the fact the longest.. 2 weeks and did they take care of it all.. nope... just the puddy on the celing...


    So i call them yesterday telling them im giving a 30 days notice *because we are on month to month by now and we have lived in this place for 4 years so i about had enough with it.. well she tells me i need to give 60 days.. of corse im thinking oh F&%@ that we are on month to month.. then she goes to tell me about a self renewing contract... *great* which is one sideded BTW
    i tell her look we got mold we are leaving she says no you need to do a 60 days notice *and man was she being RUDE!* now im sitting here getting pissed thinking about how weak we have all been probably because of the mold and i flat out say.. Look we have a mold problem and we ARE moving in 30 days and if you want to press this matter then be my guest
    and i say somthing about gladly taking them to court and bla bla bla... her reply is go ahead... Mmmkay



    so my husband stops by to give them the 30days notice.. he got the same responce.. they werent very polite... they brough up the court thing... lets just say it didnt go well.. so 20 mins after my hubby gets home they immedatly show up... *a guy came earlier when i called the first time about it and tried to clean the mold out of the carpet... *oh geee i took samples sorry your too late * Well first he says he going to check to see if it is mold.. then he goes on to tell me its not (hes a mantinence guy so.. wtf ya know?)
    all of a sudden hes real quck to want to clean it for me? what? dont you do mantienece? anyways first he says his just makeing sure.. then he ges to say see its not mold its comming right out then quickly sprays the other mold things when i told him not too.. like RIGHT before he did.. what he say.. "oh whoops sorry didnt know".. uhh okay... but low and behold the mold was still there.. anyways....


    the lady is being SOOOOO rude and i wanna just..... but im cool getting ready for work.. all of a sudden they start tearing out the carpet she comes in to tell us fora 4th time theres no mold.. *yeah right lady whatever you say* we go in there and look at it.. the board that goes around the floor under the carpet was black... BLACK she says oh you have had water damage but theres no mold here *HOW are you going to stand there and tell my that wood is black because of water damage?* we just stand there and are like ok whatever you say... while hes taking anything he sees black out from the floor i grabbed a piece of wood after this lady leavestook a pic got a sample put the wood back because he wasnt happy about it.. they wouldnt let us have any of the molded stuff.. they said they had tohold it at the club house.. ???????

    and im thinking.. how long has this mold been there.. and is it in the walls?


    also my djs mom and dad use to live here... his dad fell through the attic floor fro the termites...


    all this in one day,.... monday im going to get the samples tested.

    When I have time later I'll look for some articles about this to post here. You need to contact an attorney- you may suffer long-term health effects and the landlord can be liable for that. She should not have been so rude! What the landlord is doing is setting up a situation to make it appears as if you are at fault for the water damage, so she won't be liable in court.
    She is a F*cking slumlord!!!!!!!Take some pictures of your own of the water damage & give them to someone who does not live in the building. Now.

    There is something called rent escrow. You have to file for it in court. Basically, if you are renting somewhere that has a serious problem like you described, you can file suit against them, and until they fix the problem, the rent money you pay them goes into an escrow account, so they dont get a damn dime. If I were you I would break the lease. They have to have acceptable living conditions, and it doesnt sound to me like they do. And I would bet money that if you took THEM to court, they would be paying YOU.

She is blowing LOTS of smoke out her ass if she thinks she could take you to court. It actually might be better for her to take you, so she can look like the idiot when you win money, and then the papers can exploit her. But seriously, take pictures and go to court.

    i have about 30 pictures of the mold ALONE not to mention the samples i grabbed.. im probably going to go running around the place and take photos of whats gone wrong.

    i was in utter shock with the lack of respect i was getting for being someone who has lived there for 3-4 years and have them turn around and act like that.. my tolerance out of the club is real high.. but i just wanted to smack her one

    You really need to take her to court. I hear of too many people who could win something in cases like this, but just wont go through with it. Take the time to set things up!! You wont be disappointed.

    Well have a mold person come over and do a test and when you get the results demand that it gets fixed and also you may have a law suit as well , lawyers love this shit .

    You definitely need to do something like take pictures and such because you don't want them trying to stick maintenance fees and other things when you move out. Have you ever heard of a poor man's patent? Take pictures and mail them to yourself and don't open them at all. That way you have the date on the envelope so if they take you to court to try to get money from you, you have the proof that the damage was there and that's why you had to move. Did any of that make sense? Sometimes my sentences run together.

