    Angry I'm being sued

    I'm new here but I need your help.
    We're being sued by a guy who says we caused his harm for his
    bachelor party. We received the subpoena on friday. They're suing
    us for 75 000 $. Me and 2 other girls are named by our stage names.

    They're saying that they had to postone the wedding because we wrote stuff on his face with a magic marker and that it cost them
    a fortune. I find that really suspicious.
    1- Who the hell has his bachelor party the day just before the wedding.
    2- It's a magic marker not a tattoo needle, that stuff comes off

    He also says that we handcuffed him, harmed him physically and relieved him of his clothes.
    1- What about his buddies that had him brought up for 100 $
    2- We didn't drag him on stage kicking and screaming. He could
    have said no. If he got too drunk that's his problem.

    I'm really scared that the club owner will use us 3 as scapegoats
    to wash his hands. There is no way that someone can say that it was only us 3 on the stage. There are at least 6 or 7 girls on one guy for these shows.
    I've been in this buisness for 8 years and it's the first time that
    someting like that has happened.

    I'm really scared because you always hear about these crazy million dollar suits by people for finding stuff in their food or other silly things and sometimes they actually win. Any feedback would be appreciated.

    Well from my point of view (me being a Judge Judy watcher lol) I really dont' think that he has a case. There is no merit. He had a bachelor party. He gets drunk, has the girls dance for him, then it's over!

    The fact that he had to postpone his own wedding is between him and his bride. Honestly majic markers can be cleaned off. And if it was THAT bad..which I highly doubt, he could've easily used some makeup remover to breakdown the markers ink. Like I said, this case will not go far at all. You could probably be your own respresentation. But I still think you should talk to a lawyer!

    Wow so uncool of him to sue. Im wondering if he really has a case being he was drunk?
    If he was very drunk then wouldnt his friends act in his best interest instead of letting him due the full show?
    Something to me smells shady about this? Then again I am no lawyer ..Im curious to hear other opinions on this...

    Wow, OK...

    First of all, and I don't want to sound like I'm against you, but you can't just assume that the wedding isn't the next day. It's uncommon for it not to be but it still happens. And even if it isn't, that doesn't mean that he is not going to see his fiancee the next day either. As a rule of thumb, we generally do not leave marks on the guy that take a long time to remove (e.g. permanent marker). If we do mark the guy, we use lipstick and we'll put it on his back or his ass so he can hide it under his clothes or wash it off when he gets home. His face is a *little* too obvious...

    And for the second thing, did you make the guy's friends aware that you'd be stripping and hitting him? We generally tell the bachelor group in advance what we intend to do so noone says we didn't say so. As for the bachelor, if he was in pain and didn't want to be stripped, he should have said so. But I hope that you didn't hit him way too hard.

    I really wouldn't know what to say in such circumstances. Just get yourselves a really good lawyer. I hope some of the others may have good advice for you.

    I'm really sorry about the whole thing, but good luck. I hope it won't come to you actually getting sued.

    edit to say: he's asking for a large amount of money. I doubt considering the circumstances that he will get this much from you at all, even if he did win. That seems a bit extreme. All in all, he would have known what went on in bachelor shows, it hardly sounds like anything nobody would've heard of.

    That's crazy!! What a wuss!! I'm not a lawyer but I don't think this guy has a strong case. But you girls make sure YOU have strong arguments; maybe try to find previous bachelors that could testify in your defense (look within the club's circle..) witnesses that were there that night; regulars, employees, DJ. Bring the marker you used or a similar one and PROVE that it can be washed off. Bring the handcuffs. Find anything or anyone that could help you with this. Good luck and keep us posted.

    I think you should consider retaining your own legal counsel; don't rely on the club's attorney to protect you.

    A good lawyer will have this case settled out of court with minimal actions.

    All a lawyer has to prove is this individual consented to all the tomfoolery that transpired and it's a done deal.

    I wouldn't get yourself in a tizzy but instead redirect that energy into finding a really aggressive lawyer that wants to also collect damages from the sexual assault that you sufferred during the said bachelor party.

