Sorry for the language but...fucken bitches derserve to get sued!!! Your story is worse than my cold leaky window I had back home. I hope that you get better soon or cough all over them instead. I dont know too much about legal stuff but sounds like theyve got something coming to them.

Oh.......honey, this landlord is gonna be sorry. I smell her nastiness is bred out of FEAR. I've seen this act before in every hustler bar manager who tried to cheat me out of pay. She's gonna lose money and she knows it. If she was in NorCal she'd be toast already.
We had some mold problems in our home, but we owned the house we were in. So it was our responsibilty. We weren't endangering strangers or neglecting our part of a rental agreement.
Your landlord is gonna try to paint you as this opportunistic troublemaker stripper who is just causing trouble and wants out of her lease. Don't be surprised if you suddenly hear stories about you and your conduct in the complex that are news to you 'cause the stories aren't true.
You seem like a sweety and I hate seeing this happening. But the world is full of bad people, your landlord seemingly being one of them. Let the courts handle it now. There's probably a few people who have fied suit against your landlord and you just don't know about it. Good luck and keep us updated.

DID YOU GO TO THE CITY INSPECTORS AND HEALTH DEPARTMENT???????

Like I said before, lawyers cannot do anything for you but sue the person (which you should do for reimbursement of medical expenses). You NEED to get the inspectors FROM THE CITY AND THE HEALTH DEPARTMENT in there and have them sanction the landlord and MAKE THE LANDLORD put you into a hotel!!

Lawyers cannot do this in split second time...it needs to be done by the city inspectors and the health department!!! As you'll soon find out...the "legal" way to do anything is going to take quite a long time.

And, make sure you get a lawyer who will work on a contingency...and make sure you have that lawyer sue the landlord for the costs of legal representation.

Before you hire a lawyer, though, you need to get the city inspector and health department down there!!

    Good luck! Keep us updated!

That woman is begging for problems and sounds like she's trying to use her venemous inconsiderate attitude to intimidate you out of taking legal action.

If you haven't already started, please start a log book of every conversation, what time you have it, where you have it, the names of anyone in the room, and what the other person is wearing.

That last part might sound a little stupid, but if you end up in a court room (and on the TODAY show...hehe) it lends to your credibility when you can point out small details like that. Also, make sure that in every case you maintain your civility. This woman is a bitch....so let her hang herself with her own rope. You are not asking for the stars and the moon, here....you're asking them to take responsibility.

Venus and Madmaxine are correct !

I went through something simular in Houston, when I discovered the foundation was shifting
and my apartment was leaning forward ( man, that was scary).
Anyway, I originally contacted the city inspectors office as well as many others.
Thats what you need to do ! Contact as many county/city officials as you can.
You should also think about contacting your local newspaper/newstation too. I also
did that and got great results. Be sure to talk to your neigbors, chances are many of them have mold as well. I was smart enough to get a group of neighbor behind me when I took on my apartment complex.
The Red Cross might be able to assist you with living accomendations, it wouldn't hurt to contact them.
Lastly, find out where the management's head office is and contact them too, via phone and certified mail. You'll find its better to keep as much of your interactions with them in writing or recorded on a small recorder. you can get them for under $50 !

Be advised though, like MM said, to have your character attacked. Especially if you go to trial. It was said that I was giving bj's all over my complex !
Stick to your guns but, try to stay as calm as possible. Mold is nothing to play w/ and black mold is even worse as it can have many longterm effects on the body.

There's nothing more "inspiring" and well-documented than a newspaper report with pictures. Not only will it "spur" on the landlord...it may help others come out of the closet and the story will be date documented (which is admissable in court).

Last weekend after I kicked a hole into my bathroom wall in a fit of anger, I found all kinds of debris inside the wall including slabs of wood, busted up sheetrock, and empty trash bags. I also found black mold all over the inside of the wall and the debris. I guess there had been some water damage from a leaky pipe from prior years. The wall is about to crumble it's so decrepit, but I wouldn't have known it unless I made the hole. How do I know whether to take a sample of the mold to get it checked out. And where do I go to get it done? I have noticed more frequent sore throats and overall sickness since I moved in there. Since making the hole last week, I've woken up every morning with a sore throat that makes my neck stiff, my nose is always stuffed up too. By the time I get to work, some of the symptoms alleviate. Is this cause for concern?

Thank you TB! I just called my bf and told him to knock out the patch we put up to cover the hole and to get some samples out of the wall. It's ALL OVER the inside of that wall and now I'm pissed because my landlady knew damn well there was water damage. Our whole fucking ceiling is warped from the water damage and it looks like some dipshit dd a quick plastering job over it to cover up any water stains. There's a dark spot as well and now I'm all freaked out.

If you could move...I would. They had a big thing of black mold in my home town ..took entire homes and all the stuff inside too. The people had too move and start over. They had to leave all thier stuff behind b/c it was infected. It was sad they had just bought new homes too.

I hope you both get better *hugs*

Hottie...just like I told TB...call your local Health Department and Building Inspector. No one can make this landlord do ANYTHING right away besides these two agencies.

And, do NOT handle the mold on your own. Big no-no...let the health department send a specialist out...and document all of your illnesses...dates, times, etc.

    Good luck!

Yuck! I lived in an appt. that I had a leak that they would NOT fix for like a week and I got mold on the feet of my sofa and I'm sure it was in the floor and walls. I even called a guy who trains mold sniffing dogs and he told me it would be very costly to find out if I had toxic mold. I even contacted an attorney about it and he said it would be costly to try to pursue and it would be better if I just stuck it out for the 3 months left on my lease and moved. Now some poor soul is living in that shit hold apt. complex I used to live in.
