    OMG- Did Ohio pass the House bill 23????

    I have been told from a certain source that the bill HAS been passed and is waiting to go into affect. If so, this will totally fuck everything up!! Dancers will have to be 6 ft from customers at all times and customers have to tip in jars while dancers are on stage. Plus ALL clubs have to close at 11pm!!!!!! How are we going to make any $$$??

    Someone please help me out with this. Thanks.

    Wow,that sucks for the industry!

    I know a few chain clubs were waiting on the outcome of this before expanding into Ohio.

    The bad part is,they would have "upped"the quality of the industry by adding higher end clubs and forcing the small dives out of business,or into "Business" that would cause them to close soon anyways.

    What this has done in other areas is to force out the quality entertainers for greener pastures and the dives still operate,after making enough changes to abide by the new unreasonable laws,then the quality of the girls drop and the extras go up.

    I hope this isnt a forcast for Ohio.There is a shitload of money in that state,more then most,even the chain im with has been looking and waiting.

    By my read, it's even worse than you think !


    Sec. 3768.04. The following requirements shall apply to an adult entertainment establishment that regularly features persons who appear in a state of nudity or seminudity or that regularly features live performances characterized by their emphasis upon the display or simulation of specified sexual activities:

    (A) No person, while nude or seminude, knowingly shall do any of the following:

    (1) Appear in the view of any patron, customer, or client unless the person remains at least six feet from the patron, customer, or client and on a stage at least two feet above the floor;


    - translation, no more nude/topless private dance/VIP rooms i.e. dancers must keep costumes on whenever they are not on stage

    (2) Receive any pay or gratuity directly from any patron, customer, or client;

    - translation, no taking of direct tips or private dance money from customers i.e. all customer money must be funneled through the club's cash register or payroll system before the club pays the dancer

    (3) Touch any patron, customer, or client, or the clothing of any patron, customer, or client.

    (B) No person, while on the premises of this type of adult entertainment establishment, knowingly shall do any of the following:

    (1) Give any pay or gratuity directly to another person who is nude or seminude;

    (2) Touch any person while that person is nude or seminude, or touch the clothing or costume of any person while that person is nude or seminude.


    - translation, provides legal grounds for busting customers as well as dancers


    According to the state law, the 11pm closing time requirement does not apply to topless alcohol clubs, but by process of elimination DOES apply to nude clubs.

    Sec. 3768.03. No adult entertainment establishment shall be open for business at any time before ten a.m. or after eleven p.m., except that an adult entertainment establishment that holds a liquor permit pursuant to Chapter 4303. of the Revised Code may remain open pursuant to the terms of the permit but may not conduct adult entertainment during the hours granted by the permit that are before ten a.m. or after eleven p.m. except for performances by persons who appear in a state of seminudity and not in a state of nudity.

    the state law does open the door for local townships to impose more strict local regulations, however.

    I would also point out that the 'no direct transactions between customers and dancers' requirement also sets the stage for forcing clubs to institute payroll systems where all of the customer's tip jar and private dance money is funneled through the club before being paid out to the dancer. This will result in a 1099 report to the IRS for the money the club pays out to each dancer, forcing all dancers to file and pay taxes on all the money paid to them by the club. This situation further encourages dancers providing 'extras', as customer 'extras' money paid directly to the dancer will be the only remaining 'undocumented' income source.

    IMHO this Ohio law combines all of the worst elements of anti-dance club laws in effect in other states and cities. It has the potential for creating a small handful of very upscale topless 'show clubs' which operate legally but which will only hire the best of the best looking dancers. It also has the potential for creating many high contact clubs which operate illegally and encourage 'extras'. It clearly has the potential for bankrupting 'middle of the road' clubs which try to operate legally but which cannot attract/satisfy either the very upscale zero contact business customers or the customers expecting contact in exchange for their hard earned money.

    With the exception of a handful of super upscale 'show clubs' (like one or two clubs in each major city), this has all of the makings of a 'revolving door' club scene ... where clubs and dancers are routinely busted, routinely cop a plea and pay a fine, and return to business as usual the next night. Well maybe not business as usual, because some dancers will quickly figure out that if they're going to wind up with misdemeanor charges on their record for breaking the anti-dance club law, taking the chance on adding a misdemeanor charge for prostitution doesn't really do any more legal damage but pays one hell of a lot more money between busts than dancing 6ft away from customers !

