    Default Down Payment refund?

    I need some advice. I spoke to a plastic surgeon on Thursday and decided to have some work done. They asked for a $900 downpayment on the anesthesiologist(sp?) for the surgery on Monday, May 23. Friday Night I realized that because of school and financial situations, Im not going t be able to do it anymore. Because Im not sure when,(or if I even really want to) do it anymore, I would like to get my money back. I tried callingon Friday to let them know but they had already closed and will not open til monday.Does anyone know if they'll return the money? The Dr. was DR Farella in Ny and they didnt mention anything about any financial policies. Does anyone have some info or advice? Thanks...

    The answer will probably depend on whether or not the anesthesiologist was provided with adequate notice to schedule another surgery for monday May 23rd. In reality, it may also depend on how likely it is that you will seek a future surgery with the same plastic surgeon, versus the plastic surgeon's office figuring that you are a 'lost cause'.

    His assistent told me that a previous patient had cancelled on Monday, 23rd b/c she found out she was pregnant. What should I say in order to try to obtain my refund?

    Leave the doctor's office with the clear impression that you are merely RESCHEDULING to an as yet unknown future date due to developments at school (i.e. tuition increase or some such argument) , but that you are still VERY interested in having this particular doctor perform the procedure sometime later this year once the current school issues are behind you.

    None of the paperwork has anything about any refunds, nor does his site. The reciept doesnt say anything either. Thanks so much for all of the advice. I'll keep you posted on what happens tomorrw...Thanks again!

    Isn't there some kind of "law" that demands a refund of deposit or something within 3 business days? I thought there was. When I was in the health club biz...all customers had a mandatory 3 day "grace period" in which they could get a full refund.

    re any legally mandated "grace period', my guess would be that if there was any actual state law driving such a requirement that the law would only apply to specific types of transactions i.e. real estate rental deposits, used car purchases, that sort of thing. Seeing as how plastic surgery is probably not even considered to be a 'retail transaction', I seriously doubt that any specific relief would be spelled out under state law.