    Jen, dont worry about it. Nothing will happen, in my opinion, especially when your lawyer tells him you are going to subpoena his fiance, bridesmaids and buddies and find out all their dirty sexual secrets in court ..gasp!!!. His suit is a scare tactic to get you girls to settle the case by giving him a few thousand dollars. He cannot afford a lawyer to fight it all the way through court since he just spent money on a wedding and also his lawyer probably knows you three girls dont have $75,000 in the bank. Think about it, their is no proof yet that there was a wedding or that $75,000 was lost.

    Get a lawyer to go through the motions of paper filing.

    I am not at my own computer, so I can't write a big response now. Please send me a pm though - I have some definite ideas about this.

    Even though I am not practing right now I do have a law degree and have been admitted to the bar - I have done research in the area of adult entertainment law and have heard of some cases like this.

    We need to talk and definitely don't rely on the club's attorney.

    Don't talk about the case until you talk to an attorney.

    1- I've known quite a few guys who have had the party on the night before. Stupid, IMHO, but not uncommon.
    2- When was the last time you've attempted to remove magic marker from your face? Hands are one thing, face is another.

    These are both valid points of his and can cause a wedding to be rescheduled thereby costing the couple a significant amount of money, BUT...

Fortunately, I could hide everything with clothing.

    Regardless, I don't really think he has much of a civil case. Now if he presses criminal assault charges, that might be another matter. I don't really know.

    For the record...Magic Marker DOES NOT come off the face easily. I found out the hard way when my older brother thought that a mustache would be becoming on me. I got MOST of it off with oil and alcohol...but you could still faintly see it for several days afterwards...it is easily absorbed into the skin.

    In his lawsuit, all this guy has to say is that he was "forced" onto the stage...handcuffed so he could not move and "victimized". He has a valid claim. While it's fine to "abuse" the bachelor...it has to be consensual...and it should never leave lasting impressions.

    After all is said and done...if he has pictures, IMHO, you may be in for a long ride. As with what everyone else says...get your own lawyer. A club lawyer is paid to look out for the club's butt...make sure you find a lawyer to look out for yours.

    I'm gonna see if I can get Stant or GreenBeret in here...

    A few points.
    Is it really that hard to remove magic marker of the face ? I mean it's only ink.
    We don't usually write on their face, usually we write silly stuff on their back
    and their chest but you know when you have 6 or 7 girls on a guy some of
    them get a little carried away so you can never predict exactly what will happen. It's impossible to control. Like I've seen girls go really wild with the guys belt but what can you do.
    But I have to admit that it makes us look really bad. And specially the fact that we have the guy handcuffed. One thing is for sure though he didn't get
    dragged on stage. Usually the DJ just calls the guy up and he walks up there
    by himself. Of course he cannot know what we have planned we call it
    a ''special dance'' but his buddies do.
    Another problem is that there is no way for us to remember the guy or what happened exactly. We do those shows all the time. So he will remember it a lot more than we do and he will look more credible than us*.
    One thing is for sure that no one can say who was on stage that exact night.
    That's the reason why I think that the owner will try anything to save his ass.
    Of course when you have a bunch of strippers in court against a respectable
    guy the judge will tend to believe him more than us.
    All you opinions are appreciated. I'm really freaking out but you're really helping me out.

    Jen, the difference is... you're a person and the people who lose those crazy million dollar lawsuits are big organizations. This will get laughed out of court. The only people who will take his side were never on yours in the first place.

    Someone should tell that guy that hairspray can get it off. Then if that doesnt work, have him wear latex or makeup or something to his wedding. He is full of crap, and I highly doubt he would win that lawsuit. Plus, if he doesnt have any bruises or anything on him, he cant just say he was abused, because the judge will say, did you go to the emergency room? Well no, he didnt. So it must not have been all that painful? Its absolutely ridiculous, and if you have a judge like I did when some girl said I tried to hit her with my car, the judge will throw that mess out.