    There's also a new and very insidious wrinkle to this new law which, while it doesn't directly affect dancers, can have some huge indirect effects. The new law authorizes civil suits being brought against strip clubs, presumably by local residents, and directs local courts to provide injunctive relief. I think this means that if a local resident living near a strip club objects to the 'negative secondary effects' of the strip club on the local community, that the local resident can sue the strip club owner for supposed decreases in local property values etc. based on any violation of the new law. In other words, I think this means the new wrinkle opens the door for bible thumpers to organize neighborhoods and attempt to bankrupt strip clubs via legal fees and monetary awards from a civil court (i.e. the clubowner being ordered to pay every homeowner within a block of his club $10,000 each to compensate for the decreased value of their properties caused by the presence of his strip club) based on any alleged violation of the new law, with the court issuing an injunction which forces the club to close down until that money is paid. Where neighborhood groups are on the clubowner's ass, this new wrinkle could turn into a de-facto million dollar 'fine' against the clubowner for every violation of the new law.

    This is a very nasty piece of business, and if it stands up on appeal this new wrinkle could serve as a powerful new weapon for many states and cities to bankrupt or permanently order the closure of strip clubs. And even without ordering the club closed until such a judgement is paid, with the 'no direct payments between dancers and customers' requirement in effect, it would be possible for the civil court to garnish customer money away from the clubowner to pay judgements in favor of local residents BEFORE the clubowner can pay the dancers their share of the customers' money - which would quickly accomplish the same result as no dancers are going to work without being paid.

    According to the state website, this bill has been proposed and has just been reviewed by committee and approved, but has NOT YET been signed into law.

    CPG, did you write your representative? Mine is one of the co-sponsors of the bill, but I wrote anyway to let her know of my displeasure.

    I can't find when they're going to vote on it; I would like to know if BACE is staging a protest. I just sent an email to one of their guys, so hopefully I'll have some news.

    I would highly encourage all Ohio dancers to drop a line to your state rep; you can find them via Melonie's link above. Let them know that a vote for this bill loses yours.

    No wonder my city has plenty of customers from Ohio driving to visit the strip clubs! One guy told me how there's nothing in Cinci.

    Yes, Lizette your absolutely right. Here in Cincinnati, we do not have any type of strip clubs because of zoning laws/ordinances. It's extremely conservative here...The closest strip club in cincinnati is in Batavia and that is about 40 or so minutes away from Cincinnati.

    The best alternative, depending where in Ohio you are would probably go work in one of the Tri State areas (KY or IN) or MI or maybe even PA, depending on where in Ohio you are at. But I really hope something like this does not pass. But considering Ohio's conservative views on EVERYTHING I really see this bill as one that will get passed whether we like it or not!

    I live in Cincy and the one club CK is referring to is a Deja Vu. I drive up to Columbus (about 2 hrs north) to work since it's a better alternative than anything else in the area. There are a few clubs in Kentucky over the river, but they're bikini clubs; there's a pastie club in Indiana across the border, too. So the situation down here, to me, is pretty much like they already passed the law. If, god forbid, it goes through, I will drive down to Lexington or Louisville and give those spots a shot. Regardless, we won't be in Cincinnati or Ohio for long. I'm glad I have alternatives. It's ridiculous here.

    Shit, at least it's still in committee. What these asshats refuse to deal with is the fact that they aren't helping any young girls by shutting down the clubs. I mean, how much better does the future of an economically disadvantaged young woman get just because you take her out of the titty bar? Great, she can go on to cocktail waitress, where she can make less money and deal with the same shit. Or she can work retail and have shitty benefits.

    I wish that every rep who thought these places were bad for young women would get in touch with reality--it's a combination of our society and our economy that makes this such a good damn alternative. I'm sure plenty of dancers would love to have their educations and child care paid for so they can get by on a variety of part-time jobs with decent living wages and benefits instead of just having one most lucrative opportunity. Leaving more room of course for us committed professionals.