    Well, I PMed you.... in the letter you should write just say that you will put the rent in excrow until it has been fixed..
    Like I said in my letter by law they have to follow the contract just as you do. And that includes a habitable home.
    The friend I spoke about had a hole in his bathroom about the size of a head, he could see into the place below and the floor and tub was sinking, as you could see by looking at the wall. After the letter was received he had his placed fixed in less than no time.
    Just look online for renter's rights and it will tell you everything that I said to do.

    Actually I think you can file escorw just by going to the court house... I'm not sure, but I don't tihnk it's concidered difficult to do at all, but write the letter first and if that doesn't fix it, by law you do NOT have to pay rent.

    Yep, all you have to do is go to the courthouse, at least thats what they told me. But yea, thats what I would do. They dont deserve any money at all if they let people live like you have to live.

    I'm jumping in this thread kind of late, so I don't know what people have advised thus far...but not only do you need to find an attorney, you need to contact your local health department and building inspector!! NOW...immediately!!

    They don't go for this shit...and, being that you've complained and the landlord hasn't done a damn thing...they may be liable for your past and present medical bills...and any damage to your things from their inability to keep up their rental property.

    If you moved out NOW...taking all kinds of pictures...sending a CERTIFIED letter to your landlord (keep a copy of the letter) stating all of the problems that you've complained about over the course of 4 years which were never resolved...and mention the mold again...stating that your family has suffered ill health due to the mold (keep your medical bills)...I do not think that there would be a judge anywhere that would make you pay "lost rent". However, DO take this up with a PROPERTY attorney. An attorney who specializes in tenant/landlord law.

    You have recourse...you just need to get on the ball and do it quickly.

    I really hope you do what VG suggested, and move out immediately. You dont need these health problems that occur from mold, much less your family! You have every reason to move out, and you are guaranteed money in court, and probably your medical bills as well. Seriously though, PLEASE do this! Good luck

    got pics got samples of the mold.. went around a wrote up what has not been fixed down on paper.. guess all i need to do is get a copy of doctor visits from the past few monthsand grab a good lawyer... ill talk about more options to my hubby today when i wake up

    Don't forget to call the local Building Inspector and Health Departments! What they'll do is write up a document that your lawyer can use to go after the landlord(s). Also, the Building Inspector can issue sanctions against the landlord if they do not clean up the problem(s) by a given date. The Building Inspector can "make" the landlords move you to an approved "in-between" place while the work on your place is done. If the landlords cannot or will not do any of that stuff, then the building inspector can issue the home "CONDEMNED/UNLIVABLE". While a lawyer will get you into court...the Building Inspector and Health Department will get you "foulproof" documentation that the lawyer can use...and really kick your landlords in the ass. Court can take a LONG time...the building inspector (usually in these extreme cases) will not fuck around and doesn't need to take the landlords to court.

    Go to court to sue for damages, etc. Use the Health Department and Building Inspector to get your place repaired...properly...NOW.

    UPDATE

    Okay so far i wrote down what all has been wrong.. cant get a copy of things that has gone wrong *they say that our files from the first 2 yrs are missing* Right...

    took the mold to the lab.. the lady told us it was mold by we told her we needed a document saying so... allready have lawyer picked out just waiting on lab results..


    CHEST IS KILLING ME hard for me to breathe so im going to the doctor Tonight..


    with all the things that we reported a total of 11 things tha has gone wrong and NEVER fixed correctly.. Actually only 3 out of 11 reported items we "Attempted" to be fixed..

    ill keep yall updated

    okay went to the doctor..

    i have broncitis... the doctor knows about our mold problem and said it could easily be directly related. also we have an indoor air specialist comming in monday.


    thats all for now.. ill post more next week

    there are places you can send samples to in order to test for toxic black mold... in all honesty, if its the toxic mold, that could be the root of the health problems and you can sue up the ass for that... find out... i will look iy up for you, but my brain doesnt work and i dont remember the name of the black mold... good luck

    I'm not sure how it applies to real estate contracts, but "self-renewing" contracts aren't enforcable for many things I know for a fact. I believe that a 60 day notice clause would have to be part of the month-to-month agreement.