    First of all, I hope everything works in your favor. This really sucks and I'd hate to have to go thru it (which is why I don't do onstage bachelor parties anymore). However, this guy may have a case. The very last BP that I did, the other dancer and I used magic marker all over him, playfully beat him with a belt, and our lovely DJ insulted the hell out of him (I later found out this gent had been battling his weight for a year after an illness and thought he was making great progress until the DJ pointed out how fat he was, even though he really wasn't THAT overweight). His buddies had NO IDEA we would do that and thought it would be more of a sexy show. He was horrified, they were horrified, and ended up getting $60 of their $100 back (the other dancer and I kept our money).

    Another time a guy got the "Bachelor Beat Down" (spanking, marker, insults, undressed, etc..) and demanded the dancers uncuff him and ran off the stage and out the door humiliated with most of his friends in tow.

    Both times, we could've been sued for intimidation, emotional distress, etc...We've never been sued, but it sounds like a lawsuit waiting to happen. I wouldn't be so quick to dismiss this or think the guy's case will be thrown out of court. Best advice: retain your own attorney. The club's attorney will look out for THE CLUB, not you.

    Never in a million years would I allow a friend of mine to go up on stage during a bachelor party. I don't know how this came to be "the way it's done," but man, when they drag a bachelor up on stage for one of those things, it just gets really sadistic. It's almost like the girls are taking out some frustration on the guy.

    oh they are taking out frustrations on the guy. not all girls but i see the same ones getting carried away.
    one club i worked at they beat the shit out of the guy with his belt. it was voulntary to go up there, and it was ALWAYS the same girls that did it.

    back on topic. i remember hearing of a similar case here in fl. it didnt fly.

    pretty soon bachelors are going to have to sign a waiver and get a notary to authenticate it.

    *sigh*

    bachelor parties can get pretty cruel, but at least ONE of the guys at the party would have known what was going to happen at it. It's done the same all across the country and it's a service he paid for. That would be like going to that restraunt Dicks and suing them for emotional distress after they insulted you. Bullshit.

    First up I wanna say that I hope it works in your favour too - you obviously didn't want to cause distress to the guy. You were just doing your job and now you're dealing with shitty legal stuff. Yuk!

    I am agreeing with the main points made by Venus Goddess and Amethyst. Get your own attorney and start working out exactly what it was that YOU did that night (as opposed to the other girls, the DJ etc.). You could be in for a long and nasty ride over this.

    I also gotta agree with Mr.Hyde - I would never put one of my buddies up for this kind of thing, but I guess they have become a tradition, and the stuff that you outlined that happened can easily be described as "standard". This still may not save you from assault charges.

    I was involved as one half of a duo in a non-stripping related industrial case about 10 years ago. I am mentioning this because if you knew the details - including the absolutely shitty, worthless "case" that our complainant was lodging against us - you would also have thought there is no way he would even be listened to in a court. It was taken to an industrial commission and the guy won. Not a year later, he made headlines accross the country pulling a similar scam with another organsiation. The individual was one of those people you really wish you'd never have met, and made it his business to get as much milage from his cases in every aspect.

    I have never underestimated people's willingness or propensity to use the legal system since. I know male stripping is different, but I do get a lot of hen shows. I ALWAYS whisper to the hen what it is I am about to do before I do it if it involves handcuffs, picking her up or anything like that that could be construed as something else later. If the hen is really drunk, I leave all my "tricks" out and just dance. I take no chances as the world has become to letigious.

    Babe- I hope you get this taken care of. When does this go to court? Also, is a subpoena with the dance names legal? I mean- don't you have to have the real names? The club can't give them out... not like it can be hidden if it goes all the way to court, but this makes me think that since they have false names, then the club is really the people they're after.

    The permanent marker thing is a bit extreme, but then again, I leave big bite marks around men's nipples (through a dollar bill) as part of my schtick so who am I to talk?
    Good luck, get a lawyer, cover your ass and as mercenary as it sounds-- you really can't worry about the other girls unless you trust them to be on top of their legal shit too so you don't ALL go down.
