Your major obstacle will likely be the Tracy Lords law a.k.a. section 2257. Just about the time that you have completed your investment of time and money to get your webcam operation off the ground, your 'performers' will be faced with complying with the 'adult proof of age' requirements of this law. To do that, according to many adult entertainment attorneys, will require that the girls post their real names, real addresses, and real ages on their webcam page for anyone surfing the internet to see (because webcams are considered to be 'live' adult content). Failure to do that will expose them, and more importantly YOU as webmaster, to potential felony 'child porn' charges and going through life as a registered sex offender.
The enforcement of the Tracy Lords law on websites and webcams was delayed as a result of the Ashcroft controversy last year. However, there is every indication that the Attorney General's office will still move ahead under Gonzales. I considered this to be such a risky deal that I quit doing webcam myself.
When the Tracy Lords law is brought to bear on webcams, you'll be faced with a choice of limiting your webcam models to absolutely zero sexual contact (i.e. no breast or cookie touching) and attempting to sell that to internet customers, versus convincing your webcam models to post their personal info publicly on the webcam page.
Obviously, attempting to operate on a 'trust factor' would be very much like clubowners attempting to operate with the same 'trust factor' in regard to girls giving extras in the VIP room. The significant difference of course is that a clubowner will not be busted for prostitution if a dancer is caught giving 'extras' in his VIP room, whereas a webcam webmaster could be brought up on felony Section 2257 'child porn' charges if one of the webcam girls is caught doing 'extras' on camera without her real name, real address and real age being posted on the webcam page. I'm told that it won't matter if the girl in question is actually underage or not, only that the webmaster and girl have failed to prove in advance that the girl is over 18 per the specific Section 2257 requirements of posting the girl's real name, real address, and real age on the webcam page.
Also, besides the Tracy Lords law, there have also been some recent prosecutions of webmasters who, even though they lived in a state where the adult content was perfectly legal, and even though their web server was located in a state where the adult content was perfectly legal, were arrested on warrants and tried in courts of communities in different states which considered the webmaster's content illegal and also considered the webmaster's delivery of that illegal content to local residents of their community to be a crime. I considered this to be a rising risk factor as well and took down my pay website because of it.
