    Default RED ALERT for NYC DANCERS !

    The NY appellate court has just ruled 4-0 that all NYC clubs outside of specific 'Adult Business' zones which had been allowed to continue operating under a 60/40 rule or other 'grandfather' provisions must now go bikini or close altogether. As such, it is pretty well assured that many clubs will be closing and filing for bankruptcy. This will mean that a NY bankruptcy court is going to be handed the 'books' from all of these clubs - 'books' which include the names, addresses and SS#'s of dancers. As this info will surely be shared with the NYC income tax people, NY state tax people, and IRS, the next two days represent a last chance opportunity to file income taxes or at least an extension. Doing so might also make you eligible for unemployment benefits, which might be a very important consideration given that thousands of NYC dancers stand to face imminent unemployment with little chance of getting hired in other clubs outside the NYC limits which are within reasonable driving distance/ public transportation routes.

    Great post Mel ! Do you know how many clubs will be effected by the ruling ?
    Not yet. But I do know that the only clubs which are actually located in an approved Adult Business zone are PEC, Hustler, Scores West etc. located on the 'far west side' near the future sports stadium. I also know that any club which is located within 500ft of somebody's residence, a school, a church, or other types of public buildings are now considered to be Adult businesses thus are in violation of NY State law as well as NY city ordinances.

    Well............. there is a good and bad side to these things....... On the brighter side there will be fewer clubs for customers to attend and therefore each remaining club should get a bit more than average bussiness after the other clubs are gone. There is an over saturation of clubs in NYC as well as in several other larger cities and this is one way to level that.

    Ofcourse not everyone affected will be on the brighter side of this situation, unfortunatly.......Time to either move, travel or get hired at a properly zoned clubs.

    At least there is some early warning on what will happen !
    Example of discrimination (Imho):

    the only prudent way to treat Islamics in the US and western europe today is along the same vein as Russians and Eastern Europeans were treated during the 'cold war' days - with some degree of suspicion warranted until proven otherwise !

    Damn that's gonna fuc* up the indusrty all over... so many chiquitas out of work.

    To everyone in NYC, I hope the appeal is granted and the clubs stay open in the meanwhile.

    And Melonie is absolutely right, these clubs will not just close up and dissapear. They WILL file for bankrupcy, because that way they can hide whatever cash they've squirreled away (and trust me, they knew this might hapen so they've been skimming a LOT lately off the cash, I promise.)

    Then they allow whatever 'assets' are left to be disbursed among the creditors (or in some cases the 'clean' investors). And the primary owners will walk away.

    There are so many advantages for them to file chapter 11 instead of just closing, I can't even list them here.

    but Mel is right, anyone who ever gave their Social Security # to their club, anyone who gave their Drivers Liscence to the club, you ladies are DEFINETLY going to be hearing from the IRS.

    The club owners may even inflate their accounts of the dancers earnings to explain away the 'skimmed' money, so even if you're legit you could have to 'disprove' what the club says you made.

    I have a feeling this is going to be really ugly for a LOT of people.

    And when the dancers start doind their taxes and start talking about the house/dj fees they paid and never got recipts for... well, the DJ's and maybe even Hostesses are going to be up the creek too.

    Damn.

    Agreed, but the 'good' is going to be limited to top notch dancers currently working at properly zoned clubs, plus the best of the best dancers who will lose their jobs at other clubs and subsequently be hired at remaining clubs. However, for the less than top notch dancers at all clubs, regardless of whether they're properly zoned or not, it's going to be a very tough road.

    Also, I don't completely buy into the idea that the legally zoned 'far west side' clubs are going to gain all of the business which is lost when other clubs close. Much business at existing clubs is 'location opportunity' i.e. being located next to the Stock Market, being located next to Broadway theatres, being located next to Times Square etc. If guys are going to go to the trouble of taking a cab ride from their hotel to a 'far west side' hotel, it only takes 5 more minutes to cross the river into North Jersey where they can smoke, drink, and pay about 1/2 the cover !

    as the article says, nobody knows what 'temporary' will actually mean yet ... 6 weeks versus 6 years.

    Will at least the "temporary" order means dancers and other club employee's are free to earn a living (for a while at least)
    Hopefully the dancers will work a little more and save up as much as they can.

    I would be interested in an update though. What ever happened with this?
    well, a few different things appear to be going on.

    A - certain NYC politicians are mucho pissed off that they're tangled up in yet another round of legal appeals with Manhattan clubs that are operating in improperly zoned areas, but apparently realize that this is going to take as long as it takes and will cost as much as it costs.

    B - rather than carrying on a 'frontal attack' on these Manhattan clubs i.e. closing them down for improper zoning, rumor has it that the pissed off politicos have instead been trying to close them down for 'criminal' activity or 'tax problems' instead. This has reportedly led to a higher level of behind the scenes investigations, one of which recently resulted in a club related extortion bust of a NY mob figure.

    C - from the standpoint of Manhattan dancers, it is my personal opinion that the risk of having your financial info swept up as part of a behind the scenes investigation of the club is now even higher than it was prior to the 'stay order' being issued a year ago.


    As to what this actually means in terms of risk factor for girls that are working / have worked in Manhattan clubs that are the subject of investigations, there is absolutely no way to gauge this accurately. However, there is one huge difference between investigations for 'active' crimes versus 'financial' crimes ... that the latter is not under the same sort of statutory time pressure as the former. Thus it's possible that these investigations could smoulder on for another year to avoid tipping their hand, and then all of a sudden the IRS+NYState tax+NYCity tax people could let loose a surprise barrage of indibtments/audit notices. The real worrysome aspect is that, if the investigations have been able to prove criminal intent i.e. wilful tax evasion, then the indibtments/audits could go back as many years as the club file records do !

    From a personal standpoint, while I haven't worked in NYC clubs in a few years now it is undoubtedly a fact that my real name, real SS# and real address are contained in the file records of several NYC clubs. That personal info could be easily spun off to the IRS+NYState+NYCity tax agencies and used as a source for further investigation. I'm not worried about this in the least since my past club income was properly declared, and my past tax filings and payments were all properly filed and paid at that time. However, were that not the case, I would be VERY worried right about now.

    Under the NYC zoning laws, an adult (strip) club can not be within 500 feet of a residential building, school or church. An exception is if only 40% of the Club is used for adult purposes.

    Some of the established strip Clubs in Manhattan are complying with the 60/40 adult zoning laws by splitting the Clubs up and having 60% as a bikini bar or restaurant or sports bar. The newer strip Clubs are mostly on the far West Side of Manhattan where it is completely commercially zoned and you can have adult clubs.

    ^^^ the court ruling invalidated the 60/40 exception. Thus as soon as the 'stay' order is lifted or expires, the vast majority of clubs that are NOT located on the West Side Strip will have to become NJ style bikini clubs.
